HomeMy WebLinkAbout1988-12-05The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular session, December 5, 1988, at 6:00 P.M., in the Council Chambers, #205, 307 West Dallas Road, Grapevine, Texas, with the following members present to wit: Gerald Thompson Becky Swann Charles Giffin Don Frieden Chairman Secretary Member 2nd Alternate constituting a quorum, with Vice Chairman, Tim Hobbs, and Members Don Bigbie, and Raymond Truitt absent. Also present were the following City Staff present to wit: Joy Carroll Administrative Assistant Adrienne Leonard Attorney, City Attorney's Office Gerrie Taylor Administrative Secretary � • y0 0 v Chairman, Gerald Thompson, called the meting to order at approximately 6:10 P.M. Chairman, Gerald Thompson, administered the Oath of Truth to the members of the audience who wished to speak during the meeting. OLD BUSINESS The item of Old Business for the Board of Zoning Adjustment to consider, was BZA 88-24, submitted by Carswell Federal Credit Union for their property located at 925 South Main Street. This case was tabled at the October 3, 1988 meeting in order to gain clarification on the dedication required by the Thoroughfare Plan. The City Council, on October 18, 1988, approved the amendment to the Thoroughfare Plan reducing Nash Street from a Type E Collector, 75 foot required minimum right-of-way to a Type F Collector, 60 foot minimum right-of-way. The 10 foot easement the Public Works Department needed for utilities and sidewalks, will not effect their property, because it falls within the existing street. Rick Rogers, Branch Manager of Carswell Federal Credit Union, explained about installing a new drive-through facility on the north side of the building which would be more convenient for customers and would alleviate the traffic problem which presently backs up onto Terrell Street. Joy Carroll stated that Staff did recommend approval, the special condition being, the tract is non-conforming, the drive-through will not require additional impervious area, and the number of parking spaces will be accommodated at the building on Terrell Street. Chairman, Gerald Thompson, administered the Oath of Truth to Rick Rogers since he arrived after the Oath of Truth had beer, administered to the audience. Charles Giffin made a motion to close the Public Hearing. Becky Swann seconded the motion which prevailed by the following vote: Ayes: Thompson, Swann, Giffin, Frieden Nays: None Absent: Hobbs, Truitt, Bigbie Charles Giffin made a motion that a special condition exists. Don Frieden seconded the motion which prevailed by the following vote: Ayes: Thompson, Swann, Giffin, Frieden Nays: None Absent: Hobbs, Truitt, Bigbie Charles Giffin stated the special conditions were based on the fact that the current building is existing and non-conforming, the installation of BOARD OF ZONTNG ADJIJSTYBM DECEMBER 5, 1988 PAGE 2 the drive through will not require additional impervious surface, the difference of the number of parking spaces will be accoimiodated at the building on Terrell Street, and made- a motion to grant the variances as recorded in the memo. Adrienne Leonard, Attorney, with the City Attorney's office, noted the motion needed to be contingent upon the deed restrictions, she had received, which showed to be consistent with the requirements of the variance request. Ayes: Thompson, Swann, Giffin, Frieden Nays: None Absent: Hobbs, Bigbie, Truitt Uirst Alternate, Raymond Truitt, arrived at this point of the meting. Im-woul.RM Joy Carroll explained that the Palffers, in financing their home which is located at 3619 Oakwood Drive, are asking for these variances at the request of Arlington Savings Bank. Norris Palmer, applicant, of 3619 Oakwood Drive, Grapevine., took the Oath of Truth and explained the house they bought through HUD, was built in 1955 and encroaches very little over the building line. Ayes: Thompson, Swann, Giffin, Truitt, Frieden Nays: None Absent: Hobbs, Bigbie %ecky Swann then made a motion that the special condition was the house is e-xisting and was built before the Zoning Ordinance was in effect. Charles Giffin seconded the motion which prevailed by the following vote: Ayes: Thompson, Swann, Giffin, Truitt, Frieden Nays: None Absent: Hobbs, Bigbie I-T*APD OF ZONING ADJUSTY= DECEMBER 5, 1988 PACE 3 Becky Swann made a motion to grant the variance to Grapevine Zoning Ordinance 82-73, Section 15.G.1, allowing a 15 foot front yard variance, and to Section 42.D, allowing a 5 foot variance for the side yard setback for reverse frontage lots. Charles Giffin seconded the motion which prevailed by the following vote: Ayes: Thompson, Swann, Giffin, Truitt, Frieden Nays: None Absent: Hobbs, Bigbie The next item of new business was for the Board of Zoning Adjustment to consider BZA 88-27, submitted by Michael's Store, Inc., requesting a variance to Grapevine Zoning Ordinance 82-73, Sign Standards, for the purpose of adding to an existing sign which was approved prior to present sign requirements which does not conform to present sign regulations for the Moskatel's Store located at 1601 Northwest Highway. The following variances being requested are to Grapevine Zoning Ordinance 82-73, Section 60.B.2.c.4: , - allowing a 12 foot maximum cabinet width; the request is for a 16 foot width, a variance of 4 feet; - allowing a maximum 12 foot cabinet height; the request if for a 16.74 foot cabinet height, a variance of 4 and 74/100 foot variance; - allowing a 14 inch cabinet depth; the request is for a 20 inch depth, a variance of 6 inches; - allowing a maximum.108 square feet; the request is for 183 and 16/100 square feet, a variance of 75 and 16/100 square feet; and a variance to- Section 60.B.2.c.11, Sign Standards, requiring the overall sign height to be 20 feet; the existing 30 foot sign will need a 10 foot variance. Adrienne Leonard noted the third variance regarding the cabinet depth was advertised with the request for a 20 inch depth, a variance of 6 inches, and explained that the motion could not be changed to allow a 24 inch cabinet depth, a variance of 10 inches. Charles Giffin then amended his motion to change the 24 inch cabinet depth to allow for a 20 inch cabinet depth, and to change the 10 inch variance to allow for a 6 inch variance. Mr. Giffin also added to his motion that the sign cabinet should match the other three existing sign cabinets on the pole. Joy Carroll did state that if the cabinet was to be built with a 24 inch depth instead of the 20 inch cabinet depth that had been advertised, then Moskatel's would have to reapply before the Board for that variance. A representative from Michael's Stores, Inc., noted that Moskatels would build the sign in conformance with the panels on the existing sign, and MIrs. Carroll confirmed that 20 inch was the correct measurement. Don Frieden seconded the motion which prevailed by the following vote: Ayes: Thompson, Swann, Giffin, Truitt, Frieden Nays: None Absent: Hobbs, Bigbie The last item of new business was for the Board of Zoning Adjustment to consider BZA 88-28, submitted by Mr. Jams R. Scott, who is requesting a variance to Grapevine Zoning Ordinance 82-73, Section 15.G.2, "R-7.5", Single Family Zoning District Regulations, which requires a 25 foot rear yard setback, for his property located at 2713 Creekwood Drive. Joy Carroll explained that Mr. Scott was wanting to construct a carport at the rear of his driveway, which would leave a 6 foot rear yard setback, a 19 foot variance. Mrs. Carroll stated that Staff recommended denial for this request because of the reasonable lot and house size.
