ADJOURNMENT IN ACCORDANCE WITH ARTICLE 6252 -17, V.A.T.C.S., AS AMENDED BY CHAPTER 227, ACTS OF THE 61ST LEGISLATURE, REGULAR SESSION, THE REGULAR BOARD OF ZONING ADJUSTMENT MEETING AGENDA WAS PREPARED AND POSTED ON THIS THE 3RD DAY OF OCTOBER, 1986 AT 5:00 P.M. The Board of Zoning Adjustment for the City of Grapevine, Texas met in regular session October 9, 1986, at 413 Main Street, in the Council Chambers, Grapevine, Texas with the following members present to wit: Bill Waldrip Gerald Thompson Ron Troy Garry Tischler Don Bigbie John Ferguson Charles Giffin Chairman Vice-Chairman Secretary Member Member lst Alternate 2nd Alternate constituting a quorum. Council Representative Ted Ware and H. T. (Tcmmy) Hardy, the Director of Community Development was absent and the following City Staff was present to wit: Jim VanTreese Assistant Building Official Joy Carroll Administrative Assistant Adrienne Leonard Attorney, City Attorney's Office Gerrie Taylor Secretary Chairman Bill Waldrip called the meeting to order at 6:05 P.M. ME r--# shum flaWTAW-01IME, The first item of old business was for the Board of Zoning Adjustment to consider BZA cases 86-34, and 86 -35, Chasewoo Construction Company which has been tabled since the May 5th meting, to give Chasewood time to work out some agreement with the adjacent Parkwood Development to provide screening between the two developments according to Section 22.H. of the Grapevine Zoning Ordinance. Joy Carroll stated that she had talked with Mr. Michaels and he said that they intend to erect some landscape along the creek on the apartment side for Phase II. After some discussion, Garry Tischler made a motion to table these cases until the next regularly scheduled meeting. Ron Troy seconded the motion which prevailed by the following vote: Ayes: Waldrip, Troy, Thompson, Tischler, Bigbie Nays: None Absent: None mg-IgIT The first item of new business was for the Board of Zoning Adjustment to consider BZA 86-62, submitted by Charles D. Reynolds, who is asking for exceptions from Grapevine Zoning Ordinance for an existing building at 1280 South Main Street. The building was built under "C-1", Commercial requirements. Then after the April, 1984 City rezoning, this property was zoned "PO ", Professional Office, which made 1280 South Main Street a non-conforming use. Mr. Reynolds is asking for the following exceptions in order to bring the property to a conforming use:1). Exception to 27.G.3 (which requires a 25 foot landscaped front yard (parking presently exists in that area) ; 2). A ten foot (10') exception to the 25 foot rear yard requirement (27.G.4.); 3). Exception to buffer and screening which "Po" abuts residential (27.H), as the rear abuts "R-7.5" residential; 4). Exception to 27.J Landscape requirements; 5). Exception to 27.K which requirements for planter island landscaping every 12 parking spaces and at end of rows; 6). Exception to 27.M.4, which requires a 10 foot buffer strip where abutting residentially zoned property; 7). Exception to 27.F.5, which allows only 80% impervious area (more than 80% of the attached plan is in buildings and paving. Board of Zoning Adjustment October 9, 1986 Page Charles D. Reynolds of 7452 Malabar Lane, Dallas, Texas, and owner of the property took the oath • Truth and explained that the building has no value from the lender because it does not conform to the new "Po" zoning regulations, and therefore, he needs the variances granted to be able to conform. Mr. Reynolds explained that if 60% of the building is ever destroyed by wind damage, fire, etc., he needs the variances requested to be able to build it back the way it originally was built. With no one else to speak for or against the request, Ron Troy made a motion to close the Public Hearing. Don Bigbie seconded the motion which prevailed by the following vote: Ayes: Waldrip, Thompson, Troy, Bigbie, Tischler Nays: None Absent: None The next item of new business was for the Board of Zoning Adjustment to consider BZA 86-63 and BZA 86-64, submitted by Hooker Barnes Homes who is asking for a standard request for utilizing a residence as a model home/sales office temporarily, for 4015 Meadow Drive (Lot 15, Block 2, Yorkshire Meadows) , and 4013 Meadow Drive (Lot 14, Block 2, Yorkshire Meadows), an exception to Grapevine Zoning ordinance 82-73, Section 15, "R7.5", Single Family Off-Street Parking Requirements. With no one to speak either for or against the requests, Ron Troy made a motion to close the Public Hearing. Garry Tischler seconded the motion which prevailed by the following vote: Ayes: Waldrip, Thompson, Troy, Tischler, Bigbie Nays: None Absent: None With no further discussion, Don Bigbie made a motion to grant both variances as requested. Garry Tischler seconded the motion which prevailed by the following vote: Ayes: Waldrip, Nays: None Absent: None Thompson, Troy, Tischler, Bigbie The next item of new business was for the Board of Zoning Adjustment to consider BZA 86-65, submitted by Glen E. Turner, who is asking for an exception to Grapevine Zoning ordinance 82-73, Section 15.G.1., "R-7.5", Single Family. The mortgage company foreclosed on the property located at 2931 Roaring, Springs (Lot 34, Block 1, Trail Lake) and after the property was surveyed, an encroachment of eight (8') feet into the required thirty (301) foot front yard was discovered for a structure that was already framed. Glen Turner of 16475 Dallas Parkway, Dallas, Texas 75248, took the Oath of Truth and explained that the Inspector did approve the foundation inspection. With no one else to speak either for or against the request, Gerald Thompson made a motion to close the Public Hearing. Ron Troy seconded the motion which prevailed by the following vote: Ayes: Waldrip, Thompson, Troy, Tischler, Bigbie Nays: None Absent: None Board of Zoning Adjustment October 9, 1986 Page During further discussion, Jim VanTreese explained that the setbacks were not inspected and that the green tag was given for the steel being set up properly in order for the concrete to be poured. Jim also assured the Board that on November 3, 1986, setback inspections were going to be required. After further discussion, Ron Troy made a motion to grant the variance as requested. Garry Tischler seconded the motion which prevailed by the following vote: Ayes: Waldrip, Thompson, Troy, Tischler, Bigbie Nays: None Absent: None The next item of new business was for the Board of Zoning Adjustment to consider BZA 87-66, submitted by Whataburger, Inc., who is requesting the following exceptions to Grapevine Zoning ordinance 82-73, Section 26, 53, and 56 for the northeast corner of Northwest Highway and Central Avenue. 1) . A nine (91) foot exception to Section 26.G.3, which requires a twenty-five (25') foot front landscaped setback; 2). An exception to Section 53.H.1.c, which requires landscape islands to be 10' X 201; 3). An exception to Section 53.H.2.b, which requires a ten (10') foot perimeter landscape area for vehicular use areas; 4). An exception to Section 53.H.2.a, which requires fifteen (15') feet of perimeter landscape for vehicular use areas abutting a public right-of-way; 5). An exception to Section 56.C, which requires one parking space for every three seats plus five. Robert Drury of 2019 Stampede, Arlington, Texas, took the oath of Truth and asked that all variances be tabled. Due to a problem with the way the case was advertised, Ron Troy made a motion to continue the Public Hearing at the next regularly scheduled meeting on November 6, 1986 at 6:00 P.M. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Waldrip, Nays: None Absent: None Thompson, Troy, Tischler, Bigbie The next item of new business was for the Board of Zoning Adjustment to consider BZA 86-67, submitted by Tim Lancaster who is requesting an exception to Grapevine Zoning Ordinance 82-73, Section 58.B, which requires all off-street parking areas for 1201 Minters Chapel Road, (Lot 1, Block 2, D/FW Air Freight Center) to be paved. Mr. Lancaster is requesting a crushed rock parking area for a temporary basis until his project is fully developed. Staff recommends approval for only the present occupant, and to limit the variance for one year. Tim Lancaster, applicant, took the Oath of Truth and explained that his tenant, Mid Cities Truck and Trailer requested to park long trucks in the fenced-in area, but could not because the new Zoning Ordinance requires parking areas to be paved. Joy Carroll stated that she had received one letter of approval from Mr. Crouch. With no one else to speak for or against the request, Ron Troy made a motion to close the Public Hearing. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Waldrip, Thompson, Troy, Tischler, Bigbie Nays: None Absent: None After further discussion, Gerald Thompson made a motion to grant the variance for a temporary time of one year or as long as the stated use is Board of Zoning Adjustment October 9, 1986 Page continued, whichever is the shortest. Ron Troy seconded the motion which prevailed by the following vote: Ayes: Waldrip, Thompson, Troy, Tischler, Bigbie Nays: None Absent: None Chairman Bill Waldrip called for a five minute reces-2 The meting was reconvened at 7:55 P.M. by Chairman Waldrip. NM The next item of new business was for the Board of Zoning Adjustment to consider BZA 86-68, submitted by Tim Lancaster who is requesting exceptions to Grapevine Zoning Ordinance 82-73, Section 53.H.2.b, which requires a ten (10') foot landscaped area between abutting parking lots, and to 53.H.c, which requires planter islands at the end of rows of parking for property on Northwest Highway, where the former Le Villa Vecchia Restaurant was, legally described as Lot 5, Block 1, of the W.C. Lucas Addition. Since the lot is sixty (60') feet wide, it does not allow enough room to meet other requirements, therefore, Staff recommends approval. Tim Lancaster stated that the ten (10') foot side yard, a twenty-five (25) foot fire lane, and a thirty (30') foot wide building is greater than the width of the lot, therefore, makes a hardship in order to build. Jim VanTreese stated the variance is to eliminate four planter islands, which would be required at the north end of the property and north end of building and at the south end of the property and building which would take up four required parking spaces. Joy Carroll received three letters of approval from property owners within two-hundred (2001) feet of the property in question. She also read aloud letters of approval from Cecil Griggs, owner of Import Car Center, and H. A. Bowling. With no one else to speak either for or against the request, Garry Tischler made a motion to close the Public Hearing. Ron Troy seconded the motion which prevailed by the following vote: Ayes: Waldrip, Thompson, Troy, Tischler, Bigbie Nays: None Absent: None After further discussion, Don Bigbie made a motion to approve the variance as submitted. Garry Tischler seconded the motion which prevailed by the following vote: Ayes: Waldrip, Nays: None Absent: None Thompson, Troy, Tischler, Bigbie The next item of new business was for the Board of Zoning Adjustment to consider BZA 86-69, submitted by Tim Lancaster who is asking for an exemption from masonry requirement from Section 54 of the Grapevine Zoning Ordinance for an addition to an existing building located at 525 Industrial Blvd.,(Lot 3, Grapevine Industrial Park). Staff recommends approval. Tim Lancaster stated that the addition will be directly behind the existing building, away from the street and would like it to be metal to match the first building. Ross Ramsey, of 2732 Belmead, Carrollton, Texas and Controller of Gulf Bearing Company who owns property right to the north of the applicants, took the oath of Truth and stated that Gulf Bearing wanted to request denial of the variance and feels that concrete and masonry structures support a higher property value. E. L. Lancaster took the oath • Truth and spoke in favor of the variance. The next item of new business was for the Board of Zoning Adjustment to consider BZA 86-71, submitted by J. A. Eastham who is asking for an exception to Grapevine Zoning Ordinance 82-73, Section 21.8.4 to provide a meting/social room for Timberline Condominiums, located at 3500 Timberline Drive. The Zoning Ordinance requires an additional building be located in a common area. Jim Eastham of 5603 Kingstree, Arlington, Texas, took the oath of Truth and stated that he would like to enhance the property by providing an additional amenity for the tenants by designating one of the condos on the ground floor as a meeting/social room. With no one else to speak either for or against the request, Ron Troy made a motion to close the Public Hearing. Garry Tischler seconded the motion which prevailed by the following vote: Ayes: Waldrip, Troy, Thompson, Tischler, Bigbie Nays: None Absent: None There was further discussion and concern about the noise and tenants being next door. Mr. Eastham explained that there were no tenants living next to the condo that was to be used as the meeting/social room, and if those are to be rented in the future, the tenants would be made aware of the situation. With no further discussion, Garry Tischler made a motion to grant the variance as requested. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Waldrip, Nays: None Absent: None :• a IN, Thompson, Troy, Tischler, Bigbie The last item of new business was for the Board of Zoning Adjustment to consider BZA 86-72, submitted by General Homes who had a model home variance request approved on August 7, 1986 for 1826 Altacrest, which should have been a variance for a temporary parking lot which is not a permitted use for single family zoning. Tom Watson, of 2915 Hilltop Drive, Euless, Texas, took the Oath of Truth and explained that he had thought the proper application had been made when they applied for a temporary parking lot for their model home park. So they are reapplying for a parking lot to hold the normal traffic for their sales office and model home park. Mr. Watson assured the Board that the parking lot will be removed when the development is completed and converted back to single family residences. With no one else to speak either for or against the request, Garry Tischler made a motion to close the Public Hearing. Also discussed was to change the meeting date for the November meeting, because there will not be enough members present to make a quorum. Don Bigbie made a motion to change the meeting date from November 6, 1986 to November 13, 1986 if the applicant can be notified. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Waldrip, Thompson, Troy, Tischler, Giffin Nays: None Absent: None There was discussion about Wilbur Goltz's building having to comply with the masonry requirements. Also discussed was weather or not the house on Hyland Greens, who had been denied a variance earlier in the year, had complied with the motion. Jim VanTreese stated that the applicant had been cited.
