The Board of Zoning Adjustment for the City of Grapevine, Texas met in regular session April 6, 1987, at 307 West Dallas Road, in the Council Chambers, Grapevine, Texas with the following members present to wit: Bill Waldrip Chairman Gerald Thompson Vice-Chairman Don Bigbie Member John Ferguson lst Alternate Charles Giffin 2nd Alternate constituting a quorum, with Secretary, Ron Troy, absent. Also present was Council Representative Ted Ware, and the following City Staff present to wit: Joy Carroll Administrative Assistant Marcy Ratcliff Planner Adrienne Leonard Attorney, City Attorney's Office Gerrie Taylor Secretary Chairman Bill Waldrip called the meeting to order at 6:00 P.M. NEW BUSINESS BZA 87-25, 26, AND 27, CENTENNIAL HOMES The first item of new business was for the Board of Zoning Adjustment to consider BZA 87-25, 26, and 27, submitted by Centennial Homes who is asking for three separate variances. The first variance is for a parking lot for a model home located at 1705 Parkwood Drive, Lot 50, Block 7, Parkwood Subdivision, an exception to Grapevine Zoning Ordinance 82-73, Section 53, relative to landscaping and to Section 15.A, relative to a temporary use for a principle use. The second and third variances, BZA 87-26 and 27, are for the standard off-street parking request for temporary model homes located at 1701 and 1703 Parkwood Drive, Lots 51 and 52, Block 7, Parkwood Subdivision, exceptions to Grapevine Zoning Ordinance 82-73, Section 56.C. Jim J. Clark, Jr., Vice President of Marketing for Centennial Homes, took the Oath of Truth and stated that the reason for the variance for the temporary parking lot for 1705 Parkwood Drive is to keep cars off the street to not create a dangerous situation. With no one else to speak either for or against the request, Don Bigbie made a motion to close the Public Hearing. John seconded the motion which prevailed by the following vote: Ayes: Waldrip, Thompson, Bigbie, Ferguson, Giffin Nays: None Absent: Troy Gerald Thompson made a motion that there is a special condition that does exist for BZA 87-25. Don Bigbie seconded the motion which prevailed by the following vote: Ayes: Waldrip, Thompson, Bigbie, Ferguson, Giffin Nays: None Absent: Troy Gerald Thompson made a motion that the variance for BZA 87-25 be granted relative to Grapevine Zoning Ordinance 82-73, Section 53.H, landscaping requirements for parking lots and to Section 15.A, an exception to allow a parking lot to be a temporary principle use, because of the unnecessary hardships for marketing of the home, which has been permitted in the past and that model homes in subdivisions are being accepted. Charles Giffin seconded the motion which prevailed by the following vote: Ayes: Waldrip, Thompson, Bigbie, Ferguson, Giffin Nays: None Absent: Troy and of Zoning Adjustment April 6, 1987 Page 2 Gerald Thompson moved to grant the variances for BZA 87-26 and 27 relative to Grapevine Zoning Ordinance 82-73, Section 56.C, because model homes in subdivisions are being allowed. Charles Giffin seconded the motion which prevailed by the following vote: Ayes: Waldrip, Thompson, Bigbie, Ferguson, Giffin Nays: None Absent: Troy The next item of new business was for the Board of Zoning Adjustment to consider BZA 87-31, submitted by Braewood Homes, who is also asking for a variance from Grapevine Zoning Ordinance 82-73, Section 56.C, relative to off-street parking requiren)ents for a temporary model home located at 543 Dove Creek Place, Lot 2, Block 1, Dove Creek Subdivision. Joy Carroll stated that Staff recommends approval. Since there was no one to speak either for or against the request, John Ferguson made a motion to close the Public Hearing. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Waldrip, Thompson, Bigbie, Ferguson Nays: None Abstain: Giffin Absent: Troy Don Bigbie made a motion that the property in question does have special conditions. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Waldrip, Thompson, Bigbie, Ferguson Nays: None Abstain: Giffin Absent: Troy Then Don Bigbie made a motion that the conditions are the temporary nature of the permit and the use of model homes has been accepted in the past, which applies to Grapevine Zoning Ordinance 82-73, Section 56.C. John Ferguson seconded the motion which prevailed by the following vote: Ayes: Waldrip, Thompson, Bigbie, Ferguson Nays: None Abstain: Giffin Absent: Troy Board of Zoning Adjustment April 6, 1987 Page 3 Tom Powers of 404 Pebblebrook Drive, took the Oath of Truth, and stated that he understands the variance will reduce the landscaping and suggests the school to consider transferring the landscaping to the outside perimeter of the parking lot. With no one else to speak either for or against the request, Gerald Thompson made a motion to close the Public Hearing. Charles Giffin seconded the motion which prevailed by the following vote: Ayes: Waldrip, Thompson, Bigbie, Ferguson, Giffin Nays: None Absent: Troy After further discussion, Charles Giffin made a motion that there are special conditions that are based on the existing parking lot and the existing configuration of land based on the inability to expand the land and to keep the playground as large as possible. John Ferguson seconded the motion which prevailed by the following vote: Ayes: Waldrip, Thompson, Bigbie, Ferguson, Giffin Nays: None Absent: Troy Gerald Thompson made a motion to grant the variance because of the need for the increased size of the parking lot and the increased safety of putting the street for the bus entrance and exist and subject that to adding the landscaping adjacent to College Street and adjacent to the parking lot along Pebblebrook Drive. The variance will be subject to 82-73, Section 53.H.1.c and Section 53.H.2.a. John Ferguson seconded the motion which prevailed by the following vote: Ayes: Waldrip, Thompson, Bigbie, Ferguson, Giffin Nays: None Absent: Troy Chairman Waldrip stated the variance was approved with the attached conditions. The next item of new business was for the Board of Zoning Adjustment to consider BZA 87-24, submitted by Doyle and Arlene Dickerson, who are asking for variances from Grapevine Zoning Ordinance 82-73, Section 53.H.2.b, a 10' landscape buffer; Section 53.H.2.a, 15' landscape buffer from street frontage; and Section 53.H.1.c, landscape islands. Staff recommends approval. Arlene Dickerson of 932 Harbor, Grapevine, Texas, took the Oath of Truth and stated they were planning to tear down the old station and construct a breakfast-type restaurant which they need more parking area because of the small lot size. Mrs. Dickerson also stated that they are already 1000 feet over the required landscaping, but it needs to rearranged. Joy Carroll read letters of approval into the record from surrounding property owners. With no one else to speak for or against the request, Charles Giffin made a motion to close the Public Hearing. Charles Giffin seconded the motion which prevailed by the following vote: Ayes: Waldrip, Thompson, Bigbie, Ferguson, Giffin Nays: None Absent: Troy Board of Zoning Adjustment April 6, 1987 Page 4 Gerald Thompson made a motion to grant the variance for Item 1, relative to Section 53.H.2.b, because of the size of the lot and for parking required by the City and the fact that there is a screening fence between the two businesses already. John Ferguson seconded the motion which prevailed by the following vote: Ayes: Waldrip, Thompson, Bigbie, Ferguson, Giffin Nays: None Absent: Troy Gerald Thompson made a motion to grant the variance for Item 3, relative to Grapevine Zoning Ordinance 82-73, Section 53.H.2, because of the required 25' setback on the front property, plus the size of the building, the size of the parking spaces, and because the turnaround between the parking spaces leaves only nine feet on the existing lot and five feet for handicap parking spaces. John seconded the motion which prevailed by the following vote: I Ayes: Waldrip, Thompson, Bigbie, Ferguson, Giffin Nays: None Absent: Troy Gerald Thompson made a motion to grant the variance for Grapevine Zoning ordinance 82-73, Section 53.H.2.a for Item 4 because of the size of the lot and the required number of parking spaces that were forced to be put behind the restaurant and to the rear of the property which reduces the distance for the turn which only leaves 12'2" for the landscaping area on the rear side. Charles Giffin seconded the motion which prevailed by the following vote: Ayes: Waldrip, Thompson, Bigbie, Ferguson, Giffin Nays: None Absent: Troy Gerald Thompson also made a motion to grant the variance for Item 5, relative to Grapevine Zoning Ordinance 82-73, Section 53.H.l.c, due to the small size of the lot, the fact that the building is not being overbuilt, the fact the number of parking spaces required are being met and the overall landscaping exceeds what is required. Don Bigbie seconded the motion which prevailed by the following vote: Ayes: Waldrip, Thompson, Bigbie, Ferguson, Giffin Nays: None Absent: Troy The next item of new business was for the Board of Zoning Adjustment to consider BZA 87-28, submitted by Jerry and Lillie Parks, who is requesting a variance from Section 43.D.2, non-conforming uses and structures. Joy Carroll stated that this was a special condition-type variance, whereby the Parks need authorization to retain an accessory building due to their property being rezoned to Highway Commercial. Their home already exists, and the accessory structure would comply with "HC" setback requirements. Jerry Parks of 216 West Wall, Grapevine, Texas, took the Oath of Truth and stated that he had installed the accessory building on a slab and wanted to install electricity, which when he applied for a permit, he then discovered that the building was not in ccupliance with the zoning ordinance. Mr. Parks also stated that this was their retirement home and needs a workshop and storage building. With no one else to speak either for or against the request, John Ferguson made a motion to close the Public Hearing. Charles Giffin seconded the motion which prevailed by the following vote: Ayes: Waldrip, Thompson, Bigbie, Ferguson, Giffin Nays: None Absent: Troy Don Bigbie then made a motion that a special condition does exist. John Ferguson seconded the motion which prevailed by the following vote: Board of Zoning Adjustment April 6, 1987 Page 5 Ayes: Waldrip, Thompson, Bigbie, Ferguson, Giffin Nays: None Absent: Troy Don Bigbie made a motion to grant the variance to Grapevine Zoning Ordinance 82-73, Section 43.D.2, due to the City-wide rezoning in 1984, and that there is a non-conforming situation. John Ferguson seconded the motion which prevailed by the following vote: Ayes: Waldrip, Thompson, Bigbie, Ferguson, Giffin Nays: None Absent: Troy At this point, Chairman Waldrip called for a five minute break. The next item of new business was for the Board of Zoning Adjustment to consider BZA 87-29, submitted by the First Baptist Church of Grapevine, who is wanting to redevelop and expand the Church facilities and are asking for exceptions to Grapevine Zoning Ordinance 83-73, Section 15.6.1, relative to the front yard setback requirements. Joy Carroll stated that Staff recommends denial because Staff feels there is ample room at the west and south ends. Joe Lipscomb of 210 West College, Grapevine, Texas, representing the Church, took The Oath of Truth and stated that a 20.5' variance is being asked for instead of a 27' variance indicated in the memo. Mr. Lipscomb also stated that the variance is for an exception to Grapevine Zoning Ordinance 82-73, Section 15.G.1, the required 30' front yard setback for a proposed canopy at the north entrance. Mr. Lipscomb stated the advantages that the north entrance would serve and that the problem with the south entrance is that it is 80' from the parking lot, which would create a construction problem and the west entrance is served by a driveway that is presently required to be a firelane and also serves a large parking area. Mr. Lipscomb also stated that some of the property owners around the Church had no objections. With no one else to speak either for or against the request, Gerald Thompson made a motion to close the Public Hearing. John Ferguson seconded the motion which prevailed by the following vote: Ayes: Waldrip, Thompson, Bigbie, Ferguson, Giffin Nays: None Absent: Troy After further discussion, Charles Giffin made a motion that a special condition exists based on the use of the property as a church. Gerald Thompson seconded the motion which failed by the following vote: Ayes: Thompson, Giffin Nays: Waldrip, Bigbie, Ferguson Absent: Troy Don Bigbie made a motion that a special condition does not exist. John Ferguson seconded the motion which prevailed by the following vote: Ayes: Waldrip, Bigbie, Ferguson Nays: Thompson, Giffin Absent: Troy Don Bigbie then made a motion to deny the variance. John Ferguson seconded the motion which prevailed by the following vote: Ayes: Waldrip, Bigbie, Ferguson Nays: Thompson, Giffin Absent: Troy F*.TJ-AIff.*JJMTfJ§bTA The next item of new business was for the Board of Zoning Adjustment to consider BZA 87-30, submitted by Robert Tatangelo, who is requesting an exception to Grapevine Zoning ordinance 82-73, Section 15.G.1, 30' Board of Zoning Adjustment April 6, 1987 Page 6 front yard setbacks for single family district requirements for a 10 1 encroachment into the required 30' front yard at 2819 Oakwood, legally described as Lot 3R, Block 1, Grapevine Lake Estates. Joy Carroll stated that Staff recommends approval. Robert Tatangelo, of 2819 Cripple Creek, Grapevine, Texas, took the Oath of Truth and stated that the request is for a 10' variance because the lot has a severe drop-off in the rear, and that the house to the south also has a 20' setback due to the slope of the property. With no one else to speak either for or against the request, John Ferguson made a motion to close the Public Hearing. Charles Giffin seconded the motion which prevailed by the following vote: Ayes: Waldrip, Thompson, Bigbie, Ferguson, Giffin Nays: None Absent: Troy Gerald Thompson then made a motion to grant the variance to Grapevine Zoning Ordinance 82-73, Section 15.G.1 because of the severe slope of the lot falling off toward the lake, the property line going toward the center of the street, and that the area was annexed to the City after numerous house were built with many of them having less than 20' front yards. Thomson who is requesting an exception to Grapevine Zoning Ordinance 82-73, Section 58.C, Off-Street Development and Loading Standards which prohibits more than one drive per 150' of street frontage for 214 West Northwest Highway, legally described as Lots 1-A, 2-A, Blocks 7, 9, & 10 of the Starr Subdivision. Joy Carroll stated that Staff recommends denial for the second drive to be approved. Pat Wadlington, 4801 Chapel Springs Ct., Arlington, Texas, took the Oath of Truth, and stated that they are intending to construct a full service car wash and requests an entrance and an exist.
