IRVING, TX. 75061 03/13/2007 07:17 9725549370 RCSALES:VEACH STNT PAGE 03/03 Page 2 of 2 EASEMENT ABANDONMENT 604 HOMESTEAD LANE GRAPEVINE, TEXAS BEING a tract of land situated in Tarrant County, Texas and being part of Lot 3- R, Block 1, Heritage Place, an addition to the City of Grapevine, Tarrant County, Texas according to the Plat thereof recorded in Cabinet A, Slide 4472, Plat Records, Tarrant County, Texas, and being more particularly described by metes and bounds as follows: BEGINNING at a'r4 inch iron rod found in the west right-of-way line of Homestead Lane (a 50 -foot wide right-of-way), said iron rod being the southeast comer of said Lot 3-R; THENCE North 89045'25" West, along the south line of said Lot 3-R, a distance of 109.16 feet to a point for corner; THENCE North 00014'35" East, along the east line of an existing 7.5 -foot Utility Easement, a distance of 7.50 feet to a point for corner, THENCE South 89°45'25" East, over and across said Lot 3-R, a distance of 109.53 feet to a point for comer in the aforesaid west line of Homestead Lane; THEME in a southwesterly direction, along said west line of Homestead Lane with a curve to the left having a radius of 560.00 feet and a central angle of 00°46'07", an arc length of 7.51 feet to the POINT OF BEGINNING and containing 820 square feet of land more or less. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, ABANDONING AND VACATING A PORTION OF A UTILITY EASEMENT IN THE CITY OF GRAPEVINE, TEXAS AS HEREINAFTER DESCRIBED; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, the property owner of Lot 3-R, Block 1, Heritage Place Addition, recorded in Cabinet A, Slide 4472, Plat Records, Tarrant County, Texas, more specifically described in Exhibits "A" and "B" attached hereto and incorporated herein for all purposes, has requested an existing 7.5 foot wide utility easement along the south border of said lot, as herein after described, be abandoned and vacated; and WHEREAS, the existing utility easement, is not needed for public use and will not be needed in the future for public use; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated in the preamble of this ordinance are true and correct and are hereby incorporated into the body of this ordinance as if copied in their entirety. Section 2. That the existing utility easement, located within the property described in Exhibits "A" and "B", attached hereto and incorporated herein for all purposes, is hereby abandoned and vacated for public use and the same is hereby abandoned and vacated insofar as all public right, title, interest in and to said existing 7.5 foot utility easement is concerned. Section 3. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of any section, subsection, word, sentence or phrase shall be held to be invalid, it shall not affect the remaining part of this ordinance. Section 4. The fact that the utility easement segment is no longer needed by the public for public usage and would create a hardship or burden upon the City of Grapevine to keep open and maintain such utility easement creates an urgency and an emergency for the immediate preservation of the public health, safety, and general welfare which requires that this ordinance shall take effect immediately from and after its passage and it is accordingly so ordained.
