BRIEFING SESSION Chairman Oliver announced the Planning and Zoning Commission would conduct a briefing session relative to the following cases: Z06-16 414 NORTH MAIN STREET CU06-51 GRAPEVINE DODGE/SERVICE KING CU06-55 GRAPEVINE MILLS CROSSING AM07-01 AMENDMENTS TO SECTION 12,49 AND 60 OF THE GRAPEVINE COMPREHENSIVE ZONING ORDINANCE to discuss development issues. JOINT PUBLIC HEARINGS ZONE CHANGE REQUESTS Z06-16 414 NORTH MAIN STREET First for the Commission to consider and make a recommendation to the City Council was zone change requests Z06-16 submitted by RWS Management for property located at 414 North Main Street and legally described as Tracts 29A and 29B, Abstract 946, A F Leonard Survey and Lots 11-15 & 18-21, North Side Addition. The applicant was requesting to rezone 0.60 acres from "CN" Neighborhood Commercial and 1.37 acres from "R-5.0" Zero Lot Line to "PO" Professional Office District for a proposed office development. 022007 3 Mr. Ron Shirley, the applicant, was available for questions and requested favorable consideration of the application. Mr. Shirley stated that the buildings would be one-story and would have brick and stone exteriors. Discussion was held regarding the drive access on Turner Road. Mr. Shirley stated that the Turner Road access could be made an gated emergency access. The Planning and Zoning Commission and City Council voiced concerns regarding bringing commercial development into a residential area. Ms. Denise McCloyn, representing "The Hill", opposed the proposed development stating the residents desire to keep the integrity of "The Hill" residential. Mr. Charles Tarrant and Ms. Eliza Brewer, residents of "The Hill" also spoke in opposition of the development. Ms. Lisa Douglas and Ms. Julie Hartman, residents of Silver Lake Addition, had concerned regarding height of the buildings, high traffic and drainage into their neighborhood. Mr. Ronnie Smith, representing the property owner, spoke regarding the history of the property. Mr. Smith stated that development of the property would help the drainage issue and that the property was not considered part of "The Hill". With no further questions, guests to speak, two letters of concern, the public hearing was closed. In the Commissioner's deliberation session after a brief discussion B J Wilson moved to deny zone change requests Z06-16. Danette Murray seconded the motion, which prevailed by the following vote: Ayes: Oliver, Coy, Murray, Wilson, St. John and Lowery Nays: Roy CONDITIONAL USE REQUEST CU06-51 GRAPEVINE DODGE/SERVICE KING Next for the Commission to consider and make recommendation to the City Council was conditional use request CU06-51 submitted by Russell Byrum Signs for property located at 2601 William D Tate Avenue and platted as Lot 1, Block 1, Frank Parra Autoplex Addition. The applicant was requesting a conditional use permit to amend the previously approved site plan of CU03-09 (Ord. 03-26) for an automotive dealership with sales and service of new and used vehicles, specifically to allow the addition of a 20 -foot pole sign for Service King Collision Repair. Mr. Jeff McFadden, Vice -President of Service King, was available for questions and requested favorable consideration of the application. With no further questions, guests to speak, letters nor petitions, the public hearing was 022007 P & Z JOINT PUBLIC HEARING FEBRUARY 20, 2007 closed. In the Commissioner's deliberation session, Chris Coy moved to approve conditional use request CU06-51. Danette Murray seconded the motion, which prevailed by the following vote: Ayes: Oliver, Coy, Murray, Wilson, St. John, Lowery and Roy Nays: None CONDITIONAL USE REQUEST CU06-55 GRAPEVINE MILLS CROSSING Next for the Commission to consider and make recommendation to the City Council was conditional use request CU06-55 submitted by Baldwin Associates for property located at 3500 North Grapevine Mills Boulevard and proposed to be platted as Lots 1- 6, Block A, Grapevine Mills Crossing Addition. The applicant was requesting a conditional use permit to establish a planned commercial center and to allow for two 40 foot pole signs. Mr. Rob Baldwin, the applicant, was available for questions and requested favorable consideration of the application. Discussion was held regarding additional signage on the development. Additional signage will be requested as each phase is developed. With no further questions, guests to speak, letters nor petitions, the public hearing was closed. In the Commissioner's deliberation session, Mark Lowery moved to approve conditional use request CU06-55 with two monument signs and two pylon signs. B J Wilson seconded the motion, which prevailed by the following vote: Ayes: Oliver, Coy, Murray, Wilson, St. John, Lowery and Roy Nays: None FINAL PLAT APPLICATION OF LOTS 1-6 BLOCK A GRAPEVINE MILLS CROSSING Next for the Commission to consider and make a recommendation to the City Council was the Statement of Findings and Final Plat Application of Lots 1-6, Block A, Grapevine Mills Crossing submitted by Baldwin Associates for property located on the south side of Grapevine Mills Boulevard between FM2499 and Highway 121. The applicant was final platting 18.384 acres for a commercial development. In the Commission's deliberation session Chris Coy moved to approve the Statement of Findings and Final Plat Application of Lots 1-6, Block A, Grapevine Mills Crossing. Danette Murray seconded the motion, which prevailed by the following vote: Ayes: Oliver, Coy, Murray, Wilson, St. John, Lowery and Roy Nays: None 022007 5 it � • r r � � ♦ r AM07-01 ZONING ORDINANCE AMENDMENTS TO SECTION 12 DEFINITIONS AND SECTION 49, SPECIAL USE PERMITS RELATIVE TO PUBLIC RAIL STATIONS AND SECTION 60, SIGN REGULATIONS RELATIVE TO REAL ESTATE SIGNAGE Next for the Commission to consider and make recommendation to City Council was zoning ordinance amendment AM07-01 to Section 12, Definitions and Section 49, Special Use Permits relative to public rail stations and Section 60, Sign Regulations relative to real estate signage. With the passing of the recent sales tax initiative to bring The T rail transit system to Grapevine, staff proposed amendments to the Zoning Ordinance relative to rail stations. Section 12, Definitions has been amended by adding a definition of Public Rail Station, and Section 49, Special Use Permits has been amended by adding Public Rail Station Facilities as a Special Use. Staff proposed amendments to the sign ordinance that would require all permits for real estate signs exceeding eight square feet in area to be accompanied by a notarized affidavit stating that the building is less than 100% occupied, excluding common areas. The amendment requires removal of real estate signs when 100% of a building is occupied, excluding common areas. This permit may be renewed annually upon submittal of a renewal fee and a notarized affidavit certifying that the building is less than 100% occupied, excluding common areas. A provision was also made to allow real estate signs to be placed on properties with vacancies to occur within 30 days, again by submitting a notarized affidavit. Staff proposed an exception to allow real estate signs less than eight square feet to be placed without permits. Property owners will be allowed to advertise upcoming vacancies that are more than 30 days from occurring. Properties in our commercial and industrial zoning districts fronting on State Highways 114, 121, 360 and State Highway 26 west of Texan Trail/Ruth Wall Road would be allowed to have larger signs. In the Commissioner's deliberation session, Mark Lowery moved to approve zoning ordinance AM07-01, Becky St. John seconded the motion which prevailed by the following vote: Ayes: Oliver, Coy, Murray, Wilson, St. John, Lowery and Roy Nays: None HEARINGEND OF PUBLIC 022007 1 P & Z JOINT PUBLIC HEARING FEBRUARY 20, 2007 FINAL PLAT APPLICATION OF DRENNAN ADDITION Next for the Commission to consider and make a recommendation to the City Council was the Statement of Findings and Final Plat Application of Lots 1, 2 & 3, Block 1, Drennan Addition submitted by Robert, Bobbie and David Drennan for property located on the south side of the 1500 block of South Gravel Circle. The applicant was final platting 1.15 acres for three existing residences. In the Commission's deliberation session Danette Murray moved to approve the Statement of Findings and Final Plat Application of Lots 1, 2 & 3, Block 1, Drennan Addition. Becky St. John Murray seconded the motion, which prevailed by the following vote: Ayes: Oliver, Coy, Murray, Wilson, St. John, Lowery and Roy Nays: None CONSIDERATION OF MINUTES Next for the Commission to consider were the minutes of the January 16, 2007, Planning and Zoning joint public hearing. Chris Coy moved to approve the Planning and Zoning Commission minutes of January 16, 2007 as written.
