The Board of Zoning Adjustment for the City of Grapevine, Texas, met in
regular session on Monday evening, May 7, 1990, at 6:00 P.M., in the
Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas, with
the following members present to wit:

constituting a quorum, with Member Patti Bass absent. Also present were
City Council Representative Gil Traverse and the following City Staff:

Chairman, Charles Giffin, called the meeting to order at 6:02 P.M.
The first item of new business was for the Board of Zoning Adjustment to
consider BZA 90-12, submitted by Mr. Robert Jones for his property located
at 3030 Sweethriar, Lot 18, Block 2, Trail Lake Estates. Mr. Jones is
requesting a variance to Section 15.G.3 of Zoning Ordinance 82-73, which
requires a 6 foot side yard, to allow a maximum 3.1 foot encroachment by
the northeast corner of the principal structure, which is presently the
rear of the garage.
Joy Carroll stated that Staff recommended approval for the encroachment
relating to existing development which is in no way the fault of the
applicant.
Robert Jones, applicant, took the Oath of Truth and explained that within a
year after his house was built, he discovered his driveway was built on the
neighbor's property. He also explained that after about 4 years in court
over the matter, he and his neighbor settled out of court in which the
encroachment would have to be removed. He received a sum of money from his
builder and surveyor to put another driveway on the other side of the house
which is the only way to get to the garage.
Phillip Perry, of 3025 Trail Lake Drive, took the Oath of Truth and
explained that his house was located north of Mr. Jones'. Mr. Perry I s
house and back yard was flooded due to the runoff which came through where
Mr. Jones' old driveway was removed. Mr. Perry requested the Board deny
Mr. Jones' variance request or grant approval, with stipulations that Mr.
Jones place sand bags at the west side curb cut, repair the new curb cut on
the east side, not be allowed to bring in more sand and have the City
require a survey showing the forms for the new driveway to be at least 2
inches higher than the curb.
Gerald Thompson noted that the drainage problem will be corrected when the
old curb cut is filled in and the new driveway is completed, then the
drainage from the street will be directed to the storm drain.
Greg Wheeler stated a permit will be issued contingent upon the Board's
approval. He explained that Engineering will make an inspection on the
approach and will require it to be 2 inches above the curb. There was also
discussion on connecting a French drain to an underground pipe in the
easement in Mr. Jones' backyard to catch runoff.

With no one else to speak either for • against the request, Becky Swann
made a motion to close the Public Hearing. Raymond Truitt seconded the
motion which prevailed by the following vote:
Ayes: Giffin, Swann, Thompson, Truitt, Dorety
Nays: None
Absent: Bass

Danny J. Tosh, applicant, • 16051 Addison Road, #306, Dallas, took the
Oath of Truth and explained that the eastern corner of the car wash
intercedes into the rear yard, where the 5 foot variance is needed. He
noted that the car wash would not be economically feasible to move and is
in the best location for the circulation of traffic.
With no one else to speak either for or against the request, Gerald
Thompson made a motion to close the public hearing. Becky Swann seconded
the motion which prevailed by the following vote:

Nays: None
Absent: Bass

The next item of new business was for the Board of Zoning Adjustment to
consider BZA 90-13, submitted by Albert and Charlie Boswell who is
requesting a variance to Grapevine Zoning Ordinance 82-73, Section 15.B.6
which allows an accessory structure in the "R-7.5", Single Family Zoning
District to have a maximum 16 foot height unless the structure is set back
an additional 2 feet for each additional foot over 16 feet. The applicant
is requesting an 18 foot high accessory structure, requiring a 4 foot
variance for their property located at 2410 Dove Loop Road, Lot ID, Block
2, Russwood Estates, Phase III.
Joy Carroll stated that Staff recommended denial for the request because
there is reasonable use of the property.
Mrs. Charlie Boswell, applicant, took the Oath of Truth and explained that
a 4 foot variance is being requested to add a second story onto their
existing carport. She further explained that there was no alternative
location for a storage building on the lot. There is a railroad tie wall
on the east and south side of the property which restricts any building.
Albert Boswell, applicant, took the Oath of Truth and explained about the
construction of the addition which would make the height of the structure
be 16 feet plus 2 feet for the roof.
Tony Vertuca of 1306 Martin Court, Grapevine, took the Oath of Truth and
stated he opposed the request for two reasons. His first reason was the
fact he would be able to see the structure from his back windows and
second, there were power lines running through the property.
with no one else to speak either for or against the request, Gerald
Thompson made a motion to close the public hearing. Becky Swann seconded
the motion which prevailed by the following vote:
Ayes: Giffin, Swann, Thompson, Truitt, Quinn
Nays: None
Absent: Bass, Dorety
After further discussion, Raymond Truitt made a motion that no special
condition exist. Becky Swann seconded the motion which prevailed by the
following vote:
Ayes: Giffin, Swann, Thompson, Truitt, Quinn
Nays: None
Absent: Bass, Dorety
Raymond Truitt, therefore, made a motion to deny the variance as
requested. Becky Swann seconded the motion which prevailed by the
following vote:
Ayes: Giffin, Swann, Thompson, Truitt, Quinn
Nays: None
Absent: Bass, Dorety
The next item of new business for the Board of Zoning Adjustment to
consider was BZA 90-15, submitted by Charlene H. Berry, who is requesting a
variance from Grapevine Zoning Ordinance 82-73, Section 15.G.1, "R-7.51'11
Single Family Zoning District, which requires a 30 foot front yard, to
allow a .5 foot encroachment by the house and provide for a 29.5 foot
setback for the property located at 2835 Brookshire, Lot 13, Block 13, Oak
Creek Estates.
Charlene Berry, applicant and selling agent, of 1200 S. Main #2100,
Grapevine, took the Oath of Truth. Ms. Berry explained that eight years
after the house had been built, a survey showed there was a .5 foot
encroachment.
With no one else to speak either for or against the request, Becky Swann
made a motion to close the public hearing. Andrew Quinn seconded the
motion which prevailed by the following vote:

The last item • new business for the Board • Zoning Adjustment to
consider was BZA 90-16, submitted • Wayne and Carolyn Garrett, who is
requesting a variance to Grapevine Zoning Ordinance 82-73, Section
"R-12.5", Single Family Zoning District, which requires a 35 foot front
yard for their property located at 2741 Manchester Lane, Lot 9, Block 2, of
Canterbury Village.
Joy Carroll explained that
the
Garretts
were granted a variance at the
previous meting to add a
garage to
their existing residence. An
additional survey indicated
the
previous
survey was in error; therefore,
the Garretts are requesting
an
additional
4 feet to provide a total 10.5
foot variance when BZA90-03
and
BZA90-16
are combined, and provide for a
24.5 foot front setback.
Mrs. Garrett, applicant, took the Oath of Truth and explained that Greg
Wheeler suggested to pull string lines from pin to pin, but one • the pins
was destroyed when the City was installing water in the area, therefore;
necessitating a second survey.
With no one else to speak either for or against the request, Gerald
Thompson made a motion to close the public hearing. Andrew Quinn seconded
the motion which prevailed by the following vote:
Ayes: Giffin, Swann, Thompson, Truitt, Quinn
Nays- None
Absent: Bass, Dorety
Andrew Quinn then made a motion that a special condition did exist and the
special condition being that there was a mistake with the previous survey
and was no fault of the owners. Further, Mr. Quinn made a motion to grant
the variance to Grapevine Zoning Ordinance 82-73, Section 14.G.1, allowing
an additional 4 feet, providing for a 24.5 foot setback. Gerald Thcmpson
seconded the motion which prevailed by the following vote:
Ayes: Giffin, Swann, Thompson, Truitt, Quinn
Nays: None
Absent: Bass, Dorety
Gerald Thompson made a motion to approve the minutes of the March 5, 1990,
meeting, as corrected. Raymond Truitt seconded the wtion which prevailei

Nays: None

• further discussion, Gerald Thompson made a motion to adjourn the
