HomeMy WebLinkAbout2011-09-12STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Building Board of Appeals for the City of Grapevine, Texas, met on Monday evening, September 12, 2011, at 6:00 P.M. in the Planning and Zoning Conference Room, 2"d Floor, 200 South Main Street, Grapevine, Texas, for a Briefing Session with the following members present to wit: Joe Lipscomb Chairman Clint Hallman Member Jerrold Sklar Member Hal Hardister Member Paul Biesiadny Member constituting a quorum with Member Russell Kidd absent. Also present were City Council Representative Sharron Spencer, City Attorney Matthew Boyle and the following City Staff: Scott Williams Development Services Director f Building Official Randi Frisinger Deputy Chief Gene Tignor Code Enforcement Officer Connie Cook Development Services Assistant CALL TO ORDER Chairman Joe Lipscomb called the Briefing Session of the Building Board of Appeals to order at approximately 6:00 P.M. NEW BUSINESS Scott Williams briefed the Building Board of Appeals regarding the item scheduled to be heard in the regular public hearing. RECESS BRIEFING SESSION With no further discussion, the Briefing Session recessed to the Council Chambers to conduct Public Hearing, at approximately 6:15 P.M. RECONVENE BRIEFING SESSION Briefing session reconvened at approximately 6:45 P.M. City Attorney; Matthew Boyle conducted a briefing on the legal aspects of the Building Board of Appeals. Mr. Boyle explained the purpose, importance and composition of the Board. ADJOURNMENT With no further discussion, the meeting was adjourned at approximately 7:30 P.M. Also present were City Council Representative Sharron Spencer, City Attorney Matthew Boyle and the following City Staff: Scott Williams Development Services Director / Building Official Randi Frisinger Deputy Chief Gene Tignor Code Enforcement Officer Connie Cook Development Services Assistant CALL TO ORDER Chairman, Joe Lipscomb called the Public Hearing to order at approximately 6:15 p.m. OATH OF OFFICE Connie Cook administered the Oath of Office to reappointed Member, Hal Hardister, reappointed Member, Jerrold Sklar, and reappointed Member, Paul Biesiadny. ELECTION OF OFFICERS, For office of Chairman, Clint Hallman nominated Joe Lipscomb. Jerrold Sklar seconded the motion which prevailed by the following vote: Ayes: Hallman, Sklar, Hardister, Biesiadny Nays: None Abstain: Lipscomb Absent: None Jerrold Sklar made a motion to close nominations, Clint Hallman seconded the motion which prevailed by the following vote: Building Board of Appeals 9/12/11 Ayes: Hallman, Sklar, Hardister, Biesiadny Nays: None Abstain: Lipscomb Absent: None Joe Lipscomb was re-elected as Chairman. For office of Vice -Chairman, Jerrold Sklar nominated Russell Kidd. No second nomination was made. For office of Vice -Chairman, Paul Biesiadny nominated Jerrold Sklar, Hal Hardister seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Hallman, Hardister, Biesiadny Nays: None Abstain: Jerrold Sklar Absent: Kidd Clint Hallman made a motion to close nominations, Paul Biesiadny seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Sklar, Hallman, Hardister, Biesiadny Nays: None Abstain: None Absent: Kidd Jerrold Sklar was elected Vice -Chairman. PUBLIC HEARING BUILDING BOARD OF APPEALS TO CONSIDER BUILDING BOARD OF APPEALS CASE DB11-01. CITY OF GRAPEVINE The Building Board of Appeals considered DB1 1 -01 submitted by City of Grapevine for property located at 414 North Main Street, legally described as Lot 2, Block 1, North Main Addition. Scott Williams explained that Staff recommended the Building Board of Appeals determine the property to be a dangerous building pursuant to Chapter 7, Article II, of the Grapevine Code of Ordinances and recommended the Board to require the property to be repaired or demolished within 30 days. Mr. Williams stated that the owner would have thirty (30) days from the action of the Board, and if the work was not completed within the thirty (30) day period, the Board could report the act of noncompliance to the City Attorney for an injunction to be filed in district court. 2 Building Board of Appeals 9/12/11 Mr. Williams further explained that the property owner, Aubrey L. Smith, was initially notified of the violation on May 20, 2011, and no action had been taken by the property owner since the notification. The City of Grapevine has on numerous occasions secured and mowed the subject property. Mr. Williams requested that the Board declare the subject property a dangerous building due to the lack of action by the property owner. He also stated that due to the condition of the structure, he was working with the City Attorney towards summary demolition. Paul Biesiadny asked Mr. Williams if there was a more detailed legal description of a dangerous building. Mr. Williams stated that Chapter 7, Article II, of the Grapevine Code of Ordinances outlined different building elements that constituted a dangerous building. Joe Lipscomb asked Mr. Williams if he would read to the Board the sections of the Ordinance that were pertinent to this case. Mr. Williams proceeded to read Chapter 7, Article II, of the Grapevine Code of Ordinances. Mr. Williams stated that the specific violations included, but were not limited to: inadequate weather protection, (holes in roof and broken windows), fire damage to structure, damaged / missing plumbing, holes in walls, and unsanitary structure and premises. Mr. Williams further stated that Mr. Aubrey Smith and his son, Ronnie Smith, had been notified of the Building Board of Appeals meeting. With no further questions for Mr. Williams, and no additional speakers, Clint Hallman made a motion to close the public hearing. Jerrold Sklar seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Sklar, Hallman, Hardister, Biesiadny Nays: None Abstain: None Absent: Kidd Jerrold Sklar made a motion that the Board found the structure, located at 414 North Main Street, Lot 2, Block 1, North Main Addition, to be declared a dangerous building, pursuant to Chapter 7, Article Il, of the Grapevine Code of Ordinances and required the property to be repaired or demolished within 30 days from this meeting. Hal Hardister seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Sklar, Hallman Nays: None Abstain: None Absent: Kidd NEW BUSINESS Hardister, Biesiadny Next the Building Board of Appeals considered and approved the 2010 and 2011 3 Building Board of Appeals 9/12/11 Meeting Agenda Schedules, which prevailed by the following vote: Ayes: Lipscomb, Sklar, Hallman, Hardister, Biesiadny Nays: None Abstain: None Absent: Kidd MINUTES Next for the Board to consider was the minutes of the June 14, 2010, Briefing Session and Public Hearing. Jerrold Sklar made a motion to accept the minutes of the June 14, 2010, Briefing Session and Public Hearing. Clint Hallman seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Sklar, Hallman, Hardister, Biesiadny Nays: None Abstain: None Absent: Kidd ADJOURNMENT With no further discussion, Hal Hardister made a motion to adjourn.
