THE BOARD OF ZONING ADJUSTMENT REGULAR MEETING AGENDA WAS PREPARED AND POSTED ON THIS THE 2ND DAY OF JUNE, 1989, AT 5 PM. DIRECTOR OF COMM I Y DEVELOPMENT STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular session Monday, June 5, 1989, at 6:00 P.M., at 307 West Dallas Road, Room #205, Grapevine, Texas, with the following members present to wit: Gerald Thompson Chairman Tim Hobbs Vice-Chairman Charles Giffin Member Raymond Truitt 1st Alternate constituting a quorum with Secretary, Becky Swann, Member, Don Bigbie, and 2nd Alternate, Don Frieden absent. Also present were the following City Staff to wit: H. T. (Tcmmy) Hardy, Director of Community Development Joy Carroll Administrative Aide Greg Wheeler Assistant Building Official Adrienne Leonard Attorney, City Attorney's Office Gerrie Taylor Administrative Secretary CALL TO ORDER Chairman, Gerald Thompson called the meeting to order at 6:05 P.M. [02�A Chairman, Gerald Thompson administered the Oath of Truth to those persons of the audience who wished to speak. NEW BUSINESS BZA 89-17, THISTLE HOMES ( SCOTT KRETZER) The first item of new business was for the Board of Zoning Adjustment to consider BZA 89-17, submitted by Thistle Homes who is requesting a variance from Grapevine Zoning Ordinance 82-73, Section 15.G.1, "R-7.5", Single Family Zoning District Regulations which requires a 30 foot front yard setback for an existing house located at 3504 High Countryside Drive, legally described as Lot 5, Block 5,.High Country, Phase II. Joy Carroll explained the special condition was due to the topography and curve of the lot. The curve of the lot, and the elevation of the house being seven '(7) feet higher than the street, making retainer walls necessary in the rear and side yards, were all conditions contributing to the mistake in setting the slab. Scott Kretzer, of Thistle Hcmes, Inc. explained the lot had such a hill, that the mistake occurred when the stringlines were pulled. MX. Kretzer stated he had received a green tag on his form inspection. After some further discussion, Charles Giffin made a motion to close the Public Hearing. Tim Hobbs seconded the motion which prevailed by the following vote: Ayes: Thompson, Hobbs, Giffin, Truitt Nays: None Absent: Swann, Bigbie, Frieden Charles Giffin made a motion that a special condition did exist. Tim Hobbs seconded the motion which prevailed by the following vote: Ayes: Thompson, Hobbs, Giffin, Truitt Nays: None Absent: Swann, Bigbie, Frieden Charles Giffin then stated the special conditions were the curve of the street and topography of the lot, the fact the lot is 7 feet higher than the street making the stringline difficult to install and read properly, and that the variance was a honest mistake, and to grant the variance to Grapevine Zoning Ordinance 82-73, Section 15.G.1, for a.834 foot variance fOAR D OF ZONING ADJUSTMENT JUNE 5, 1•8• 1-#AGE 2 • 10 inch variance providing for a front yard line of 29.2 feet. Tin Hobbs seconded the motion which prevailed by the following vote: Ayes:- Thompson, Hobbs, Giffin, Truitt Nays: None Absent: Swann, Bigbie, Frieden Mr. Johnston spoke and explained the problem with the encroachment and survey. After further discussion, Charles Giffin made a motion to close the Public Hearing. Tim Hobbs seconded the motion which prevailed by the following vote: Ayes: Thompson, Hobbs, Giffin, Truitt Nays: None Absent: Swann, Bigbie, Frieden Ayes: Thompson, Hobbs, Giffin, Truitt Nays: None Absent: Swann, Bigbie, Frieden powailmals "Ohnewomy DIN BOARD • ZONING ADJUSTMENT JUNE 5, 1989 PAGE 3 00110 The next item for the Board of Zoning Adjustment to consider were the minutes of the May 1, 1989 meting. Charles Giffin made a motion to accept the minutes as corrected, which under BZA 89-10 through 15, Harwood, Miller and Giffin, Charles Giffin was changed from voting for the request to abstaining from the vote. Tim Hobbs seconded the motion which prevailed by the following vote: Ayes: Thompson, Hobbs, Giffin, Truitt Nays: None Absent: Swann, Bigbie, Frieden Tommy Hardy stated that if any board member is involved in a case, to have someone else present to represent the case. Adrienne Leonard also stated if there is a conflict of interest among a board member, that person should not participate. Charles Giffin inquired about Kountry Donuts and their green space. Greg Wheeler stated he and the Main Street Director, Terry Colley, had checked the site and the building and that everything looked fine. Charles Giffin seconded the motion which prevailed by the following vote: Ayes: Thompson, Hobbs, Giffin, Truitt Nays: None Absent: Swann, Bigbie, Frieden The meeting was adjourned at 6:25 P.M.
