THE :•`•r OF ZONING ADJUSTMENT REGULAR MEETING AGENDA WAS PREPARED AND POSTED ON THIS THE UffiNTY-THIRD DAY OF DECENBER, 1987, AT 5 PM. qj Director of Comum DeveloFment I i. al WARN The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular session on Monday evening, at 6:00 P.M., January 4, 1988, in the Council Chambers, #205, 307 West Dallas Road, Grapevine, Texas, with the following members present to wit: Don Bigbie Robert Hinson Charles Giffin Gerald Thompson Becky Swann Raymond Truitt Chairman Vice-chairman Secretary Member 1st Alternate 2nd Alternate constituting a quorum, with Member Tim Hobbs absent. Also present was City Council Representative, Gil Traverse, and Adrienne Leonard, Attorney, with the City Attorney's Office. The following City Staff was also present to wit: H. T. (Tcmiy) Hardy Director of Community Development Joy Carroll Administrative Assistant Gerrie Taylor Administrative Secretary Chairman Don Bigbie called the meting to order at 6:00 P.M. OATH OF OFFICE Gerrie Taylor, Secretary to the Board, administered the Oath of Office to new member, Raymond Truitt. OATH OF TRUTH Chairman Don Bigbie administered the Oath of Truth to the audience for those who wished to speak. ................ The item of new business for the Board of Zoning Adjustment to consider was BZA 88-01, submitted by Neil Hart, of Hart Pool and Spa, Inc. Mr. Hart is requesting a variance from Grapevine Zoning Ordinance 82-73, Section 15.G.2, Single Family, twenty-five (251) foot rear yard setback requirements for an encroachment of twelve and one-half (12 1/2') feet for 610 Ellington Court, legally described as Lot 16, Block 10, Glade Crossing I-B. Joy Carroll stated that Staff's recommendation for the request was denial. Neil Hart of 6703 Colleyville Blvd., Colleyville, Texas, stated that he normally does not construct anything other than pools, but Mr. Lucas, the owner, wanted him to construct a covered patio. Mr. Hart stated that construction was stopped from the City Inspector for not having a permit. When the owner did apply for the permit, it was discovered there was a problem with the covered patio being in the easement. Larry Lucas, owner of 610 Ellington Court, Grapevine, Texas, spoke and stated that he had the approval from his neighbors for the construction. After further discussion, Charles Giffin made a motion to close the Public Hearing. Robert Hinson seconded the motion which prevailed by the following vote: Ayes: Bigbie, Hinson, Giffin, Thompson, Swann, Nays: None. Absent: Hobbs Robert Hinson made a motion that a special condition does not exist. The motion died for lack of a second. Board of Zoning Adjustment January 4, 1988 Page 2 There was discussion among the members on having a problem finding a hardship with the case. After further discussion, Robert Hinson made a motion that a special condition does not exist. Becky Swann seconded the motion which prevailed by the following vote: Ayes: Bigbie, Hinson, Swam Nays: Giffin, Thompson Absent: Hobbs Robert Hinson made a motion to deny the variance to Grapevine Zoning Ordinance 82-73, Section 15.G.2, R-7.5, Single Family District Regulations for the twelve and one-half (12 1/2) foot rear yard setback for Case #88-01. Becky Swann seconded the motion which prevailed by the following vote: Ayes: Bigbie., Hinson, Swarm Nays: Giffin, Thompson Absent: Hobbs Tommy Hardy explained to the applicant that it would be a year before he could come before the Board again concerning this case; however, in the event a zoning ordinance amendment is approved allowing covered patios or porches to extend into the required rear yard, Staff would contact Mr. Hart or Mr. Lucas so that they could pursue the building permit application. In that event, a variance would not be necessary. '1111511,11111111 Tommy Hardy stated that on Tuesday, January 12, 1988, there will be a Planning and Zoning workshop which patio covers will be an item of discussion. The Board was advised by Staff that they were invited. Don Bigbie suggested that the Board of Zoning Adjustment and Planning and Zoning Commission meet with the City Attorney to discuss the legal procedures, duties, and limitations of each. The Board of Zoning Adjustment-to consider minutes of the December 7,1987 Minutes. Gerald Thompson made a motion to approve the minutes of the December 7, 1987 meeting. Robert Hinson seconded the motion which prevailed by the, following vote: Ayes: Bigbie, Hinson, Giffin, Thompson, Swann Nays: None Absent: Hobbs I VATI Mrall-PUY1 IT, IN 1VW W With no further discussion, Gerald Thompson made a motion to adjourn the meeting. Robert Hinson seconded the motion which prevailed by the following vote: Ayes: Bigbie, Hinson, Giffin, Thompson, Swann Nays: None Absent: Hobbs The meeting was adjourned at 7:00 P.M.
