MISCELLANEOUS DISCUSSION AND/OR REPORTS Rl ACCORDANCE WTTH ARTICLE 6252-17, V.A.T.C.S., AS AMENDED BY CHAPTER 227, ACTS OF THE 61ST LEGISLATURE, REGULAR SESSION, THE BOARD OF ZONING ADJUSTMENT REGULAR MEETING AGENDA WAS PREPARED AND POSTED ON THIS THE 2ND DAY OF OCTOBER, 1990, AT 5:00 P.M. JUL ak2d� DIRECTOR OF CDHVbWITY DEM-OPMENT The Board • Zoning Adjustment for the City of Grapevine, Texas, met in in a special session on Thursday evening, October 4, 1990, at 6:00 P.M., in the Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas, with the following members present to Charles Giffin Raymond Truitt Patti Bass Andrew Quinn Randy Howell Chairman Vice Chairman Member 1st Alternate 2nd Alternate constituting a quorum, with Secretary, Gerald Thoapson and Member John D• rety absent. Also present were the following City Staff: H. T. (Tommy) Hardy Greg Wheeler Joy Carroll Gerrie Anderson NISLOJA-M Director of Community Development Building Official Administrative Aide Administrative Secretary Chairman Charles Giffin called the meting to order at 6:12 p.m. The item of new business for the Board of Zoning Adjustment to consider was BZA 90-32, submitted by Tandy Homes for an existing house located at 2813 Green-brook Ct., Lot 21, Block 3 of the Timberline South Subdivision. City Staff recommends denial to a requested variance from Grapevine Zoning Ordinance 82-73, Section 15.G.2, R-7.5, Single Family Zoning District requirements for a 25 foot rear yard setback. A 19 foot variance is being requested for the encroachment to allow a six foot setback for the existing garage. Staff recommends approval to Grapevine Zoning Ordinance 82-73, Section 43.0.3 which allows, a maximum six foot wide breezeway to connect a principal and accessory structure in the residential zoning districts. The request is to allow a 12 foot wide breezeway to remain as built which will require a six foot variance. Staff also recoarends approval to Grapevine Zoning Ordinance 82-73, Section 68.J. Board of Zoning Adjustment, to waive the requirement for a one (1) year waiting period for any like request on the same tract of land. The Board of Zoning Adjustment denied the request September 4, 1990; and the applicant has re-applied for an identical variance on the same tract. Tommy Hardy explained that the first item was for the Board to act on whether or not they agree to waive the one vear waiting period for an applicant to come back before the Board, after being denied a variance. Andrew Quinn made a motion to waive the one year waiting period in order for the applicant to be heard at tonight's meting. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Truitt, Bass, Quinn, Howell Nays: None Absent: Thompson, Dorety 1,,Iext, Tommy Hardy showed the 'Board a slide presentation of the property. Mr. Hardy explained that the Board was hearinq the case again because Staff and the applicant both shared in the responsibility of the encroachment of the breezeway. He explained that because there was not enough Staff time, the architectural plans were not checked, or the 20 foot breezeway would have been caught. The applicant also did not show the breeze-way on the plot plan which is always checked in plan review. Michael Tandy, applicant, spoke and explained that to remove the breezeway, both sides of the garage roof would be involved and that the breezeway and balcony on the house all tie-in together. He also noted that another special condition would be aesthetics, and that he would not have built the breezeway if he had been aware of the six foot wide requirement. Mr. Tandy and of Zoning Adjustment October 4, 1990 Page 2 also explained that all electrical wiring runs through the breezeway into the garage and that the service would have to be moved. With no one else to speak either for or against the request, Raymond Truitt made- a motion to close the public hearing. Patti Bass seconded the motion which prevailed bv the following vote: Ayes: Giffin, Truitt, Bass, Quinn, Howell Nays: None Absent: Thompson, Dorety Andrew Quinn then made a motion that special conditions exists. He further stated that the special conditions were that the structure is existing and to make the change now would damage the quality of the house and possibly the safety. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Truitt, Bass, Quinn, Howell Nays: None Absent: Thonpson, Dorety Andrew Quinn made a motion to grant the variance to Grapevine Zoning Ordinance 82-73, Section 42.C.3 which requires a six foot breezeway, allowing for a six foot variance for a 12 foot breezeway. Patti Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Truitt, Bass, Quinn, Howell Nays: None Absent: Thompson, Dorety With no further discussion, Raymond Truitt made a motion to adjourn the meeting® Patti Bass seconded the notion which prevailed by the following vote: Ayes: Giffin, Truitt, Bass, Quinn, Howell Nays: None Absent: Thompson, Dorety The meting was adjourned at 6:30 P.M.
