Also present was City Council Representative Gil Traverse and the following City Staff: Greg Wheeler Assistant Building Official Marcy Ratcliff Planner Adrienne Leonard Attorney, City Attorney's Office Gerrie Anderson Administrative Secretary Chairman Charles Giffin called the meting to order at 6:15 P.M. NEW BUSINESS QUINFAI .11 1 The first item of new business for the Board of Zoning Adjustment to consider was BZA 89-39, submitted by Donna L. Martin who is requesting variances to Grapevine Zoning Ordinance 82-73, Section 15.G.1 which requires a 30 foot front yard, a 1.13 foot variance is needed, and to Section 15.G.3 which requires a 6 foot side yard, a .69 foot variance is needed. The variances requested is for Ms. Martin's property located at 1449 Rider Circle, Lot 13, Block 3, Blair Manor Estates. Greg Wheeler explained that the builder had built the northeast corner of the house over the front building line and the garage was built over the south property line onto Lot 12, Block 3. The garage also encroaches over the rear 25 foot rear yard requirement. Chairman Charles Giffin administered the Oath of Truth to Ms. Donna Martin and Tommy Burks, with Burks Land Surveying. Since the property had not been replatted, Adrienne Leonard noted that the Boards decision would have to be contingent on the replat if approved. Ms. Martin stated that her neighbors, who live on Lot 12, have no problem with the variance. With no one else to speak either for or against the request, Becky Swann made a motion to close the Public Hearing. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Giffin, Swann, Thompson, Truitt Nays: None Absent: Bass Becky Swann then made a motion that a special condition did exist. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Giffin, Swann, Thompson, Truitt Nays: None Absent: Bass Becky Swann made a motion that the special condition is that the property is existing, the violation is no fault of the applicant or owner and to approve the variances to Grapevine Zoning Ordinance 82-73, Section 15.G.1 to allow 1.13 foot encroachment to the front yard setback, and to Section 15.G.3, to allow a .69 foot encroachment to the side va-rd setback, and both being contingent on a replat being approved that is consistent with these variances. Gerald Thompson seconded the motion which prevailed by the following vote: BOARD OF ZONING ADJUSTPENT JANUARY 9, 1990 PAGE 2 There was some discussion among the Board members on the importance of saving trees. Raymond Truitt made a motion that a special condition did exist. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Giffin, Swann, Thcmpson, Truitt Nays: None Absent: Bass Raymond Truitt made a notion that the special condition is that the reposition of the house on the lot would cost the lives of many trees, therefore, to grant the variance to Grapevine Zoning ordinance 82-73, Section, 15.G.1 to allow for a 1.5 foot encroachment in the front yard setback. Charles Giffin amended the motion to add to the special condition that the lot is irregular in shape, the house would fit on a normal rectangular shaped lot in the subdivision, and that the 1.5 foot variance is for a bay window which would normally be permitted if it did not touch the ground. Raymond Truitt made a motion to accept Charles Giffin's amendments to the motion. Gerald Thompson seconded the motion to accept the amendments and to approve the variance. The following vote prevailed: Ayes: Giffin, Swann, Thompson, Truitt Nays: None Absent: Bass MISCELLANEOUS DISCUSSION AND/OR REPORTS Adrienne Leonard discussed with the Board that it would be easier to state three separate motions, that a special condition exists, what the exceptions are, and then to make the notion to approve or deny the variance. Marcy Ratclif f announced the two new board me-nbers that will be sworn in at the next meeting, John Dorety, 1st Alternate, and Andrew Quinn, 2nd Alternate. VOAPD OF ZONING ADJUSTMENT impm 9, 1990 • AGE 3 Raymond Truitt made a motion to approve the minutes of the November 6, 1989, meeting as written. Becky Swann seconded the motion which prevailed by the following vote: Ayes: Giffin, Swann, Thompson, Truitt Nays: None Absent: Bass IAT�, -TnTTT)&'MA'MTM With no further discussion, Becky Swann made a motion to adjourn the meting.
