OATH OF TRUTH is, - •: 1 Z A. Board of Zoning Adjustment to consider a request on BZA 86 -12, submitted by Charles Yancy Homes and consideration of the same. B. Board of Zoning Adjustment to consider a request on BZA 86 -13, submitted by The Church of Jesus Christ of Latter -Day Saints and consideration of the same. C. Board of Zoning Adjustment to consider a request on BZA 86 -14, submitted by Mr. Randy Howell and consideration of the same. 1. IV. NEW BUSINESS - JOINT PUBLIC HEARING Items A,B & C are deemed to need little Board of Zoning Adjustment deliberation and will be acted upon as one item. However, any member of the Board of Zoning Adjustment or member of the audience may request that an item be placed before the Board for full discussion. A. Board of Zoning Adjustment to conduct a public hearing relative to BZA 86 -16, submitted by Landmark Homes and consideration of the same. B. Board of Zoning Adjustment to conduct a public hearing relative to BZA 86 -17, submitted by Landmark Homes and consideration of the same. C. Board of Zoning Adjustment to conduct a public hearing relative to BZA 86 -23, submitted by Ryland Homes and consideration of the same. V. NEW BUSINESS - PUBLIC HEARING A. Board of Zoning Adjustment to conduct a public hearing relative to BZA 86 -19 submitted by Mr. & Mrs. Norris Y. Palmer and consideration of the same. B. Board of Zoning Adjustment to conduct a public hearing relative to BZA 86 -20 submitted by Mr. Dave Huffman and consideration of the same. C. OF ZONING ADJUSTMENT REGULAR MEETING AGENDA WAS PREPARED AND POSTED ON THIS THE 28TH DAY OF MARCH, 1986, BY 5:00 P.M. STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for regular session April 3, 1986, at Chambers, Grapevine, Texas with the Doug Lamb Bill Waldrip Ron Troy Gerald Thompson Garry Tischler Kay Gilliam John Ferguson the City of Grapevine, Texas met in 413 Main Street, in the Council following members present to wit: Chairman Vice - Chairman Secretary Member Member 1st Alternate 2nd Alternate constituting a quorum, with Council Representative Ted Ware present and the following City Staff present to wit: H. T. (Tommy) Hardy, Director of Community Development Jim VanTreese Assistant Building Official Joy Carroll Administrative Assistant Adrienne Leonard Attorney, City Attorney's Office Gerrie Taylor Secretary CALL TO ORDER Chairman Lamb called the meeting to order at 6:05 P.M. OLD BUSINESS BZA 86 -12, Charles Yancey Homes The first item of old business was for the Board of Zoning Adjustment to consider BZA 86 -12, Charles Yancey Homes who is requesting a variance from Grapevine Zoning Ordinance 82 -73, Section 15.G.1 which requires a thirty (30') foot front setback at an existing house located at 3529 Edgehill, Lot 8, Block 3, Woodland Hills Addition. Jim VanTreese explained that due to the misunderstanding about the meeting time, Charles Yancey was late in arriving and the case was denied for lack of prosecution, but was refiled within the allotted ten days. Staff recommends approval. Charles Yancey of Charles Yancey Homes took the oath of truth and stated that the mistake was made when the concrete men measured from the curb line instead of from the property line. With no one for or against this request, Ron Troy made a motion to close the Public Hearing, Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: None After further discussion, Garry Tischler made a motion to approve the variance as requested. Ron Troy seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: None BZA 86 -13, The Church of Jesus Christ of Latter- Day - Saints The next item of old business was for the Board of Zoning Adjustment to consider BZA 86 -13, The Church of Jesus Christ of Latter - Day - Saints, whose case was tabled at the last meeting because all property owners within 200' were not notified. The Church of Jesus Christ of Latter -Day- Saints are asking for a variance to Grapevine Zoning Ordinance 82 -73, Section 15.H.2, R -7.5, Single Family, which allows accessory structures to be a maximum of sixteen (16') feet. The purpose of the request is for a free - standing 49.4' tower to be erected, a 33.4' exception to Grapevine Zoning Ordinance. Staff recommends denial. Board of Zoning Adjustment April 3, 1986 Page 2 Bill Fowkes, with the Church of Jesus Christ of Latter - Day - Saints took the oath of truth and explained that all their Churches have the same structures which creates a symbolic feeling among church members which they would want to maintain with the structure. Brad Franks, the property owner next door to the church property took The Oath of Truth and spoke in favor of the request. Andrew Quinn, property owner north of the church property, took The Oath of Truth and spoke in favor of the request. With no further discussion, Ron Troy made a motion to close the Public' Hearing. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: None After further discussion, among the members, Gerald Thompson made a motion to grant the variance as requested. Garry Tischler seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: None BZA 86 -14, Randy Howell The last item of old business was for the Board of Zoning Adjustment to consider BZA 86 -14, Randy Howell, whose case was denied at the last meeting because lack of prosecution, due to a misunderstanding relative to the meeting time. Mr. Howell is requesting an exception to Grapevine Zoning Ordinance 82 -73, R -7.5, Single Family District Regulations, Section 15.G.1, 2 & 3, front, rear, and side yard setbacks, for his lot on Placid Circle Drive, Lot 6, Block 2, of the Placid Peninsula Subdivision. Randy Howell took The Oath of Truth and explained that there is no lot area to build anything feasible, and what he intends to build will be more uniform with the other houses. With no further discussion, Ron Troy made a motion to close the Public Hearing. Bill Waldrip seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: None After further discussion, Gerald Thompson made a motion to grant the variance as requested. Ron Troy seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: None NEW BUSINESS BZA 86 -16, BZA 86 -17, Landmark Homes BZA 86 -23, Ryland Homes The first item of new business was for the Board of Zoning Adjustment to consider BZA 86 -16, and BZA 86 -17, Landmark Homes, and BZA 86 -23, Ryland Homes who is asking for a typical off - street parking variance to Grapevine Zoning Ordinance 82 -73, Section 15, for temporarily deleting the drive for model home sales office at 4110 and 4106 Countryside Drive, and 609 Drexel Drive. Staff recommends approval. Barry Cammack of Landmark Homes took The Oath of Truth and spoke in regards to their model home park in Countryside Estates. Mike Kuykendall of Ryland Homes took The Oath of Truth and spoke in favor of the request for their model home. Board of Zoning Adjustment April 3, 1986 Page 3 With no one for or against the requests, Garry Tischler made a motion to close the Public Hearing. Bill Waldrip seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Nays: None Absent: None During further discussion, there home request in the past had ever stated this would be looked into. Tischler made a motion to grant Waldrip seconded the motion which Troy, Thompson, Tischler was question among members if model been converted back. Mr. Hardy With no further discussion, Garry all variances as requested. Bill prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: None BZA 86-19, Palmer The next item of new business was for the Board of Zoning Adjustment to consider BZA 86-19, Mr. & Mrs. Norris Y. Palmer, who are requesting an exception to Grapevine Zoning Ordinance 82-73, Section 15.G.1 and 2, Single Family District Regulations for the property legally described as Lot 9, Block 1, Grapevine Lake Estates. The Palmers are asking for a variance from the twenty-five (25') rear yard to be reduced to a zero rear yard, and the thirty (30') foot required front yard be reduced to ten (10') feet. Staff recommends approval. Norris Palmer, owner of the property, took The Oath of Truth and stated that most of the trees would be saved if the house is built according to the plot plan. Jimmy Mundell of 3570 Oakwood Drive took The Oath of Truth and spoke against the request and expressed concern about Redbird Lane and Oakwood Drive not meeting and this house not having access to a City maintained street. Tommy Hardy stated that where Redbird Lane and Oakwood Drive meet is a dedicated, unimproved City street. Bill Sutter of 3548 Redbird Lane took The Oath of Truth and stated that he was concerned about access to the property, and feels that the value of his house and property will decrease if the Palmers do not build according to the building code. Dan Driskell, builder and architect of the project took The Oath of Truth and spoke in favor of the request. He stated that the house plans had been drawn up especially for this lot in order to save trees and to blend in with other houses. Victoria Butler of 3543 Redbird Lane, took The Oath of Truth and was also concerned about the street and there being a drainage problem from the removal of trees from the Palmer's lot. A letter from Edmond and Eleanor Matheson was read into the record by Joy Carroll dated March 27, 1986 concerning the case. Also as requested, a memo from Staff Engineer, Doug Eberhart concerning the drainage was read into the record. David Butler of 3543 Redbird Lane, took The Oath of Truth and spoke in objection to the survey Doug Eberhart had made concerning the drainage of the property. There was concern among the Board members concerning the street. Council Representative Ted Ware stated that Council probably will not make the street go through since land would have to be purchased and if property owners are not in favor of it going through. Mr. Palmer also brought up that a variance had been granted on the property in the past, but the building was never started. In reference to BZA 81-1, submitted by Earl Lynn and John Smith, the variance was granted providing for a zero rear yard requirement; providing for a twenty foot front yard; and further providing that the Board of Zoning Adjustment April 3, 1986 Page 4 partial subdivision plats of Grapevine Lake Estates and Placid Peninsula, as introduced, be made a part of the record of the application. There being no one else to speak for or against the request, Garry Tischler made a motion to close the Public Hearing. Ron Troy seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: None After a ten minute recess the meeting was called back to order by Chairman Lamb at 8:45 P.M. During further discussion, Bill Waldrip stated he was concerned with the ten (10') foot front yard more than the rear yard since the property does back up to Corp property. After lengthy discussion among members, Gerald Thompson made a motion to grant the variance with a ten (10') foot variance off the front setback and a twenty-five (25') foot variance on the rear setback. Bill Waldrip seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson Nays: Tischler Absent: None The motion carried and the variance was granted as stated. BZA 86-20, Dave Huffman The next item of new business was for the Board of Zoning Adjustment to consider BZA 86-20, Dave Huffman, who is requesting a variance from Section 54 of the Zoning Ordinance which requires seventy (700) percent of the exterior building in "LI", Light Industrial zoning be of masonry material. This will apply to an addition to an existing building which was built before the present masonry requirements were imposed. Dave Huffman of 1943 Shoreline Drive, Grapevine, took The Oath of Truth and spoke in favor of the request. There being no one else to speak for or against the request, Gerald Thompson made a motion to close the public hearing, Garry Tischler seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: None After further discussion, Gerald Thompson made a motion to grant the variance as requested. Garry Tischler seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: None BZA 86-21,, Drees Homes The next item of new business was for the Board of Zoning Adjustment to consider BZA 86-21, Drees Homes, who is requesting an exception to Grapevine Zoning Ordinance, Section 15.G.1, R-7.5, Single Family District Regulations for a 6/10' front yard encroachment on an existing house at 4169 Harvestwood Drive, legally described as Lot 18, Block 2, Countryside East. Staff recommended approval. David Heimerman, of Drees Homes, took The Oath of Truth and stated that this was the first house started on this street and the error was not noticed until the Mortgage Company had the lot surveyed. There being no other comments from the public, Bill Waldrip made a motion to close the public hearing. Garry Tischler seconded the motion which prevailed by the following vote: Board of Zoning Adjustment April 3, 1986 Page 5 Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: None The Board Members asked what procedures Drees Homes would take to prevent this from happening in the future. David Heimerman stated that the lot would be surveyed and in measuring, they will allow an extra foot. After further discussion, Garry Tischler made a motion to grant the variance as requested. Ron Troy seconded the motion which prevailed by the following vote: Ayes: Lamb. Waldrip, Troy, Thompson, Tischler Nays: None Absent: None BZA 86-22, Walmart Sign Shop The next item of new business was for the Board of Zoning Adjustment to consider BZA 86-22, Walmart Sign Shop who is requesting a variance to Grapevine Zoning Ordinance 82-73, Section 60, relative to Sign Standards, to allow an addition to their pole sign and to erect signage on their wall which will exceed the maximum 64 square feet allowed by Ordinance. Staff recommended denial. Joe Stamps, with Walmart Stores, took The Oath of Truth and explained that the "Prescriptions" sign will be added to the existing pole and will replace the sign that was there but removed when the Pharmacy changed hands. The new automotive signage on the building will identify the facility and service available for customers. . Ron Troy made a motion to close the public hearing. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: None After further discussion, Gerald Thompson made a the auto center sign not exceed two (2') feet in (16') feet in length to be mounted on the building,and grant that the prescription sign not either side of the existing pole standards that Tischler seconded the motion which prevailed by t Ayes: Lamb, Troy, Thompson, Tischler Nays: Waldrip Absent: None The variance was granted as specified. BZA 86-24, Stan Heitman motion to grant that height and sixteen front wall of the exceed one (1') foot are there. Garry ae following vote: The next item of new business was for the Board of Zoning Adjustment to consider BZA 86-24, Stan Heitman who is requesting a variance from Grapevine Zoning Ordinance, Section 42.D, relative to corner lots and Section 15.G.1, relative to front yard requirements. The house is to be removed five (5') feet away from Mercury Drive. This will result in a one (1') foot encroachment into the side yard between the lots. The reverse frontage on the Peninsula side has a fifteen (15') foot encroachment, the garage is to be moved back five (5') feet to put the garage door twenty (20') feet from property line as per zoning requirements. Stan Heitman, who is requesting the variance, took The Oath of Truth and spoke in favor of the request. Ted Ware also spoke in regards to reverse frontage lots being hard to build on. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: None After further discussion, Bill Waldrip made a motion to grant two items for one variance, a one (1') foot encroachment on the 120' side of the property and a fifteen (15') foot variance on the Peninsula Drive side of the property. Ron Troy seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: None BZA 86-25, Robert Dixon The last item of new business was for the Board of Zoning Adjustment to consider BZA 86-25, Robert Dixon, who is requesting a variance to the rear yard setback requirement at 3008 Double Creek, legally described as Lot 4, Block 4, Creekwood West, which would be encroached upon by connecting the garage to the house. That would change the rear yard requirement from six (6') feet to twenty-five (25') feet and separation from house, ten (10') feet. This variance is for the purpose of adding an exercise room for the Dixon's eighteen year old son who recently suffered from a brain tumor which left him blind and partially paralyzed. Robert D. Dixon took The Oath of Truth and explained the reason of the variance requested and that he would be adding approximately 800 square feet. With no one else for or against the request, Garry Tischler made a motion to close the public hearing. Bill Waldrip seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: None After further discussion, Ron Troy made a motion to grant the variance as requested. Garry Tischler seconded the motion. Bill Waldrip stated he would like to request an amendment to the motion. Ron Troy accepted the request for an amendment to the motion. Bill Waldrip made an amendment to the motion to grant the variance with the requested rear yard setback and with the plan as shown, with conforming brick and conforming roof line and materials. Ron Troy seconded the amended motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: None A vote was held on the motion as amended which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: None MISCELLANEOUS REPORTS AND/OR DISCUSSIONS Chairman Doug Lamb officially announced his resignation from the Board of Zoning Adjustment.
