MISCFTT,AT\TE)OTJS DISCUSSION AND REPORTS 0 5w IN ACCORDANCE WITH ARTICLE 6252-17, V.A.T.C.S., AS AMENDED BY CHAPTFP 227, ACTS OF THE 61ST LEGISLATURE, REGULAR SESSION, THE BOARD OF ZONING ADJUSTMENT REGAR MFFTING AGENDA WAS PREPARED AND POSTED ON THIS TFF 29TH DAY OF MARCH, 1991 AT 5 PM. STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the in regular session on Monday evening, in the Council Chambers, Room #205, 307 Texas with the following members present Charles Giffin Raymond Truitt Gerald Thompson Patti Bass Andrew Quinn City of Grapevine, April 1, 1991, at West Dallas Road, to wit: Chairman Vice Chairman Secretary Member lst Alternate Texas, met 6:00 P.M., Grapevine, constituting a quorum with Member John Dorety and 2nd Alternate Randy Howell absent. Also present was City Council Representative Gil Traverse and the following City Staff: Greg Wheeler Marcy Ratcliff Ray Collins Roger Beecham Gerrie Anderson CALL TO ORDER Building Official Planner Planner Attorney, City Administrative Attorney's Office Secretary Chairman, Charles Giffin called the meeting to order at 6:00 P.M. NEW BUSINESS BZA91-03, SUNBELT SAVINGS (DAVID SURDUKAN) The first item of new business for the Board of Zoning Adjustment to consider was BZA91-03, submitted by Sunbelt Savings who is requesting a variance to Grapevine Zoning Ordinance 82-73, Section 22.G.1, R-MF-2, Multi Family Zoning District 40 foot front- yard setback requirements for the Dove Creek Apartments, located at 500 Dove Road. The existing apartment complex encroaches as follows: Building #1 - 19.3 feet to allow a 20.7 foot setback; Building #2 - 12.8 feet to allow a 27.2 foot setback; and Building #3 - 14.1 feet to allow a 25.9 foot setback. David Surdukan, Surveyor, of 5404 Rutledge Court, The Colony, Texas, took the Oath of Truth and explained that by cleaning and bringing the tract into conformance would make it more appealing to a buyer. Mr. Surdukan explained that the reason the first building did not conform at the time of platting was because the surveyors did not stake a five foot dedication, therefore; the new right-of-way missed including the five feet. With no one else to speak either for or against the request, Patti Bass made a motion to close the public hearing. Gerald Thompson seconded the motion which prevailed by the following vote: BOARD OF ZONING ADJUSTMENT APRIL 1, 1,991 PAGE 2 Ayes: Giffin, Truitt, Thompson, Bass, Quinn Nays: None Absent: Dorety, Howell Andrew Quinn then made a motion that a special condition did exist and further stated that the condition was no fault of the owner. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Giffin, Truitt, Thompson, Bass, Quinn Nays: None Absent: Dorety, Howell Andrew Quinn made a motion to grant the variance to Grapevine Zoning Ordinance 82-73, Section 22.G.1, Multi Family Zoning District 40 foot front yard setback requirements, allowing a 20.7 foot setback for Building #1; a 27.2 foot setback for Building #2; and a 25.9 foot setback for Building #3. Patti Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Truitt, Thompson, Bass, Quinn Nays: None Absent: Dorety, Howell (7 BZA91-0�11 HARLEY BEAN Harley Bean, current owner of 3312 Redbird Lane, Grapevine, took the Oath of Truth. Mr. Bean explained to the Board that the lot is limited for building and that the north 30 foot of the lot is located in a pond. Mr. Bean also noted that he gave the City an 1800 foot sewer line easement on the side the variance is being requested. BOARD OF ZONING ADJUSTMENT APRIL 1, 1991 PAGE 3 With no one else to speak either for or against the request, Patti Bass made a motion to close the public hearing. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Giffin, Truitt, Thompson, Bass, Quinn Nays: None Absent: Dorety, Howell After further discussion, Andrew Quinn made a motion that a special condition did exist. Mr. Quinn further stated the special condition was if the land was platted with the current ordinance, only a six foot setback would be needed and that the original builder set the three setbacks to make sure whatever was built would meet all the requirements. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Giffin, Truitt, Thompson, Bass, Quinn Nays: None Absent: Dorety, Howell Andrew Quinn then made a motion to grant the 3.5 foot variance to Grapevine Zoning Ordinance 82-73, Section 15, for Lot 44, Block 4, Placid Peninsula Subdivision. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Giffin, Truitt, Thompson, Bass, Quinn Nays: None Absent: Dorety, Howell MINUTES Next, the Board of Zoning Adjustment considered the minutes of the January 7, 1991, meeting. Patti Bass made a motion to accept the minutes as written. Raymond Truitt seconded the motion which prevailed by the following vote: Ayes: Giffin, Truitt, Thompson, Bass, Quinn Nays: None Absent: Dorety, Howell Marcy Ratcliff introduced to the Board, Curtis Young who was recently appointed to the Planning and Zoning Commission. Greg Wheeler updated the Board that Classic Chevrolet had not brought their plans in yet but he was expecting them to bring them in soon. Patti Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Truitt, Thompson, Bass, Quinn Nays: None Absent: Dorety, Howell The meeting was adjourned at 6:17 P.M.
