IN ACCORDANCE WITH ARTICLE 6252-17, V.A.T.C.S., AS AMENDED BY CHAPTER 227, ACTS • THE 61ST LEGISLATURE, REGULAR SESSION, THE BOARD • ZONING ADJUSTMENT •B A• MEETING AGENDA WAS PREPARED AND POSTED ON THIS THE 2ND DAY • NOVEPMER, 1••0, AT 5:00 P.M. 0 - 100-NOMMUKOOKKwuNlat . jwWoMadjol mo The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular session on Monday evening, November 5, 1990, at 6:00 P.M., in the Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas with the following members present to wit: Charles Giffin Gerald Thompson Patti Bass John Dorety Andrew Quinn Randy Howell Chairman Secretary Member Member lst Alternate 2nd Alternate constituting a quorum with Vice Chairman, Raymond Truitt absent. Also present was City Council Representative, Ted Ware, and the following City Staff: H. T. (Tommy) Hardy, Community Development Director Greg Wheeler Building Official Joy Carroll Administrative Aide Marcy Ratcliff Planner Gerrie Anderson Administrative Secretary Chairman, Charles Giffin, called the meeting to order at 6:05 P.M. NEW BUSINESS The first item for the Board of Zoning Adjustment to consider was BZA 90-30, submitted by Mr. Carroll Rowbotham, who is requesting variances to his property located at 131 Hudgins Street, Lot 8, Block 15, of the Original Town of Grapevine, in order to expand his existing mini-warehouse development with the subject 39,044 square feet of additional land area adjoining his property. City Staff recommends denial to the following variances that are being requested. Section 31.F.2 for a 13% variance to the 15% Open Space requirement; Section 31.F.4 for a 13% variance to the 85% maximum impervious area requirement; Section 31.G.3 to allow 740 square feet of open space in the front yard instead of the 5,285.4 square feet required, a 4,545.4 square foot variance; Section 31.G.5 for a 5 foot variance to the 25 foot rear yard instead of the 30 feet required; Section 53.H.2.B. for a 10 foot variance to the 10 foot buffer yard required on the north and east property lines; Section 53.I.3.b for a 13% variance to the 15% required front yard landscaping; and to Section 53.1.4 requiring 3 trees to be planted requesting that no trees be required to be planted, a 100% variance. Zoning Application Z90-09 was heard October 16, 1990, by the City Council /Planning and Zoning Commission in a joint public hearing. The request is to change the CN, Neighborhood Commercial zoning to LI, Light Industrial. The City Council accepted the Planning and Zoning Commission's recommendation and approved the request on the first reading of the ordinance. If the Board of Zoning Adjustment denies the requests, then the 2nd reading of the ordinance cannot be considered. John Levitt, engineer for Mr. Rowbotham, of 726 Commerce Street, Southlake, TX, took the Oath of Truth. He explained that the two BOARD OF ZONING ADJUSTMENT NOVEMBER 5, 1990 PAGE 2 metal buildings located next to this property are nonconforming and were also granted variances. Carroll Rowbotham, applicant, 131 E. Hudgins, Grapevine, took the Oath of Truth and showed slides of his property and the surrounding neighborhood. As the slides indicated, Mr. Rowbotham improved the existing facility from its previous condition. He also noted that there is a need for additional storage in the area. Joy Carroll read letters stating approval, which are attached as Exhibit A, from Robert O. Stewart - American Bank of Commerce, Phillip R. Murphy - Mustang Metals Corporation, Donald R. Botic-DRB Management Group, Inc., and John M. Smith - Association Management Corporation. Mr. Rowbotham showed the Board a drawing of the existing property and the proposed facility. He explained that with one exit and one entrance, it would be hard to have the required amount of green area in the front of the property. Mr. Rowbotham did state that the City Council and Planning and Zoning Commission did endorse his plot plan. With no one else to speak either for or against the request, Gerald Thompson made a motion to close the public hearing. Patti Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Thompson, Bass, Dorety, Quinn Nays: None Absent: Truitt Mr. Rowbotham explained that he would like both facilities to look the same. He explained that the layout of the warehouses is for security reasons so there will be visibility down each aisle. Charles Giffin said he had no problems with the variances except he would like to see more landscaping and trees planted in the front area. Tommy Hardy noted that Staff felt since the applicant was continuing the existing development to the west, it would be difficult and impossible to develop the property under the current regulations. He also said that maybe the Board and the applicant could work out a compromise. Gerald Thompson seconded the amended motion which prevailed by the following vote: Ayes: Giffin, Nays: None Absent: Truitt Thompson, Bass, Dorety, Quinn The next item for the Board of Zoning Adjustment to consider was BZA 90-34, submitted by Jack Short who is requesting a variance from Grapevine Zoning Ordinance 82-73, Section 14.G.1, "R-12.5", Single-Family which requires a 35 foot front yard, to allow a 1.5 and 11 foot encroachment by the garage and the house and provide for a 28.5 and a 24 foot front yard. The variance is requested for 3022 Lakeview Drive, Lot 3, Block 2, Shoreview Estates. Greg Wheeler explained that a variance was requested back in 1984 when the front building line was 30 feet under the "R-111 requirements. The property now is under the new zoning ordinance which another variance is needed for the 35 foot front yard building line. Jack Short, applicant, took the Oath of Truth and explained to the Board that he had purchased the house one month ago. The house was built in 1979 which the original site plan showed 6 feet and is now changed to 11 feet. One bedroom and the garage area now encroaches under the new zoning ordinance. With no one else to speak either for or against the request, Patti Bass made a motion to close the public hearing. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Giffin, Thompson, Bass, Dorety, Quinn Nays: None Absent: Truitt Gerald Thompson made a motion that a special condition did exist. Mr. Thompson further stated that the special condition is that the building is existing and was built under the ordinance prior to the one we have today and had a variance to a non-conformance at that time, and further moved that in order to utilize the building, a variance needed to be granted. Patti Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Thompson, Bass, Dorety, Quinn Nays: None Absent: Truitt Gerald Thompson made a motion to approve the variance to Grapevine Zoning Ordinance 82-73, Section 14.G.1, "R-12.5" Single Family which requires a 35 foot front yard, to allow a 1.5 and a 11 foot encroachment by the garage and the house and provide for a 28.5 and a 24 foot front yard. Patti Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Thompson, Bass, Dorety, Quinn Nays: None Absent: Truitt The last item of business for the Board of Zoning Adjustment to consider was BZA 90-35, submitted by McKinney Homes. McKinney Homes is asking for a variance to Grapevine Zoning Ordinance 82-73, Section 15.G.1, "R-7.5," Single - Family, which requires a 30 foot front yard, to allow a 4.5 foot encroachment by the existing house and provide for a 25.5 foot front yard for 1822 Branch Hollow, Lot 34, Block 4, Shadow Glen, Phase II-B. BOARD OF ZONING ADJUSTMENT NOVEMBER 5, 1990 PAGE 4 Christi Lou Watson, of 9550 Skillman, Suite 504, Dallas, 75243, took the Oath of Truth and explained that they used M & M Surveyors to set the forms and the house was built according to the plot plan. Ms. Watson stated that the house was being sold and the Mortgage company is requiring a survey. Maki and Associates, who did the latest survey, found the encroachment. Chairman Giffin asked why one survey shows the house to be 53 feet deep and the other survey shows 56 feet deep. Ms. Watson explained that there were probably two similar house plans and one got mistaken for the other. With • one else to speak either for or against the request, Patti Bass made a motion to close the public hearing. John Dorety seconded the motion which prevailed by the following vote: Ayes: Giffin, Thompson, Bass, Dorety, Quinn Nays: None Absent: Truitt Patti Bass made a motion that a special condition did exist and the special condition is that the encroachment relates to an existing condition. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Giffin, Thompson, Bass, Dorety, Quinn Nays: None Absent: Truitt Patti Bass then made a motion to grant the variance to Grapevine Zoning Ordinance 82-73, Section 15.G.1, to allow a 4.5 foot encroachment by the existing house and provide for a 25.5 foot front yard. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Giffin, Thompson, Bass, Dorety, Quinn Nays: None Absent: Truitt WFORN-M Next was for the Board of Zoning Adjustment to consider the minutes of the September 4, 1990, meeting. Charles Giffin made a motion to table the minutes of September 4, 1990, to the next regular meeting because Page 2 of the minutes was missing from the Board's packets. Patti Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Thompson, Bass, Dorety, Quinn Nays: None Absent: Truitt rallmolow-glam With no further discussion, Gerald Thompson made a motion to adjourn the meeting.
