ADJOUPWENT IN ACCORDANCE WITH ARTICLE 6252-17r V.A.T.C.S.r AS AMENDED BY C7T7\PMR T\ qTTE BOAPT) OF ZONTN(-, 227, 7\(--PS OF TTTR 61ST LEGISLATURE, RM--,JT-AR SESSION, TED TUTS TITS 7\rXjjjSTME,W PE(,IJTAR MEETING AGENDA WAS PREPARED AND POSTED JT, TI 28TH DAY OF RTNF, 1991 AT 5 PM. nZ STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular session on Monday evening, July 1, 1991, at 6:00 P.M., in the Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas with the following members present to wit: Charles Giffin Gerald Thompson Patti Bass Randy Howell Ron Williams Al Zimmerman constituting a quorum with Member was City Council Representative, City Staff: Greg Wheeler Joy Carroll Marcy Ratcliff Roger Beecham Gerrie Anderson leftin= Chairman Secretary Member Member lst Alternate 2nd. Alternate John Dorety absent. Also present Gil Traverse, and the following Building Official Administrative Aide Planner Attorney, City Attorney's Office Administrative Secretary Chairman, Charles Giffin, called the meeting to order at 6:00 P.M. OATH OF OFFICE Gerrie Anderson administered the Oath of Office to Randy Howell who was reappointed and to new members, Ron Williams and Al Zimmerman. BZA91-10, LOU HILLMAN The item of new business for the Board of Zoning Adjustment to consider was BZA,91-10, submitted by Lou Hillman. Mr. Hillman is requesting variances to Grapevine Zoning Ordinance 82-73, Section 15.G.1, 30 foot front yard requirements, to allow a 25 foot front yard setback, and to Section 15.G.3, six foot side yard requirements to allow a "0" foot setback for an existing carport. The property is located at 1044 Meadowbrook Drive, Lot 3, Block 3, Brookhollow Estates. Joy Carroll explained the reason for the request is for financing purposes and is no fault of the purchasers. Lou Hillman, of 203 E. Northwest Highway, Grapevine, and applicant, representing the owners, took the Oath of Truth. Mr. Hillman explained that the house was built in the 70's. The carport was added to the left of the house and a portion extends over the property line. BOARD OF ZONING ADJUSTMENT JULY 1, 1991 PAGE 2 Eugene Moore of 1034 Meadowbrook, Grapevine, whose property has the encroachment, took the Oath of Truth. Mr. Moore explained that he has no problem with the variance but is concerned that someday, new property owners might have a problem with the encroachment. With no one else to speak either for or against the request, Patti Bass made a motion to close the public hearing. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Giffin, Thompson, Bass, Howell, Williams Nays: None Absent: Dorety Ron Williams and Charles Giffin were concerned that if the Board grants the variance would there be problems for future owners as far as getting the encroachment removed. Roger Beecham explained to the Board that the encroachment over the property line would be a civil matter between the two property owners. The City cannot rectify the problem. Mr. Beecham did note that the Board can grant the variance all the way to the property line. After further discussion, Patti Bass made a motion that special conditions did exist. Ms. Bass further stated that the special conditions are; the structure is existing and the encroachment is no fault of the applicant. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Giffin, Thompson, Bass, Howell, Williams Nays: None Absent: Dorety Patti Bass then made a motion to grant the variances to Grapevine Zoning Ordinance 82-73, Sections 15.G.1, allowing a five foot variance into the 30 foot front yard setback; and to 15.G.3, to allow a six foot variance to the six foot side yard setback. Gerald Thompson seconded the motion which prevailed • the following vote: Ayes: Giffin, Thompson, Bass, Howell, Williams Nays, None Absent: Dorety Next the Board of Zoning Adjustment considered the minutes of the May 20, 1991, meeting. After reviewing the minutes, Gerald Thompson made a motion to approve the minutes as written. Patti Bass seconded the motion which prevailed by the following vote: BOARD OF ZONING ADJUSTMENT JULY 1, 1991 PAGE 3 Ayes: Giffin, Nays: None Absent: Dorety Thompson, Bass, Howell, Williams MISCELLANEOUS DISCUSSION AND/OR REPORTS Marcy Ratcliff announced that after the August meeting, Staff was planning to hold a workshop for the Board members. Roger Beecham will review the Bylaws, and discuss the procedure for motion. Joy Carroll discussed the three cases for the August meeting. Marcy Ratcliff also explained to the Board about what was taking place with the High Pointe case® ADJOURNMENT With no further discussion, Patti Bass made a motion to adjourn.
