HomeMy WebLinkAbout1991-09-03STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular session on Monday evening, September 3, 1991, at 6:00 p.m., in the Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas, with the following members present to wit: Charles Giffin Gerald Thompson John Dorety Randy Howell Ron Williams Chairman Secretary Member Member 1st Alternate constituting a quorum with Vice-Chairman, Patti Bass, and 2nd Alternate, Al Zimmerman, absent. Also present were the following City Staff: H. T. (Tommy) Hardy Greg Wheeler Joy Carroll Marcy Ratcliff Ray Collins Roger Beecham Gerrie Anderson CALL TO ORDER Community Development Director Building Official Administrative Aide Planner Planner Attorney, City Attorney's Office Administrative Secretary Chairman, Charles Giffin, called the meeting to order at 6:00 p.m. BZA91-16, PETER ZWILLENBERG The first item of new business for the Board of Zoning Adjustment to consider was BZA91-16, submitted by Mr. Peter Zwillenberg who is requesting a variance from Grapevine Zoning Ordinance 82-73, Section 15.G.1, a 30 foot front yard requirement to allow a 29 foot, six inch front yard, allowing a .5 foot or six inch variance. The request is for his property located at 553 Dove Creek Circle, Lot 12, Block 2, Dove Creek, Phase Two. Greg Wheeler explained that the house was built six inches over the building line where the garage is located. He noted that the variance is no fault of the property owner or applicant. Mr. Arno H. Zwillenberg, additional representative, was present to answer any questions. With no one else to speak either for or against the request, Gerald Thompson made a motion to close the public hearing. Randy Howell R seconded the motion which prevailed by the following vote: Ayes: Giffin, Thompson, Dorety, Howell, Williams Nays: None Absent: Bass, Zimmerman Gerald Thompson then made a motion that a special condition did exist and the special condition being that the house is existing and would be difficult to move. Ron Williams seconded the notion which prevailed by the following vote: Ayes: Giffin, Thompson, Dorety, Howell, Williams Nays: None Absent: Bass, Zimmerman Gerald Thompson made a motion to grant the variance to Grapevine Zoning Ordinance 82-73, Section 15.G.1, allowing a .5 foot variance to the house. John Dorety seconded the motion which prevailed by the following vote: Ayes: Giffin, Thompson, Dorety, Howell, Williams Nays: None Absent: Bass, Zimmerman BZA91-19, MR. HAL W. EDWARDS The next item of new business for the Board of Zoning Adjustment to consider was BZA91-19, submitted by Mr. Hal W. Edwards who is requesting a variance from Grapevine Comprehensive Zoning Ordinance 82-73, Section 15.G.1, a 30 foot front yard requirement, to allow a 27 foot front yard setback, a three foot variance; and to Section 42.D which requires a 15 foot side street building setback requirement to allow a 12.4 foot side yard, a 2.5 foot variance. Also to construct a garage where a storage building presently exists, a variance is needed to Section 15.B, which requires a garage door to be 20 feet from a side street to allow 17 feet instead; a three foot variance. The variances are for the existing house located at 1926 Lake Forest Road, Lot 7, Lake Forest Addition, Phase Two. Greg Wheeler explained that Mr. Edwards is wanting to replace an old storage building with a two-car garage. Mr. Wheeler explained that Staff recognizes a special condition topography and unusual shape of the lot and because: (1) the the encroachment requested is minimal (the house was built in encroaches three feet on the northeast corner and southeast corner); (2) to place the garage nearer require removal of several trees; (3) a concrete between the storage building and house and the entrance from the street to the area planned for the F, the 6 0 Is, it two feet on the the house would slab "dog run" existing drive garage already exists; (4) the surrounding area is uninhabited (mostly Corp property). Mr. Edwards was present to answer any questions. With no one to speak either for or against the request, John Dorety made a motion to close the public hearing. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Giffin, Thompson, Dorety, Howell, Williams Nays: None Absent: Bass Zimmerman Hal Edwards, applicant, took the Oath of Truth and explained to the Board that the garage planned would be built deep to accommodate his boat. He also explained that the storage building will be moved out and the garage built in that same location. Randy Howell made a motion that a special condition did exist and the special condition being that the structure and the encroachment is existing and the way the lot is topographically shaped, it is difficult to work with. John Dorety seconded the motion which prevailed by the following vote: Ayes: Giffin, Thompson, Dorety, Howell, Williams Nays: None Absent: Bass, Zimmerman Randy Howell then made a motion to grant the variances to Grapevine Zoning Ordinance 82-73, Section 15.G.1, to allow a 27 foot front yard setback, a 3 foot variance; to Section 42.D. to allow a 12.4 foot side yard setback, a 2.5 foot variance; and to Section 15.B allowing the garage door to be 17 feet from a side street instead of 20 feet, a three foot variance. Ron Williams seconded the motion which prevailed by the following vote: Ayes: Giffin, Thompson, Dorety, Howell, Williams Nays: None Absent: Bass, Zimmerman BZA91-20, KATHERINE GLAHN Next, the Board of Zoning Adjustment considered BZA91-20, submitted by Katherine Glahn, who is requesting a variance from Grapevine Comprehensive Zoning Ordinance 82-73, Section 68.H.3. The applicant is requesting a special exception to allow separate quarters (a kitchen addition) within the existing house and a portion of the garage of her residence located at 1321 Martin Court, Lot 12R, Block 2, Russwood Addition. Because of a medical problem Ms. Glahn's son has, she hopes to promote her son's ability to live as independently as possible within the confines of the family 3 residence. Brian Olson, 1331 Martin Court, Grapevine, took the oath of Truth and explained that he was representing some of the people on Martin Court and Mockingbird Drive that are against the request. Joy Carroll read the following letter that Mr. Olson provided from the neighbors requesting the variance be denied. A petition was also attached to the letter requesting the variance be denied. Box 95104 Grapevine, TX 76051 RE: Board of Zoning Adjustment Application Number BZA91-20, Ms. Katherine Glahn We the undersigned residents of Russwood Addition, City of Grapevine, Tarrant County, Texas, respectfully request that the special exception applied for by Ms. Katherine Glahn for 1321 Martin Ct., Lot 11R, Block 2, Russwood Addition, Grapevine, Texas, be denied. We believe that for the purposes of maintaining property value and quality of life in our subdivision, it is necessary to uphold the deed restrictions of Russwood Addition and the Grapevine Comprehensive Zoning Ordinance 82-73, Section 68.H.3. as they are written. Mr. Olson was concerned that after the alteration, the house would turn into a multi-family dwelling. Gerald Thompson asked if the alteration of the building would stay with the house. Roger Beecham, with the City Attorney's office, explained that if the Board grants the variance, it will stay with the house forever. Mr. Olson noted that there were others living in the house that were not part of the family. Greg Wheeler explained that in the future if the City was ever aware of a situation where Ms. Glahn was renting part of her house, then Staff could control the problem. Mr. Wheeler explained that a house becomes two units when there is an additional kitchen, sleeping quarter and sanitary area. Ms. Glahn was not present to represent her case. 4 With no others to speak either for or against the request, John Dorety made a motion to close the public hearing. Ron Williams seconded the motion which prevailed by the following vote: Ayes: Giffin, Thompson, Dorety, Howell, Williams Nays: None Absent: Bass, Zimmerman Ron Williams then made a motion that a special condition did not exist. John Dorety seconded the motion which prevailed by the following vote: Ayes: Giffin, Thompson, Dorety, Williams Nays: Howell Absent: Bass, Zimmerman The variance was denied. BZA91-21, MACK JAMESON - ENWAY PROPERTIES The last item of new business for the Board of Zoning Adjustment to consider was BZA91-21, submitted by Mack Jameson, Enway Properties, who is requesting special exception to Grapevine Zoning Ordinance 82-73, in accordance with Section 68.H.3 to allow continuation of the non-conforming status of 515 East Northwest Highway. Greg Wheeler explained that Conditional Use Application CU91-16 was going before City Council and the Planning and Zoning Commission on September 17, 1991, requesting outdoor storage of building supplies and materials in the CC, Community Commercial Zoning District. BZA91-21 must be approved before Council may approve CU91-16. Mr. Ed Tally, the applicant, was present to answer any questions. With no one to speak either for or against the request, John Dorety made a motion to close the public hearing. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Thompson, Dorety, Howell, Williams Nays: None Absent: Bass, Zimmerman Chairman Giffin asked about the B & B Auto variance case that was heard before this Board October 5, 1987. Marcy Ratcliff stated that the variances requested by B & B Auto were denied. Marcy Ratcliff explained that the only improvement would be a chainlink fence with red wood slats to screen the outdoor storage of building supplies and materials. 5 Ron Williams then made a motion that a special condition did exist, being that the tract was developed before the Community Commercial regulations were in place in the ordinance. John Dorety seconded the motion which prevailed by the following vote: Ayes: Giffin, Thompson, Dorety, Howell, Williams Nays: None Absent: Bass, Zimmerman Ron Williams made a motion to approve the special exception to Grapevine Zoning Ordinance 82-73, in accordance with Section 68.H.3, to allow continuation of the non-conforming status of 515 E.
