Board of Zoning Adjustment to consider a request to withdraw BZA 85 -67, submitted by Carter Enterprises. IV. NEW BUSINESS A. Board of Zoning Adjustment to conduct a public hearing relative to BZA 86 -03 submitted by Landmark Homes and consideration of the same. B. Board of Zoning Adjustment to conduct a public hearing relative to BZA 86 -04 submitted by .Bob Fail and consideration of the same. C. Board of Zoning Adjustment to conduct a public hearing relative to BZA 86 -05 submitted by Weekley Homes and consideration of the same. D. Board of Zoning Adjustment to conduct a public hearing relative to BZA 86 -06 submitted by Weekley Homes and consideration of the same. E. MINUTES Board of Zoning Adjustment to consider the Minutes of the meeting of December 5, 1985. IN ACCORDANCE WITH ARTICLE 6252 -17, V.A.T.C.S., AS AMENDED BY CHAPTER 227, ACTS OF THE 61ST LEGISLATURE, REGULAR SESSION, THE REGULAR BOARD OF ZONING ADJUSTMENT REGULAR MEETING AGENDA WAS PREPARED AND POSTED ON THIS THE 31ST DAY OF JANUARY, 1986. -CITY SECRETAR STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas met in regular session February 6, 1986 at 413 Main Street, in the Council Chambers, Grapevine, Texas with the following members present to wit: Doug Lamb Bill Waldrip Ron Troy Gerald Thompson Garry Tischler Kay Gilliam constituting a quorum, City Staff present to H. T. (Tommy) Jim VanTreese Joy Carroll Pete Eckert Gerrie Taylor Chairman Vice-Chairman Secretary Member Member 1st Alternate with John Ferguson absent, and the following wit: Hardy Director of Community Development Assistant Building Official Administrative Assistant Attorney, City Attorney's Office Secretary CALL TO ORDER In the temporary absence of Chairman Doug Lamb, Vice-Chairman Bill Waldrip called the meeting to order at 6:00 P.M. OLD BUSINESS BZA 85-67 - Carter Enterprises The item under old business was for the Board of Zoning Adjustment to consider the withdrawal of BZA 85-67, Carter Enterprises. Tommy Hardy stated that Mr. Carter has requested his case be withdrawn because of various problems. Ron Troy made a motion to grant the request that the case be withdrawn. Garry Tischler seconded the motion which prevailed by the following vote: Ayes: Waldrip, Troy, Thompson, Tischler, Gilliam Nays: None Absent: Lamb, Ferguson NEW BUSINESS BZA 86-03 - Landmark Homes The first item of new business was for the Board of Zoning Adjustment to consider the request of BZA 86-03, Landmark Homes who is requesting an exception to Grapevine Zoning Ordinance 82-73, Section 15.G.1 and G.3 which requires a thirty foot (30') front yard setback and a six foot (6') side yard setback. The slab was set 0.61 into the front yard setback and 3.5' feet into the side yard. Staff recommends approval. Macon Foster with Landmark Homes, 5949 Sherry Lane, #700, Dallas, took The Oath of Truth and spoke in regards to the variance request. Macon Foster explained they had poor workmanship in setting up and measuring the forms for the foundation. He also stated they now have surveyors to measure before the foundation is poured. Without further input from the public, Ron Troy made a motion to close the Public Hearing. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Waldrip, Troy, Thompson, Tischler, Gilliam Nays: None Absent: Lamb, Ferguson Board of Zoning Adjustment February 6, 1986 Page 2 After further discussion from the Board Members, Gerald Thompson made a motion to grant the variance as requested. Kay Gilliam seconded the motion which prevailed by the following vote: Ayes: Waldrip, Troy, Thompson, Tischler, Gilliam Nays: None Absent: Lamb, Ferguson BZA 86-04 - Bob Fail The next item of new business was for the to consider BZA 86-04, Bob Fail, who application for 3004 Columbine, Lot 11, The eight year old home has recently been encroachment on the east side and a ten i west side was detected at the time of the approval. Board of has su Block 7, sold and rich (10") survey. Zoning Adjustment Dmitted a variance Oak Creek Estates. a six inch (6") encroachment on the Staff recommends Bunny Eklund, 1200 South Main Street, Grapevine, took The Oath of Truth. Mrs. Eklund who is representing Mr. Fail, stated that the Mortgage Company is requesting the variance request in order for the new purchaser to get their loan. After further discussion, Ron Troy made a motion to close the Public Hearing. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Waldrip, Troy, Thompson, Tischler, Gilliam Nays: None Absent: Lamb, Ferguson Without any further discussion among the Board Members, Ron Troy made a motion to grant the variance as requested. Kay Gilliam seconded the motion which prevailed by the following vote: Ayes: Waldrip, Troy, Thompson, Tischler, Gilliam Nays: None Absent: Lamb, Ferguson NOTE: At this point of the meeting, Chairman Doug Lamb arrived. BZA 86-05 and BZA 86-06, Weekly Homes The next item of new business was for the Board of Zoning Adjustment to consider the request of BZA 86-05, BZA 86-06 Weekly Homes who is requesting an exception to Grapevine Zoning Ordinance 82-73, Section 15, G.1, which requires a thirty (30') foot front yard setback. The request is for 605 and 607 Huntington Court, Lots 24, and 25, Block 10, of Glade Crossing I-B. 607 Huntington Court has an encroachment of ssix and one-half feet (-'6112') and 605 Huntington Court has an encroachment of t-en feet (10) in the required thirty foot (30') front setback. Rick Shaver of 9512 Folkstone, Dallas, 75220, took The Oath of Truth and explained that the contractor measured from the back of the curb than from the property line when setting up the forms for the foundation. After the house had been roofed and all the mechanical installed, they noticed the encroachment and applied for the variance. Without anyone else for or against the variance, Gerald Thompson made a motion to close the Public Hearing. Bill Waldrip seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: Ferguson There was discussion among the members on modifying the gable in front to bring the house into conformance. Rick Shaver stated that the roof design could be modified but it would be a great expense. Board of Zoning Adjustment February 6, 1986 Page 3 After further discussion, Ron Troy made a motion to grant the variances for 605 and 607 Huntington Court as requested. Garry Tischler seconded the motion which prevailed by the following vote: , Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: Ferguson BZA 86-07, BZA .86-08, BZA 96-09, J. R. Bowling, Inc. The next item of new business was for the Board of Zoning Adjustment to consider BZA 86-07, J. R. Bowling, Inc. Chairman Lamb stated that BZA 86-08 and BZA 86-09 had been withdrawn by Mr. Bowling. Tommy Hardy stated that Mr. Bowling is seeking a variance to Grapevine Zoning Ordinance 82-73, Section 15.G.1 which requires a thirty foot (301) front setback for 325 Springbrook Court, Lot 15R, McClelland Addition. This structure encroaches nine feet (9') into the front yard requirement. Staff recommends approval. Patrick Meyer, 210 Park Boulevard-, Suite 100, Grapevine, took The Oath of Truth. Mr. Meyer, who is representing J. R. Bowling explained that when setting up the forms for the foundation, it was measured from the curb instead of the property line. He stated that now they set forms by string line and a surveyor locates the pins. With no further comments from the public, Garry Tischler made a motion to close the Public Hearing. Ron Troy seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: Ferguson There was concern from the Members on how the measuring for the foundation was missed by nine feet (9'). Mr. Meyer explained that their contractor made the mistake when measuring. With no further discussion Ron Troy made a motion to grant the variance for BZA 86-07 as requested. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: Ferguson Garry Tischler then made a motion to accept the request for withdrawal from Mr. Bowling for BZA 86-08 and BZA 86-09. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: Ferguson MISCELLANEOUS REPORT AND/OR DISCUSSION There was discussion among the Members and Staff about how the inspectors could watch more closely when foundation forms are set up to prevent a lot of the problems of encroachments. CONSIDERATION OF MINUTES Board of Zoning Adjustment to consider minutes of the following meetings: January 2, 1986, and February 6, 1986 The motion was made by Garry Tischler to approve both sets of minutes.
