IN ACCORDANCE WITH ARTICLE 6252-17, V.A.T.C.S., AS AMENDED BY CHAPTER
227, ACTS OF THE 61ST LEGISLATURE, REGULAR SESSION,. THE BOARD OF
ZONING ADJUSTMENT REGULAR MEETING AGENDA WAS PREPARED AND POSTED ON
THIS THE 30TH DAY OF MARCH, 1990 AT 5 PM.

The Board of Zoning Adjustment for the City of Grapevine, Texas, met in
regular session on Monday evening, April 2, 1990, at 6:00 P.M., in the
Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas, with
the following members present to wit:

constituting a quorum, with Members Gerald Thompson, Raymond Truitt, and
Patti Bass absent. Also present was City Council Representative Gil
Traverse and the following City Staff:

Chairman, Charles Giffin, called the meeting to order a 6:15 P.M.,
The first item of new business was for the Board of Zoning Adjustment to
consider BZA 90-07, submitted by Ralph B. Putnam, who is requesting a
variance to Grapevine Zoning Ordinance 82-73, Section 15.G.1, which
requires a 30 foot front yard setback, to allow a 9.9 foot variance for his
property located at 3627 Oakwood Drive, Lot 6, Block 1, Grapevine Lake
Estates.
Joy Carroll explained that Mr. Putnam was requesting a variance to
construct a 4,683 square foot house, but because half of the lot is
unbuildable, he needs the 9.9 foot variance. Ms. Carroll stated that Staff
recommended approval.
Mr. Ralph Putnam, applicant, took the Oath of Truth and explained that the
lot has less than 6,000 square feet that is level enough to be buildable.
With no one else to speak either for or against the request, Becky Swarm
made a motion to close the public hearing. Andrew Quinn seconded the
motion which prevailed by the following vote:
Ayes: Giffin, Swann, Dorety, Quinn
Nays: None
Absent: Thompson, Truitt, Bass
Becky Swann then made a motion that a special condition did exist. The
special conditions being the layout of the lot and the lot being
unbuildable. Further, the motion is to grant the variance to Grapevine
Zoning Ordinance 82-73, Section 15.6.1 which requires a 30 foot front yard
setback to allow a 9.9 foot variance and provide for a 20.1 foot front
yard. John Dorety seconded the motion which prevailed by the following
vote:
Ayes: Giffin, Swann, Dorety, Quinn
Nays: None
Absent: Thompson, Truitt, Bass
The next item of new business was for the Board of Zoning Adjustment to
consider BZA 90-08, submitted by Cook Investors, Inc., who are requesting a
variance to Grapevine Zoning Ordinance 82-73, Section 15.G.2 which requires
a 25 foot rear yard setback to allow an 11 foot variance for an attached
garage at 2903 Creekwood Drive.

Joy Carroll showed slides of the property and stated that Staff recamy-anded
denial since the structure and subdivision had been developed under present
ordinance requirements. Staff cannot determine that a special condition
exists to justify the variance request.
Doug Cook, • 3006 Old Mill Run, Grapevine, and applicant, took the Oath •
Truth and explained that the property owner was wanting to enclos-
•• .•- which is located on the side • the property, and to build
another garage, which would be attached to the existing garage.
With no one else to speak either for or against the case, Becky Swann made
a motion to close the public hearing. John Dorety seconded the motion
which prevailed by the following vote:
Ayes: Giffin, Swann, Dorety, Quinn
Nays: None
Absent: Thcffpson, Truitt, Bass

Joy Carroll explained that -Staff recom-nended approval because the
development is existing and the encroachment is no fault of the applicant.
She noted that the loan institution is requiring the applicant to apply for
t)t,e variance.

With no one to speak either for or against the request, Becky Swann made a
motion to close the public hearing. John Dorety seconded the motion which
prevailed by the following vote:
Ayes: Giffin, Swann, Dorety, Quinn
Nays: None

Becky Swann then made a motion that a special condition did exist. The
special conditions are that the property is existing, and the error of the
encroachment was discovered after the house was built. Further, the motion
is to approve the variances to Grapevine Zoning Ordinance 82-73, Section
15.G.1, to allow a 1.5 foot encroachment to the front yard setback, and to
Section 42.D allowing a 6 foot encroachment to the side yard setback. John
Dorety seconded the notion which prevailed by the following vote:
Ayes: Giffin, Swann, Dorety, Quinn
Nays: None
Absent: Thompson, Truitt, Bass
BZA 90-10 AND BZA 90-11, BELMONT HOMES
The last two items for the Board of Zoning Adjustment to consider were BZA
90-10 and BZA 90-11, submitted by Belmont Homes. The request is for a
variance from Grapevine Zoning Ordinance 82-73, Section 16.G.3 which
requires a 25 foot rear yard for the R-5.0, Zero Lot Line zoning district.
The request is to permit a 10 foot variance and provide for a 15 foot rear
yard for Lots 21R and 22R, Block 1, Banyan Place Subdivision.
Joy Carroll explained that the Board of Zoning Adjustment previously
approved variances to allow reduction of the 100 foot lot depth for Lots
21, 22 and 23, Block 1; however, a replat. scheduled for the April 17, 1990,
Planning and Zoning Commission/City Council meeting proposes two lots, Lots
21R and 22R, instead of the three lots to provide additional width,
requiring only rear yard variances for the subject houses. She also
explained that the Council had approved the "R-5.0" zoning and approved the
plat of the Banyan Place Subdivision with the knowledge that variances
would be necessary in order to convert the existing "R-TH", Townhouse
planned tract, in which the streets were already in place, to minimum 5,000
square foot lots. Due to the street layout, the Board of Zoning Adjustment
approved lot depths for several lots of less than 100 feet and expected
that possible variances would be requested at the time house plans were
selected.
Al Dun-cmre, of 227 Bushy Mound Road, Burleson, took the Oath of Truth and
explained to the Board that by platting the three lots into two, the lots
would be wider but the depth would stay the same.
With no one else to speak either for or against the request, Becky Swann
made a motion to close the Public Hearing. Andrew Quinn seconded the
motion which prevailed by the following vote:
Ayes: Giffin, Swann, Dorety, Quinn
Nays: None
Absent: Thompson, Truitt, Bass
John Dorety made a motion that a special condition did exist due to the lot
size being short. Further, he wade a motion to grant a 10 foot variance to
Grapevine Zoning Ordinance 82-73, Section 16.G.3, to provide for a 15 foot
rear yard for Lots 21R and 22R, Block 1, Banyan Place. Becky Swann
seconded the motion which prevailed by the following vote:
Ayes: Giffin, Swann, Dorety, Quinn
Nays: None
Absent: Thompson, Truitt, Bass

After reviewing the minutes, Becky Swann made a notion to accept the
minutes of the February 5, 1990, meting. Andrew Quinn seconded the motion
which prevailed by the following vote:

Greg Wheeler explained that if there is a ccroplaint about a storage
building, then, if there is a violation, the owner is notified by tht
Property Standards Officer.
