MRFMOR OF COWWNITY 'OF, P STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular session on Monday evening, January 7, 1991, at 6:00 P.M., in the Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas with the following members present to wit: Charles Giffin Raymond Truitt Patti Bass John Dorety Randy Howell Chairman Vice-Chairman Member Member 2nd Alternate constituting a quorum uorum with Secretary, Gerald Thompson and Ist Alternate, Andrew Quinn absent. Also present was City Council Representative, Gil Traverse and the following City Staff: Greg Wheeler Building Official Joy Carroll Administrative Aide Marcy Ratcliff Planner Ray Collins Planner Chris Caso Attorney, City Attorney's Office Gerrie Anderson Administrative Secretary 14r.111"M The meeting was called to order at 6:06 p.m. by Chairman, Charles Giffin. The first item of the Agenda for the Board of Zoning Adjustment to consider was alternate holiday meeting dates, which Patti Bass made a motion to move this item to the end of the meeting. Raymond Truitt seconded the motion which prevailed by the following vote: Ayes: Giffin, Truitt, Bass, Dorety, Howell Nays: None Absent: Thompson, Quinn OLD BUSINESS BZA90-31, DUNCAN, DICKSON AND TAYLOR The item of old business for the Board of Zoning Adjustment to consider was BZA 90-31, submitted by Duncan, Dickson and Taylor who is requesting variances for the Westwood Subdivision. This case was tabled from last months meeting due to the applicant needing more time to prepare the case. The request is in conjunction with Zoning Application Z90-10. The City Council and Planning and Zoning Commission Public Hearing was held November 20, 1990, to consider the request for R-5.0, Zero Lot Line Zoning, for 19.226 acres previously zoned and platted for R-TH, Townhouse District Regulations. As recommended by the Planning and Zoning Commission, the City Council approved R-5.0 zoning as requested on first reading of the ordinance. A second reading of the ordinance will be BOARD OF ZONING ADJUSTMENT JANUARY 7, 1991 PAGE 2 necessary following the Board of Zoning Adjustment Hearing for the requested variances. Greg Wheeler explained that Staff recommends approval to Grapevine Zoning Ordinance 82 -73, Section 16.G.1, R -5.0 Zero Lot Line 25 foot front yard requirements to allow 20 feet instead (a 5 foot variance) for the following lots: Block 1, Lots 1 through 14 Block 2, Lots 8 and 9 Block 3, Lot 10 Block 4, Lots 1 through 8, and 11 through 17 .Staff recommends denial to the variance requested to Grapevinm Zoning Ordinance 82-73, Section 16.G.2. which requires a 25 fo--" rear yard. PAGE 3 Ayes: Giffin, Truitt, Bass, Dorety, Howell Nays: None Absent: Thompson, Quinn Mr. Cameron explained the reason for the request to the 25 foot rear yard requirements to allow a 15 foot rear yard is to give more flexibility to build back to 15 feet. More side yard would then be possible on the 11 foot side allowing more open space on the other side, to allow a larger product. Raymond Truitt expressed that he had no problems with the variances for Block 4 because the lots backed up to the school property. After further discussion, Randy Howell made a motion that special conditions did exist. He further stated that the special conditions are that the subdivision is existing and the streets and utilities are already installed which creates a hardship. Patti, Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Truitt, Bass, Dorety, Howell Nays: None Absent: Thompson, Quinn Randy Howell then made a motion to approve the variances to Grapevine Zoning Ordinance 82 -73, Section 16.6.1, to allow 20 foot front yards, a five foot variance for Lots 1 through 14, Block 1; Lots 8 and 9, Block 2; Lot 10, Block 3, and Lots 1 through 8, and 11 through 17, Block 4; to deny the variances to Section 16.6.2, which requires a 25 foot rear yard for Lots 1 through 14, Block 1; Lots 8 and 9, Block 2; Lot 10, Block 3; and Lots 1 through 8, and 11 through 13, Block 4; and denial to the 20 foot rear yard requested for Lots 1 through 14, Block 5; to grant the variances to Section 16.G.5, 100 foot lot depth requirements for Lots 1 through 14, Block 1 (a 5 foot variance -95 feet); Lot 1, Block 2 (a 2 foot variance -98 feet) ; and Lots 8 and 9, Block 2 (a 19 foot variance -81 feet); and approval to Section 16.H which requires a 40 foot buffer yard between R -5.0, R -MF -2 and R -TH developments for Lots 1 through 14, Block 1; Lots 9 through 14 and 22, Block 4; and Lots 1 through 7, Block 7. Patti Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Truitt, Bass, Dorety, Howell Nays: None Absent: Thompson, Quinn NEW BUSINESS BZA90 -39, MARYMARK HOMES The first item of new business was for the Board of Zoning Adjustment to consider BZA90 -39, submitted by MaryMark Homes who is requesting variances to Grapevine Zoning Ordinance 82 -73, Section 15.G.3 for R -7.5, Single- Family, six foot (6') side yard BOARD OF ZONING ADJUSTMENT JANUARY 7, 1991 PAGE 4 requirements. A four foot -eight inch (418") variance is being requested for the existing garage for the area at a point 30 feet from the rear property line for 2132 Brookgate, Lot 30, Block 5, Winding Creek II. Mark Whiffin, representing MaryMark Homes, of 5151 Haydenbend Cr., Grapevine, took the Oath of Truth. Mr. Whiffin explained that when the forms were being set, the pins that were found at the back of the lot were used which must have been the pins for the adjoining lot. Mr. Whiffin noted that MaryMark owned the lot next door and when construction starts the house can be moved over on the lot. With no one else to speak either for or against the request, Patti Bass made a motion to close the public hearing. Raymond Truitt seconded the motion which prevailed by the following vote: Ayes: Giffin, Truitt, Bass, Dorety, Howell Nays: None Absent: Thompson, Quinn The next item of new business was for the Board of Zoning Adjustment to consider BZA90-40, submitted by Roy Stewart Homes, Inc. Mr. Stewart had asked that this case be tabled until the next regular scheduled meeting. Raymond Truitt made a motion to table BZA90-40 until the February 4, 1991, meeting. Patti Bass seconded the motion which prevailed by the following vote: BOARD OF ZONING ADJUSTMENT JANUARY 7, 1991 PAGE 5 Ayes: Giffin, Truitt, Bass, Dorety, Howell Nays: None Absent: Thompson, Quinn BZA90-41, ALLEN BIRMINGHAM (BLOCKBUSTER VIDEO) The last item of new business for the Board of Zoning Adjustment to consider was BZA90-41, submitted by Allen Birmingham for Blockbuster Video. City Planner, Ray Collins, explained that Mr. Birmingham was requesting variances from Grapevine Zoning Ordinance 82-73, Section 53.H.2.b., Landscape Regulations, which requires a 10 foot landscape buffer along the east property line, allowing a 10 foot variance; to Section 26.G.3, which requires a 25 foot front yard landscape buffer, to allow a variable landscape buffer, varying from 39 feet to 11 feet for an average 24.5 foot landscape buffer along Northwest Highway; and to Section 53.H.2.a. which requires a 15 foot landscape buffer along the west property line (facing SH 114 Frontage Road) , a five foot variance allowing a 10 foot buffer. The proposed property is addressed as 2101 W. Northwest Highway, legally described as Lot 1-R, Block 1, Oak Knolls Lakeview Addition. Allen Birmingham, applicant, of 11232 Russwood Circle, Dallas, took the Oath of Truth and explained that a lot of time has been spent on laying out different uses for this property. Raymond Truitt was concerned about the entrance at Northwest Highway being a very congested intersection. Mr. Birmingham noted that there are currently two entrances and one exit and that the State Highway Department requires only one (1) entrance on Northwest Highway. Marcy Ratcliff explained that Community Development Staff has talked with Public Works about the new plans for Highway 114 and the Northwest Highway intersection. Ms. Ratcliff explained that when that project is completed, most of the traffic problem at the Northwest Highway and Park Boulevard intersection will be eliminated. Mr. Birmingham noted that the east side of the property, which is owned by the Tom Thumb group will be landscaped and sprinkled as well as the whole site. Robert Hinson, of 1807 Redwood Trail, Grapevine, took the Oath of Truth. Mr. Hinson stated that he was the property owner to the south of this tract and feels the development will be a good addition to the area and supports the variances. With no one else to speak either for or against the request, Patti Bass made a motion to close the public hearing. Randy Howell seconded the motion which prevailed by the following vote: BOARD OF ZONING ADJUSTMENT JANUARY 7, 1991 PAGE 6 Ayes: Giffin, Truitt, Bass, Dorety, Howell Nays: None Absent: Thompson, Quinn After further discussion, John Dorety made a motion that special conditions did exist which are the irregular shape of the lot and vast frontage creates a hardship for the landowner, and he is meeting the spirit of the ordinance by providing the buffer as a whole. Patti Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Truitt, Bass, Dorety, Howell Nays: None Absent: Thompson, Quinn John Dorety then recommended approval to Grapevine Zoning Ordinance 82-73, Section 53.H.2.b. allowing a 10 foot variance to the landscape buffer along the east property line; to Section 26.G.3, allowing a variable landscape buffer, varying from 39 feet to 11 feet for an average 24.5 foot landscape buffer along Northwest Highway; and to Section 53.H.2.a., allowing a five foot variance to allow a 10 foot buffer along the west property line. Patti Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Truitt, Bass, Dorety, Howell Nays: None Absent: Thompson, Quinn Next the Board of Zoning Adjustment considered the alternate holiday meeting dates. Since Labor Day falls on a regular Board of Zoning Adjustment meeting date, the Board chose an alternate date of Thursday, September 5, 1991. Patti Bass made a motion to change the Labor Day meeting date to Thursday, September 5, 1991. Raymond Truitt seconded the motion which prevailed by the following vote: Ayes: Giffin, Truitt, Bass, Dorety, Howell Nays: None Absent: Thompson, Quinn MINUTES Board of Zoning Adjustment to consider the minutes of the October 4, 1990, meeting. Patti Bass made a motion to approve the minutes as written. Raymond Truitt seconded. the motion which prevailed by the following vote: BOARD OF ZONING ADJUSTMENT JANUARY 7, 1991 PAGE 7 Ayes: Giffin, Truitt, Bass, Dorety, Howell Nays: None Absent: Thompson, Quinn MISCELLANEOUS REPORTS AND/OR DISCUSSION Marcy Ratcliff discussed the status on Classic Chevrolet, and the Food Lion Grocery. Ms. Ratcliff also gave information about Exxon, who has applied for a Conditional Use at the southeast corner of Northwest Highway and Ball Street. ADJOURNMENT With no further information, Patti Bass made a motion to adjourn the meeting.
