HomeMy WebLinkAbout1990-02-05L" 0 V4K9J ML4 S*%Aj ZI 2J TAf 10 The Board of Zoning Adjustment for the City of Grapevine, Texas, net in regular session on Monday evening, February 5, 1990, at 6:00 P.M., in the Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas, with the following members present to wit: Charles Giffin Becky Swann Gerald Thompson Raymond Truitt John Dorety Andrew Quinn Chairman Vice-Chairman Secretary Member lst Alternate 2nd Alternate constituting a quorum, with Member Patti Bass absent. City Council Representative, Gil Traverse was present and also the following City Staff: H. T. OATH OF OFFICE Gerrie Anderson administered the Oath of Office to new members John Dorety, lst Alternate and Andrew Quinn, 2nd Alternate. NEW BUSINESS BZA 89-40, D. R. HORTON HOYM The first item of new business was for the Board of Zoning Adjustment to consider BZA 89-40, submitted by D. R. Horton Homes, who is requesting a variance from Grapevine Zoning Ordinance 82-73, Section 15.G.I., which requires a 30 foot front yard, to allow a 6 inch encroachment and provide for a 29.5 foot setback for 5105 Haydenbend Circle, Lot 15, Block 4, Glade Landing Subdivision. Joy Carroll explained that for financing purposes, a survey revealed there was a 6 inch encroachment. Staff was not making stringline inspections at the time the house was built. There was no one present to speak on the case. Becky Swann made a motion to close the public hearing. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Giffin, Swann, Thompson, Truitt, Dorety Nays: None Absent: Bass Becky Swann then made a motion that a special condition did exist and the special condition being that the structure was existing. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Giffin, Swann, Thompson, Truitt, Dorety Nays: None Absent: Bass A motion was made by Becky Swann to grant the variance to Grapevine Zoning Ordinance 82-73, Section 15.G.I., to allow a 6 inch encroachment. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Giffin, Swann, Thompson, Truitt, Dorety Nays: None Absent: Bass Board of Zoning Adjustment February 5, 1990 Page 2 The next item • new business was for the Board • Zoning Adjustment to consider BZA 89-41, submitted by Virgil Miller who is requesting a variance from Grapevine Zoning Ordinance 82-73, Section 15.G.I., which requires a 30 foot front yard to allow a six and one tenth foot (6-1/10') encroacbment and provide for a 23.9 foot front yard setback for 1138 Valley Vista Drive, Lot 8, Block 2, Bellair Addition. Joy Carroll noted that Staff reccmmnded approval and explained that when the Bellaire Subdivision was built, a 25 foot front yard was required. No one was present to represent the case, Gerald Thompson made a motion to close the Pubic Hearing. John Dorety seconded the motion which prevailed by the following vote: Ayes: Giffin, Swann, Thompson, Truitt, Dorety Nays: None Absent: Bass Becky Swann made a motion that a special condition did exist and the special condition being that the subdivision is established and the structure is already existing. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Giffin, Swann, Thompson, Truitt, Dorety Nays: None Absent: Bass The next item of new business was for the Board of Zoning Adjustment to consider BZA 89-43, submitted by Chili's, Inc. who is requesting a variance • Grapevine Zoning Ordinance 82-73, Section 60.B.2. (c) , which allows a maximum 14 inch pole sign cabinet depth. The variance will allow a 30 inch depth instead, requiring a 1 foot, 4 inch or 16 inch variance. Joy Carroll explained that Staff recormended approval for the additional iepth for the sign, because illuminated signs require ample access for repair and maintenance. Nick Rugerri, applicant with Heath and Company, took the Oath of Truth and answered questions from the Board. With no one else to speak for or against the request, Gerald Thompson made a motion to close the public hearing. Becky Swann seconded the motion which prevailed • the following vote: Ayes: Giffin, Swann, Thompson, Truitt, Dorety Nays: None Absent: Bass Charles Giffin stated that in the past the Board has granted variances to the depth of signs for repair and maintenance reasons. Gerald Thompson made a motion that a special condition did exist and the special condition being was to allow the sign to be large enough for someone to enter the sign for repair. Raymond Truitt seconded the motion which prevailed • the following vote: Ayes: Giffin, Swann, Thompson, Truitt, Dorety Nays: None Absent: Bass Board of Zoning Adjustment February 5, 1990 Page 3 A motion was made by Gerald Thompson to grant a variance to Grapevine Zoning Ordinance 82-73, Section 60.B.2. (c) , to allow a one foot, four inch (1'4") or sixteen inch (16") variance. Becky Swann seconded the motion which prevailed by the following vote: Ayes: Giffin, Swann, Thompson, Truitt, Dorety Nays: None Absent: Bass The last item of new business was for the Board of Zoning Adjustment to consider BZA 90-01 submitted by the Grapevine/Colleyville Independent School District, for 10.46 acres located north of the Colleyville boundary, west of Cheek Sparger and east of Roberts Road which is to be utilized as an elementary school. Joy Carroll explained that Staff recommended approval for the variance being requested to Grapevine Zoning Ordinance 82-73, Section 53.H.2.b., which requires a 10 foot wide perimeter landscape buffer between vehicular use areas and adjacent property lines, as indicated on the site plan; and denial to Section 53.H.1.c., which requires parking lot planter islands no further apart than twelve (12) parking spaces and at the terminus of all rows of parking. Ms. Carroll explained that to have the landscape buffer between the two tracts would not be as crucial because the property to the south is in the Colleyville city limits and will be developed as school property. Barry Kanning of 819 Beverly Drive, Grapevine, took the Oath of Truth and explained that they had made every effort to develop the tract according to the City's regulations. Mr. Kanning explained to the Board that their experience with planter islands were not good due to the kind of soil in the area, which moisture tends to get underneath the paving and could cause premature failure of the slab due to the water penetration. With no one else to speak either for or against the request, Raymond Truitt made a motion to close the public hearing. Becky Swann seconded the motion which prevailed by the following vote: Ayes: Giffin, Swann, Thompson, Truitt, Dorety Nays: None Absent: Bass Gerald Thompson asked Mr. Hardy about the effect planter islands have had on other tracts in town. Tommy Hardy explained that Mr. Kanning's concerns are valid but planter islands have been installed in Grapevine since 1984 and he has received no complaints of failure of the paving or planter islands. After further discussion, Becky Swann made a motion that no special condition existed for the variance to the planter islands. Raymond Truitt seconded the motion which prevailed by the following vote: Ayes: Giffin, Swann, Thompson, Truitt, Dorety Nays: None Absent: Bass Raymond Truitt then made a motion to deny the variance to Grapevine Zoning Ordinance 82-73, Section 53.H.1.c., for planter islands. Becky Swann seconded the motion which prevailed by the following vote: Ayes: Giffin, Swann, Thompson, Truitt, Dorety Nays: None Absent: Bass Becky Swann then made a motion that a special condition did exist for the variance to the landscape buffer area; the special condition being that the property adjoins the city limits of Colleyville and that the adjoining property is school property and is planned to be developed as a school site, and therefore grant the variance to Grapevine Zoning Ordinance 82-73, Board of Zoning Adjustment February 5, 1990 Page 4 Section 53.H.2.b. Raymond Truitt seconded the motion which prevailed by the following vote: Ayes: Giffin, Swann, Thompson, Truitt, Dorety Nays: None Absent: Bass For the office of Secretary, John Dorety made a motion to nominate Gerald Thompson. Becky Swann made a motion to accept the minutes of the December 11, 1989, meeting. Raymond Truitt seconded the motion which prevailed by the following vote: Ayes: Giffin, Swann, Thompson, Truitt, Dorety Nays: None Absent: Bass Raymond Truitt made a motion to adjourn the meetinq.
