Tate Mayor STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The City Council of the City of Grapevine, Texas met in Executive Session on this the 6th day of February, 2007 at 6:15 p.m. in the City Council Conference Room, Second Floor, 200 South Main Street, with the following members present to -wit: William D. Tate Ted R. Ware Sharron Spencer C. Shane Wilbanks Clydene Johnson Roy Stewart Darlene Freed Mayor Mayor Pro Tem Council Member Council Member Council Member Council Member Council Member constituting a quorum, with the following members of the City Staff: Bruno Rumbelow City Manager Jennifer Hibbs Assistant City Manager H. T. Hardy Assistant City Manager Doug Conner Assistant City Attorney Linda Huff City Secretary CALL TO ORDER Mayor Tate called the meeting to order at 6:32 p.m. ITEM 1. EXECUTIVE SESSION Mayor Tate announced the City Council would conduct a closed session regarding: (A) conference with City Manager and Staff to discuss and deliberate commercial and financial information received from business prospects the City seeks to have locate and expand in the City; with which businesses the City is conducting economic development negotiations under Section 551.086, Texas Government Code, and (B) pending or contemplated litigation relative to City of Grapevine v. John and Lee Burrus, Cause No. 348-218294-06, pending in the 348th District Court, Tarrant County, Texas pursuant to Section 551.071, Texas Government Code, RECESS AND RECONVENE Mayor Tate announced the City Council would recess the Executive Session to conduct the Regular City Council meeting. Upon reconvening in the Council Chambers, all of the City Council members were present. 02/06/07 The City Council conducted the Regular City Council meeting Mayor Tate announced the City Council would recess to the Conference Room to continue the closed session regarding: (A)conference with City Manager and Staff to discuss and deliberate commercial and financial information received from business prospects the City seeks to have locate and expand in the City; with which businesses the City is conducting economic development negotiations under Section 551.086, Texas Government Code, and (B) pending or contemplated litigation relative to City of Grapevine v. John and Lee Burrus, Cause No. 348-218294-06, pending in the 348th District Court, Tarrant County, Texas pursuant to Section 551.071, Texas Government Code, Upon reconvening the Executive Session in the City Council Conference Room, all members of the City Council were present. Upon reconvening in open session in the Council Chambers, Mayor Tate asked if there was any action necessary relative to the closed session. City Manager Bruno Rumbelow stated there was no action necessary relative to conference with City Manager and Staff under Section 551.086, Texas Government Code. Regarding pending or contemplated litigation relative to City of Grapevine v. John and Lee Burrus, Cause No. 348-218294-06, pending in the 348th District Court, Tarrant County, Texas, City Manager Rumbelow requested authorization for the Staff to settle the lawsuit in the amount of $14,384.99 for non-payment of sewer fees. Council Member Wilbanks, seconded by Council Member Johnson, offered a motion to approve the settlement as recommended. ITEM 1. PRESENTATION, KEEP GRAPEVINE BEAUTIFUL Mayor Tate presented the President's Circle Award to Keep Grapevine Beautiful President, Paulie Undersander, from Keep America Beautiful. The organization was recognized for their exemplary efforts to reduce liter, minimize waste and beautify and improve the community. Ms. Undersander expressed her appreciation to the City Council for their support of the program. ITEM 2. PRESENTATION VOLUNTEER SERVICE AWARDS RAY AND SUSAN HARRIS Mayor Tate presented Ray and Susan Harris plaques on behalf of the D/FW Director's Association and the Texas Recreation and Park Society (TRAPA) Region 2 for their 3 volunteer efforts for the community. They are very supportive of events and volunteer for 02/06/07 any event or project sponsored by the City and in particular, the Parks & Recreation Department. Mr. Harris expressed their appreciation to the City. ITEM 3. RESOLUTION CALL 2007 CITY OFFICER ELECTION City Secretary Linda Huff recommended approval of a resolution calling the 2007 City Officer Election for Saturday, May 12, 2007, for City Council, Place 3 and Place 4, designating the polling place and, if necessary, a run-off election. Motion by Mayor Pro Tem Ware, seconded by Council Member Spencer, to approve the resolution as recommended prevailed by the following vote: Ayes: Tate, Ware, Spencer, Wilbanks, Johnson, Stewart & Freed Nays: None A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS PROVIDING FOR THE 2007 CITY OFFICER ELECTION TO BE HELD ON MAY 12, 2007; DETERMINING THE POLLING PLACE; PROVIDING SPECIFIC INSTRUCTIONS FOR THE CONDUCTING OF SAID ELECTION; REPEALING INCONSISTENT RESOLUTIONS AND PROVIDING AN EFFECTIVE DATE ITEM 4. CHANGE ORDER DOVE POOL REPAIR SERVICES Parks & Recreation Superintendent Chris Smith recommended approval of a change order with Treaty Oak Corporation, Inc. in the amount of $5,850.00 for repair services to Dove Pool. The change order is necessary to make repairs to the fiberglass gel coat at the pool. Motion by Council Member Freed, seconded by Council Member Wilbanks, to approve as recommended prevailed by the following vote: Ayes: Tate, Ware, Spencer, Wilbanks, Johnson, Stewart & Freed Nays: None ITEM 5. CONSIDERATION OF MINUTES City Secretary recommended approval of the minutes of the January 16 and 18, 2007 City Council minutes as published.
