ADJOURNMENT IN ACCORDANCE WITH ARTICLE 6252-17, V.A.T.C.S., AS AMENDED BY CHAPTER 227, ACT'S OF THE 61ST LEGISLATURE, REGULAR SESSION, THE BOARD OF ZONING ADJUSTMENT REGULAR MEETING AGENDA WAS PREPARED AND POSTED ON THIS THE 28TH DAY OF SEPTEMBER, 1990, AT 5:00 P.M. The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular session on Monday evening, October 1, 1990, at 6:00 P.M., in the Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas, with the following members present to wit: Charles Giffin Chairman Raymond Truitt Vice-Chairman Patti Bass Member John Dorety Member Andrew Quinn 1st Alternate Randy Howell 2nd Alternate constituting a quorum, with Secretary, Gerald Thcmpson, absent. Also present was City Council Representative, Gil Traverse, and the following City Staff: H. T. (Tcniny) Hardy Director of Community Development Joy Carroll Administrative Aide Greg Wheeler Building Official Adrienne Leonard Attorney, City Attorney's Office Gerrie Anderson Administrative Secretary [W-nom Chairman, Charles Giffin, called the meeting to order at 6:06 p.m. Gerrie Anderson administered the Oath of Office to Vice - Chairman, Raymond Truitt. We gonalmli"No I INATRIN NO M a I a X41 a -2 11 M a BZA 90-24, was the item of Old Business for the Board of Zoning Adjustment to consider. This case has previously been tabled from the past meetings of August 6, 1990, and September 4, 1990 for the applicant, Mr. Mitchell Mayes and the property owner to the rear, Ms. Ann Rochelle, to work out the drainage problem that may be caused, due to the construction of a slab on the Mayes' property. The variance being requested is to Grapevine Zoning Ordinance 82-73, Section 43.E.3 for the Board of Zoning Adjustment to approve a Special Exception to allow the "remodeling or enlargement of the nonconforming use when such would not tend to prolong the life of the nonconforming use...", for 206 West Peach Street, Lot 6 of the Ellis Subdivision. Mrs. Lucille Mayes, applicant, took the Oath of Truth and stated that she did not think the drainage problem would be able to be resolved with Ms. Rochelle. Mr. Russell W. Levens, Engineer, of 220 Westwood, Southlake, Texas, took the Oath of Truth and explained that he had looked at the property two times. He explained that the drainage probably did change somewhat when the slab was poured. Ann Rochelle of 205 Hall Street, Grapevine, took the Oath of Truth. Ms. Rochelle submitted pictures of her yard for the Board's review. She explained that when the water hits the slab on the Mayes' property, there is no place for the water to go but onto her property. She suggested that a soil berm or dike would probably not keep the water from running onto her property. Ms. Rochelle said that she had asked the Mayes to build a 12 inch curb that would extend past her house so the water would drain into her garden area. Mrs. Mayes stated that they have improved the situation of the drainage with earthern and a wood board. Patti Bass made a motion to close the public hearing. John Dorety seconded the motion which prevailed by the following vote: and of Zoning Adjustarent October 1, 1990 Page 2 The variance was denied. NEW BUSINESS #at Board of Zoning Adjustment October 1, 1990 Page 3 Chairman Giffin indicated he would approve the variance. He expressed a preference for the site lay-out utilizing the outer (western most) lot area for the 25 foot drive, thereby, allowing a 12 foot width for the drive serving the interior employee parking area. Mr. Giffin expressed that based on the access and configuration of the property, might be the best layout. Raymond Truitt further made a motion to grant the variance to Grapevine Zoning Ordinance 82-73, Section 58, Parking and Loading Area Development Standards, allowing a 12 foot variance for a one way drive to be reduced from 25 feet to 13 feet. John Dorety seconded the motion which prevailed by the following vote: Ayes: Giffin, , Truitt, Dorety, Quinn Nays: Bass Absent: Thompson BZA 90-29, RICHARD R. F_q�N, S�I The last item of new business was for the Board of Zoning Adjustment to consider BZA 90-29, submitted by Richard R. Hampton, Sr., who is requesting a variance for his existing residence located at 2523 Anglers Drive, Lot 1, Block 4, Grapevine Lake Estates. Staff recommends approval to Grapevine Zoning Ordinance 82-73, Section 15.G.1, "R-7.5", Single Family Zoning District Requirements for a 30 foot front yard setback, a 5.70 foot variance is being requested.. Staff recommends denial to Section 15.G.2 which requires a 25 foot rear yard setback. The request is to allow a 15.5 foot variance for an additional bedroom and a 22 foot variance at the rear of the existing carport. Staff also recommends denial to Section 42.D. which requires a 30 foot reverse frontage setback. The request is for an 8 foot variance for the area of new construction into the reverse frontage side yard. Mr. Hampton, Sr., applicant, took the Oath of Truth and explained hardships with his 1300 square foot home that was built 27 years ago. He explained that he has two children in college that live there periodically; and he is getting married in the near future. He noted that with the add-on to his residence, the living area will be increased to 2600 square feet and there will be an area to park the cars. Mr. Hampton also noted that all of his neighbors agree that a variance is needed. George Elliott, of 2524 Anglers Drive, Grapevine, took the Oath of Truth and stated that he was speaking for the neighbors in support of the variance. Sabine Coventry, of 3721 Oakwood Drive, Grapevine, took the Oath of Truth and expressed her approval of the variance. With no one else to speak either for or against the request, John Dorety made a motion to close the Public Hearing. Patti Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Truitt, Dorety, Quinn Nays: None Absent: Thompson Mr. Hampton's builder, Pat McCombs, took the Oath of Truth and explained about the plans for the addition. After further discussion, John Dorety made a motion that a special condition does exist because of the hills, valleys and irregular shape of the lot, and that the existing structure is nonconforming. Patti Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Truitt, Dorety, Quinn Nays: None Absent: Thompson John Dorety then made a motion to approve the variances to Grapevine Zoning Ordinance 82-73, Section 15.G.1, for a 5.70 foot variance, to allow a 24.3 foot front yard; Section 15.G.2, allowing a 15.5 foot variance for an additional bedroom and a 22 foot variance at the rear of the existing carport; and to Section 42.D, allowing an eight foot variance for the area and of Zoning Adjustment October 1, 1990 Page 4 • new construction into the reverse frontage side yard. Patti Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Truitt, Dorety, Quinn Nays: None Absent- Thompson The last item was for the and of Zoning Adjustment to consider the minutes of the August 6, 1990, meeting. Patti Bass made a motion to accept the minutes of the August 6, 1990, meeting as written. John Dorety seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Truitt, Dorety, Quinn Nays: None Absent: Thompson Joy Carroll announced that there would be a special Board of Zoning Adjustment meeting scheduled for Thursday, October 4, 1990, for consideration of BZA Case#90-32, suh andy Homes. With no further discussion, Raymond Truitt made a motion to adjourn the meeting.
