THE BOARD OF ZONING ADJUSTMENT REGULAR MEETING AGENDA WAS PREPARED AND POSTED ON THIS THE 31ST DAY OF MARCH, 1989, AT 5 PM. # ' # i • i #' iI !' il' STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular session April 3, 1989, at 6:00 P.M., at 307 West Dallas Road, Room #205, Grapevine, Texas, with the following members present to wit: Gerald Thompson Becky Swann Don Bigbie Charles Giffin Raymond Truitt Don Frieden Chairman Secretary Member Member 1st Alternate 2nd Alternate constituting a quorum with Vice-Chairman, Tim Hobbs, absent, Also present was City Council Representative, Gil Traverse and the following City Staff: H. (Tommy) Hardy Director of Community Development Joy Carroll Administrative Aide Greg Wheeler Assistant Building Official Adrienne Leonard Attorney, City Attorney's Office Gerrie Taylor Administrative Secretary CALL TO ORDER Chairman, Gerald Thompson, called the meeting to order at approximately 6:00 P.M. NEW BUSINESS BZA 89-05, MR. BRUCE KAPOSTA The first item of new business was for the Board of Zoning Adjustment to consider BZA 89-05, submitted by Mr. Bruce Kaposta, who is requesting variances in conjunction with Conditional Use Application #89-03 for a full service auto body and paint repair and conversion center located at 607 West Dallas Road, legally described as Lot AR, Block 1, of the Bellaire Addition. The first reading of Conditional Use #89-03 was approved at the March 21, 1989, City Council and Planning and Zoning Commission joint public hearing. The second reading will be heard April 4, 1989, contingent on the Board of Zoning Adjustments decisions. Staff recommends approval to the following variances being requested which are to Grapevine Zoning Ordinance 82-73, Section 25.G.3, which requires a 25 foot landscaped setback, a 10 foot variance is needed; Section 25.G.5, which requires a distance to equal 1 1/2 times the height of the tallest building on the tract to be added to the required 25 foot rear yard if property is adjacent to a residential area, a 41.5 foot variance is needed; Section 25.K, which requires 10 feet between any residential district and 5 feet between any property line, a 5 foot variance is needed; Section 53 and 25.M.4 which requires a buffer and screening requirement of 24.5 feet, a 16.5 foot variance is needed; Section 53.H.1.c, which requires planter islands at the ends of rows of parking and every 12 spaces which should be landscaped and contain one tree, a variance of 9 planter islands and trees is needed. Staff recommends denial to Section 25.B.4, which requires the dumpster be set 50 feet from the residential district, a 28 foot variance is needed. Staff feels with ample property on the west side of the building, the dumpster could be relocated. Denial is also recommended for the variance to Section 26.0.5 which requires 1 parking space per 125 square feet of gross floor area of the principal use. The proposed use requires 143 parking spaces, the site plan indicates 63 parking spaces being provided, a variance of 83 spaces. Staff feels additional space to the east could be available. Bruce Kaposta, the applicant, took the Oath of Truth and noted the dumpster could be moved to the northwest and will then be located the required 50 feet from the property line. Mr. Kaposta stated he added an additional row of parking to the single row of parking shown on the site plan. He also noted when the business will be at it's full capacity, about 25 to 30 parking spaces would be taken. Charles Giffin seconded the motion which prevailed by the following vote: Ayes: Thompson, Swann, Bigbie, Giffin, Truitt Nays: None Absent: Hobbs Don Bigbie was concerned about there being too many parking spaces and cars being parked overnight. Tommy Hardy explained the conditional use permit will limit Mr. Kaposta's hours of operation, and any car not operable cannot be left outside the building overnight. Mr. Kaposta explained he would be able to get about 60 cars inside the building. Charles Giffin made a motion that a special condition did exist. Raymond Truitt seconded the motion which prevailed by the following vote: Ayes: Thompson, Swann, Bigbie, Giffin, Truitt Nays: None Absent: Hobbs Charles Giffin made a motion that the special condition is based on the fact that the building exists and was built prior to the current zoning ordinance, and it inhibits the ability to comply with current regulations. Don Bigbie seconded the motion which prevailed by the following vote: Ayes: Thompson, Swann, Bigbie, Giffin, Truitt Nays: None Absent: Hobbs Charles Giffin then made a motion that based on that special condition, to grant the variances to Grapevine Zoning Ordinance 82-73, Section 25.G.3, allowing a 10 foot variance to the landscaped setback; Section 25.G.5, allowing a 41.5 foot variance to the height restrictions; Section 25.K, allowing a 5 foot variance to the off-street parking requirements; Section 53 and 25.M.4, allowing a 16.5 foot variance to the buffer and screening requirements; Section 53.H.1.c, allowing a variance of 9 planter islands and trees, to the interior landscaping regulations, and to Section 56.0.5, allowing a variance of 83 parking spaces. Becky Swann seconded the motion which prevailed by the following vote: Ayes: Thompson, Swann, Bigbie, Giffin, Truitt Nays: None Absent: Hobbs Charles Giffin then made a motion to deny the variance to Section 25.B.4 allowing the dumpster to be closer than 50 feet to residential districts. Raymond Truitt seconded the motion which prevailed by the following vote: Ayes: Thompson, Swann, Bigbie, Giffin, Truitt Nays: None Absent: Hobbs The next item of new business was for the Board of Zoning Adjustment to consider BZA 89-06, submitted by Mr. Richard Yohn, who is requesting variances to Grapevine Zoning ordinance 82-73, Section 15.G.1, which requires a 30 foot front yard setback in the "R-7.5", Single Family Zoning District, a 5 foot variance is needed; and to Section 15.G.2, which requires a 25 foot rear yard, a 3 foot variance is needed. Mr. Yohn's property located at 1826 Chriscraft, legally described as Lot 23 Shorecrest Addition has only an 85 foot lot depth making it difficult for a minimum sized home to be built without encroachments. The minimum lot depth in the "R-7.5" zoning district is 100 feet. Mr. Steve Rhone, with Belmont Homes, representing Mr. Yohn, took the Oath of Truth and stated he would answer any questions the Board may have. Charles Giffin seconded the motion which prevailed by the following vote: Ayes: Thompson, Swann, Bigbie, Giffin, Truitt Nays: None Absent: Hobbs Becky Swann made a motion the special condition is that the property was platted prior to current zoning regulations and the request is typical of the neighborhood and to grant the variances to Grapevine Zoning Ordinance 82-73, Section 15.G.1, allowing a 5 foot variance, and to Section 15.G.2, allowing a 3 foot variance for the property located at 1826 Chriscraft. Charles Giffin seconded the motion which prevailed by the following vote: Ayes: Thompson, Swann, Bigbie, Giffin, Truitt Nays: None Absent: Hobbs BZA 89-07, MR. ROBERT MYERS The last item of new business for the Board of Zoning Adjustment to consider was BZA 89-07, submitted by Mr. Robert Myers, who is requesting a variance to Section 15.G.6, "R-7.511, Single Family Zoning District Regulations, which requires a 12 foot separation between buildings on separately platted lots. A 4 foot, 11 inch variance to Section 15.G.6 will be needed for the house planned for 2413 Blair Court, legally described as Lot 20, Block 3, of Blair Manor Estates, allowing a 7 foot separation. Joy Carroll explained that the existing house on Lot 19 was built 13 inches from the side property line instead of the required 6 feet. The particular encroachment on Lot 19 resulted from the unusual lot line, thus the subsequent variance is needed before building on Lot 20 and is no fault of the applicant. Robert Myers of 1105 Carrington Ct, Irving, Texas, who is the property owner's builder, took the Oath of Truth, and explained his client had house plans drawn up specifically for the shape of lot 20. Mr. Myers noted that when trying to lay out the house, he discovered the house next door was built too close to the property line. After further discussion Charles Giffin made a motion to close the Public Hearing. Don Bigbie seconded the motion which prevailed by the following vote: Ayes: Thompson, Swann, Bigbie, Giffin, Truitt Nays: None Absent: Hobbs Becky Swann made a motion that a special condition exists. Charles Giffin seconded the motion which prevailed by the following vote: Ayes: Thompson, Swann, Bigbie, Giffin, Truitt Nays: None Absent: Hobbs Becky Swann then made a motion to the fact that the problem is no fault of the owner and the problem exists on Lot 20 because of the encroachment on Lot 19. Don Bigbie seconded the motion which prevailed by the following vote: Ayes: Thompson, Swann, Bigbie, Giffin, Truitt Nays: None Absent: Hobbs BOARD OF ZONING ADJUSTMENT APRIL 3, 1989 PAGE 4 A motion was made by Becky Swann to grant the variance to Grapevine Zoning Ordinance 82-73, Section 15.G.6, allowing for a 7 foot separation, a 4 foot, 11 inch variance for Lot 20 Blair Manor Estates. Charles Giffin seconded the motion which prevailed by the following vote: Ayes: Swann, Bigbie, Giffin, Truitt Nays: None Absent: Hobbs Abstain: Thompson MISCELLANEOUS REPORTS AND/OR DISCUSSION The Board had questioned at a previous meeting about a few businesses needing to be notified of their flashing signs. Tommy Hardy noted to the Board the flashing sign at the Grapevine Mini Mart had been there a long time which the City cannot have them remove it. Becky Swann also stated she wanted the signs checked at Bartley's Bar-B-Q, and the tailor shop on Worth Street. Gerald Thompson asked if the City inspectors still made string line inspections and how did the house at 2413 Blair Ct. get by with a 4 foot, 11 inch encroachment? Lanny Tate, Developer of Blair Manor Estates, stated the house was 3 years old and thought string lines had been pulled. Tommy Hardy explained he did not know if string line inspection were made at that time but they do inspect them now.
