' in the Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas with the following members present to wit: Charles Giffin Patti Bass John Dorety Andrew Quinn Randy Howell Chairman Member Member lst Alternate 2nd Alternate constituting a quorum with Vice Chairman Raymond Truitt and Secretary Gerald Thompson absent. Also present was City Council Representative, Gil Traverse and the following City Staff: H. T. (Tommy) Hardy Joy Carroll Greg Wheeler Ray Collins Reed Hiller Carol Baron Gerrie Anderson "Mam"Gaug Director of Community Development Administrative Aide Building Official Planner Attorney, City Attorney ®s Office Clerk Typist Administrative Secretary Chairman Charles Giffin called the meeting to order at 6:00 P.M. The first item of new business for the Board of Zoning Adjustment to consider was BZA91-01, submitted by Carwash Equipment Company who is requesting a variance from Grapevine Zoning Ordinance 82-73, Section 26.G.1 and 2, HC, Highway Commercial which requires a 50 foot minimum lot width for lots less than 100 feet deep and adjoining a street. The western portion of Lot 3-R, Block 1 of the M.L. Hurst Addition is 87.02 feet deep requiring a 12.98 foot variance. Joy Carroll explained that this application is in conjunction with Conditional Use Application CU91-03 and the Replat of Lots 1-R, 2-R and 3-R of the M. L. Hurst Addition. Car Wash Equipment Company is proposed for Lot I-R, and is addressed as 901 West Northwest Highway. Conditional Use Application CU91-03 was tabled by the City Council as recommended by the Planning and Zoning Commission February 19, 1991. The applicant was asked to amend the site and concept plans to indicate only one 45 foot drive for the Northwest Highway frontage of Lots 1-R and 2-R before the March meeting. Because of the variance needed for the replat of Lot 3R, the City Council must hear two readings of the Ordinance for CU91-03. If the variances are approved, the Commission and Council may approve the replat and the first reading of CU91-03 on March 19, 1991. BOARD OF ZONING ADJUSTMENT MARCH 4, 1991 PAGE 2 Sid Hollingsworth, applicant, of 4725 Nall Road, Dallas, Texas, 75244, took the Oath of Truth and explained that the Quick Car Lube will be located on Lot IR and that a concept plan is required by the City of Grapevine for Lot 2R showing the size of the building and the amount of landscaping for future development. Mr. Hollingsworth further explained that cars will exit the site from north to south and to compromise with the Planning and Zoning Commission, there will be one approach to serve both tracts of land. Some members were not certain of the reasons why the variance was being requested. Tommy Hardy explained that in order to provide adequate developable lot depth for Lot IR, the 100 foot depth requirement for Lot 3R (fronting Wall) will be 12.98 feet short for a portion of the lot. Mr. Hardy further explained the eastern portion of Lot 3R would meet the width, depth and square footage; but to include the western portion necessitates the depth variance. Staff recognizes a justification for a variance because the spirit of the ordinance is met by the larger than necessary Lot 3R. With no one else to speak either for or against the request, Andrew Quinn made a motion to close the public hearing. Patti Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Dorety, Quinn, Howell Nays: None Absent: Thompson, Truitt After further discussion, Patti Bass made a motion that a special condition did exist. Ms. Bass further stated that the special condition is that due to the dedication of the widening of Wall Street, the western portion of the lot cannot meet the minimum lot depth. Andrew Quinn seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Dorety, Quinn, Howell Nays: None Absent: Thompson, Truitt Patti Bass then made a motion to Ordinance 82-73, Section 26.G.1 District, 50 foot minimum lot w variance on the western portion variance. Andrew Quinn seconded following vote: grant approval to Grapevine Zoning and 2, Highway Commercial Zoning idth requirement and to grant the of the lot allowing a 12.98 foot the motion which prevailed by the Ayes: Giffin, Bass, Dorety, Quinn, Howell Nays: None Absent: Thompson, Truitt BOARD OF ZONING ADJUSTMENT MARCH 4, 1991 PAGE 3 BZA91-02, AUTO FUEL COMPANY The next item of new business was for the Board of Zoning Adjustment to consider BZA91-02, submitted by Auto Fuel Company who is requesting a variance from Grapevine Zoning ordinance 82-73, Section 60.B. 2 (c) (11) , HC, Highway Commercial Zoning District, requiring that all pole signs shall be 20 feet in height. The applicant is requesting the pole sign be 13 feet in height, a seven foot variance for a convenience store and gasoline service station located at 101 Ball Street, the southeast intersection of Ball Street and Northwest Highway. This variance is in conjunction with Conditional Use Application CU91-02, considered by the Planning and Zoning Commission and City Council February 19, 1991. Gary DeVleer of 13642 Omega, Dallas, Texas, took the Oath of Truth and explained that if a shorter sign could be built, then three large pecan trees would be saved. He also noted there would be adequate visibility beneath the foliage of the trees. Since there was no one else to speak either for or against the request Patti Bass made a motion to close the public hearing. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Dorety, Quinn, Howell Nays: None Absent: Thompson, Truitt Randy Howell asked Mr. DeVleer if there would be visual obstruction from Ball Street. Mr. DeVleer replied that the sign would be 50 to 60 feet back which there should not be any visual obstruction. Andrew Quinn made a motion that a special condition did exist. Mr. Quinn further stated that the special condition is that by lowering the sign would allow the trees to remain. John Dorety seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Dorety, Quinn, Howell Nays: None Absent: Thompson, Truitt Andrew Quinn then made a motion to grant the variance to Grapevine Zoning Ordinance 82-73, Section 60.B.2.(c)(11), HC, Highway Commercial Zoning District requirements, allowing for a 13 foot high pole sign, a seven foot variance for 101 Ball Street. John Dorety seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Dorety, Quinn, Howell Nays: None Absent: Thompson, Truitt BOARD OF ZONING ADJUSTMENT MARCH 4, 1991 PAGE 4 Ayes: Giffin, Bass, Dorety, Quinn, Howell Nays: None Absent: Thompson, Truitt After further discussion, Randy Howell made a motion that a special condition did exist. He further stated that the special condition is that the portable building would not be feasible to brick since it will be used temporarily. Andrew Quinn seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Dorety, Quinn, Howell Nays: None Absent: Thompson, Truitt Randy Howell then made a motion to grant the variance to Grapevine Zoning Ordinance 8273, Section 54, Masonry Requirements, allowing a 100% variance. Andrew Quinn seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Dorety, Quinn, Howell Nays: None BOARD OF ZONING ADJUSTMENT MARCH 4, 1991 PAGE 5 Absent: Thompson, Truitt MINUTES Next the Board of Zoning Adjustment considered the minutes of the December 3, 1990, meeting. John Dorety made a motion to accept the minutes as written. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Dorety, Quinn, Howell Nays: None Absent: Thompson, Truitt 104-1110 -.a P1 Amn-11 6*2 • Tommy Hardy informed the Board of the development around town. He noted that Tom Thumb's permit should be issued this week; there are two Food Lions proposed for locations at Pool Road and Hall Johnson Road and for Dove Road and Kimball; Elliott's Hardware will occupy the old Safeway building; Waffle House will be starting their building soon; and Classic Chevrolet's conditional use permit was approved last week by Council. ADJOURNMENT With no further discussion, Patti Bass made a motion to adjourn.
