HomeMy WebLinkAboutItem 09 - CU15-12 Enterprise Car and Truck RentalTO: HONORABLE MAYOR, CITY COUNCIL MEMBERS AND THE PLANNING AND ZONING COMMISSION FROM: BRUNO RUMBELOW, CITY MANAGER)6 SCOTT WILLIAMS, DEVELOPMENT SERVICES DIRECTOR MEETING DATE: APRIL 21, 2015 SUBJECT: DEVELOPMENT SERVICES TECHNICAL REPORT OF CONDITIONAL USE APPLICATION CU15-12 ENTERPRISE CAR AND TRUCK RENTAL -c: APPLICANT: AME Engineering PROPERTY LOCATION AND SIZE: The subject property is located at 1800 South Main Street and proposed to be platted as Lot 7R, Block 6, Metroplace Second Installment. The property contains approximately 1.73 acres. The property has approximately 295 feet of frontage along South Main Street. REQUESTED CONDITIONAL USE AND COMMENTS: The applicant is requesting a conditional use permit to amend the previously approved site plan of CU10-19 (Ord. 2010-45) for a planned commercial center, specifically to allow for the development of a car and truck rental facility and expansion of the planned commercial center. The applicant intends to develop a 5,857 square foot car and truck rental facility (Enterprise Car and Truck Rental) on the subject site. Proposed accessory uses include a car and truck wash located at the rear (west) of the proposed facility. Primary access to site is provided by a single driveway on South Main Street. Secondary access is provided by an existing access easement and dual driveway entrances proposed on the west side of the site. Required parking for the proposed use is 38 parking spaces; 47 parking spaces are provided. An eight foot, 45 square foot monument sign is proposed adjacent to South Main Street. Also with this request the applicant proposes to increase the planned commercial center acreage 2.824 acres from 20.686 acres to 23.508 acres. PRESENT ZONING AND USE: The subject property is zoned "CC" Community Commercial District and is vacant. HISTORY OF TRACT AND SURROUNDING AREA: The subject property and surrounding area to the south, east and west were rezoned in the 1984 City Rezoning from "I-1" Industrial to "PID" Planned Industrial Development. The property at the southwest corner of South Main Street and the frontage road of State Highway 114 West was rezoned in 1985 to "CC" Community Commercial to be developed as a high rise office building with a bank. The high rise office building was never constructed. The subject property and the property to the south, east and west was rezoned in 1993 (Z93-04) from "PID" Planned Industrial Development to "CC" Community Commercial. Four lots northwest of the subject property received conditional use permits for the Planned Commercial Center of Metroplace, Second Installment allowing alcoholic beverages sales in conjunction with El Fenix Mexican Restaurant (CU93-16) and Tony Roma's (CU94-12), China Coast (CU94-23) and Olive Garden (94-24) and four (4) forty foot pole signs. Conditional Use Request CU95-19 (Ordinance Number 95-60) was approved to allow alcoholic beverage sales, two (2) forty foot pole signs, and one (1) twenty foot pole sign in conjunction with a restaurant (Joe's Crab Shack). The China Coast Restaurant was never constructed. At the November 18, 1997 meeting Council approved conditional use permit CU97-58 (Ord. 97-144) to allow the addition of an outdoor playground area for Joe's Crab Shack. CU98-70 was approved in December 1998, providing for a 3 -story Holiday Inn Express on Lot 13. CU99-51 and SU99-13 were approved in September 1999 for laser tag arena and a bowling alley on Lot 6R-1. A CU99- 59 (Ord. 99-174) allowing modification of the approved floor plan on the Olive Garden restaurant was approved on December 7, 1999. At the January 18, 2000 meeting City Council approved conditional use permit CU99-99 (Ord 2000-05) for two monument signs and a parking lot layout revision. At the December 21, 2004 meeting Council approved conditional use permit CU04-40 (Ord. 2004-85) for a hotel (Hilton Garden Inn) with alcoholic beverage sales. The Site plan Review Committee on December 21, 2006 approved conditional use permit CU06-60 to allow for elevation changes and reduced overall height of the Hilton Garden Inn. The Site Plan Review Committee at the August 26, 2009 meeting approved conditional use permit (CU09-26) for outdoor speakers at the Hilton Garden Inn. At the August 17, 2010 meeting City Council approved CU10-19 (Ord. 2010-45) to revise the floor plan and elevations of Joe's Crab Shack. Northwest of the subject site at the April 17, 2012 meeting City Council approved CU12-05 (Ord. 2012-15) to allow for a 40 foot pole sign for Grapevine Kawasaki. The property east of South Main Street was rezoned (Z90-04) from "PID" Planned Industrial Development to "CC" Community Commercial. North of State Highway 114 West has been zoned "PO" Professional Office and "HC" Highway Commercial since the 1984 City Rezoning including the Well Fargo Bank, former Grapevine Suzuki dealership, and former Tia's Mexican Restaurant. At the November 21, 1995 meeting Council approved zone change request Z95-16 (Ord. 95-89) and conditional use permit CU95-29 to rezone the current Wells Fargo Bank site from "PO" Professional Office District to "HC" Highway Commercial District and a vehicle display/parking area for the former Payton -Wright auto sales respectively. CU97-44 (Ord. No. 97-100) revised the sign height and sign elevation for Tia's Tex-Mex in September 1997. CU97-49, approved in October 1997, approved a 730 square foot expansion of Macaroni Grill. Conditional Use Request CU02-39 (Ord. 02- 78) was approved by Council at their October 15, 2002 meeting and allowed for changes in the floor plan and building elevation modifications to the former Grady's restaurant that was remodeled for and converted into a P.F. Changs restaurant. A conditional use permit (CU04-17) for a 30 -foot pole sign was approved on this site at the May 18, 2004 meeting. A conditional use permit CU06-40 (Ord. 2006-75) for the expansion of the dealership to the vacant lot plus a pre -owned vehicle sales building was approved at the October 17, 2006 meeting. At the January 17, 2007 meeting, Council approved a conditional use permit CU06-64 (Ord. 2007-03) to allow for an expanded operation including a vehicle trade-in holding area and defer construction of a previously approved pre -owned vehicle sales office building. At the June 19, 2007 meeting, Council approved a conditional use permit CU07-12 (Ord. 2007-32) to allow a new restaurant (Red's Patio Grill) into the former Tia's restaurant site. The intent was to subdivide the restaurant for two tenants with Red's occupying 5,646 square feet with a seating capacity of 223 seats. The remaining 2,823 square feet of the Tia's building would accommodate a future restaurant yet to be named. The proposal never moved beyond the initial planning stages. At the March 16, 2010 meeting Council approved a conditional use permit CU10-03 (Ord. 2010-10) for a 10,565 square foot Pappadeaux Seafood Kitchen on the former Tia's Tex-Mex restaurant that will be demolished to make way for the new restaurant. Additional acreage (approximately one acre) was absorbed into the site from the adjacent former Grapevine Suzuki property to enlarge the site to accommodate the larger structure and to provide adequate parking. A new 40 -foot pole sign was also approved as part of the request. East of the subject site, at the December 17, 2013 meeting City Council approved CU13-31 (Ord. 3013-58) to allow for the development of an indoor shooting range. The City Council directed the Site Plan Review Committee to review the proposed exterior elevations and on January 8, 2014 the Site Plan Review Committee approved revised elevations for the proposed gun range. At the March 18, 2014 meeting City Council approved CU14-07 (Or. 2014-15) to allow an increase in height of the indoor shooting range for office space. SURROUNDING ZONING AND EXISTING LAND USE: NORTH: "CC" Community Commercial District — Joe's Crab Shack SOUTH: "CC" Community Commercial District — vacant and Stacy Furniture 3 EAST: "CC" Community Commercial District - Salt Grass Steak House, Schlotzsky's Deli, NTB Tire and Battery, Super 8 Motel WEST: "CC" Community Commercial District — Hilton Garden Inn The subject tract is located within "Zone A" zone of minimal effect as defined on the "Aircraft Sound Exposure: Dallas Fort Worth Regional Airport Environs" map. Few activities will be affected by aircraft sounds in Zone A except for sound sensitive activities such as auditoriums, churches, schools, hospitals, and theaters. The applicant's proposal is an appropriate use in this noise zone. AJW5Xr07A1JK The Master Plan designates the subject property as Commercial land use. The existing use is in compliance with the Master Plan. I have read and understand all of the requirements as set forth by the application !r4IIA Date:S- I T r - tWOTWWA I Jm(P�9FHVgm MAR 12 2015 ORDINANCE N• WHEREAS, an application was made requesting issuance of a conditional use permit by making applications for same with the Planning and Zoning Commission of the City of Grapevine, Texas, as required by State statutes and the zoning ordinance of the City of Grapevine, Texas, and all the legal requirements, conditions and prerequisites having been complied with, the case having come before the City Council of the City of Grapevine, Texas, after all legal notices requirements, conditions and prerequisites having been complied with; and WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing called by the City Council did consider the following factors in making a determination as to whether this requested conditional use permit should be granted or denied: safety of the motoring public and the pedestrians using the facilities in the area immediately surrounding the site; safety from fire hazards and measures for fire control; protection of adjacent property from flood or water damages, noise producing elements, and glare of the vehicular and stationary lights and effect of such lights on established character of the neighborhood; location, lighting, and types of signs and relation of signs to traffic control and adjacent property; street size and adequacy of width for traffic reasonably expected to be generated by the proposed use around the site and in the immediate neighborhood; adequacy of parking as determined by requirements of this ordinance for off-street parking facilities; location of ingress and egress points for parking and off-street locating spaces, and protection of public health by surfacing on all parking areas to control dust; effect on the promotion of health and the general welfare; effect on light and air; the effect on the overcrowding of the land; the effect on the concentration of population; the effect on the transportation, water, sewerage, schools, parks and other facilities; and WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing called by the City Council of the City of Grapevine, Texas, did consider the following factors in making a determination as to whether this requested conditional use permit should be granted or denied; effect on the congestion of the streets, the fire hazards, panics and other dangers possibly present in the securing of safety from same, the effect on the promotion of health and the general welfare, effect on adequate light and air, the effect on the overcrowding of the land, the effect on the concentration of population, the effect on the transportation, water, sewerage, schools, parks and other public facilities; and WHEREAS, all of the requirements of Section 48 of Ordinance No. 82-73 have been satisfied by the submission of evidence at a public hearing; and WHEREAS, the City Council further considered among other things the character of the existing zoning district and its peculiar suitability for particular uses and with the view to conserve the value of buildings and encourage the most appropriate use of land throughout this City; and WHEREAS, the City Council of the City of Grapevine, Texas, does find that there is a public necessity for the granting of this conditional use permit, that the public demands it, that the public interest clearly requires the amendment, that the zoning changes do not unreasonably invade the rights of those who bought or improved property with reference to the classification which existed at the time their original investment was made; and WHEREAS, the City Council of the City of Grapevine, Texas, does find that the conditional use permit lessens the congestion in the streets, helps secure safety from fire, panic and other dangers, prevents the overcrowding of land, avoids undue concentration of population, facilitates the adequate provisions of transportation, water, sewerage, schools, parks and other public requirements; and WHEREAS, the City Council of the City of Grapevine, Texas, has determined that there is a necessity and need for this conditional use permit and has also found and determined that there has been a change in the conditions of the property surrounding and in close proximity to the property requested for a change since this property was originally classified and, therefore, feels that the issuance of this conditional use permit for the particular piece of property is needed, is called for, and is in the best interest of the public at large, the citizens of the City of Grapevine, Texas, and helps promote the general health, safety and welfare of this community. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: ORD. NO. 2 Section 1. That the City does hereby issue a conditional use permit in accordance with Section 48 of Ordinance No. 82-73, the Comprehensive Zoning Ordinance of the City of Grapevine, Texas, same being also known as Appendix "D" of the City Code, by granting Conditional Use Permit CU 15-12 to amend the previously approved site plan of CU10-19 (Ordinance No. 2010-45), as amended, specifically to expand the planned commercial center and to allow a car and truck rental facility (Enterprise Car and Truck Rental) in a district zoned "CC" Community Commercial District Regulations within the following described property: Lot 7R, Block 6, Metroplace Addition 2nd Installment (1800 South Main Street) all in accordance with a site plan approved pursuant to Section 47 of Ordinance No. 82-73, attached hereto and made a part hereof as Exhibit "A", and all other conditions, restrictions, and safeguards imposed herein, including but not limited to the following: None. Section 2. That the City Manager is hereby directed to amend the official zoning map of the City of Grapevine, Texas, to reflect the herein conditional use permit. Section 3. That in all other respects the use of the tract or tracts of land herein above described shall be subject to all the applicable regulations contained in said City of Grapevine zoning ordinance and all other applicable and pertinent ordinances of the City of Grapevine, Texas. Section 4. That the zoning regulations and districts as herein established have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the general welfare of the community. They have been designed with respect to both present conditions and the conditions reasonably anticipated to exist in the foreseeable future; to lessen congestion in the streets; to secure safely from fire, panic, flood and other dangers; provide adequate light and air; to prevent overcrowding of land, to avoid undue concentration of population; facilitate the adequate provisions of transportation, water, sewerage, drainage and surface water, parks and other public requirements, and to make adequate provisions for the normal business, commercial needs and development of the community. They have been made with reasonable consideration, among other things, of the character of the district, and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. Section 5. That this ordinance shall be cumulative of all other ordinances of the City of Grapevine, Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances which are in direct conflict with the provisions of this ordinance. Section 6. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of land described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the tract or tracts of land described herein. That any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Thousand Dollars ($2,000.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 8. That the fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its final passage, and it is accordingly so ordained. A. - Standard for new subdivisions. In addition to those requirements for subdivisions found in Appendix B of the Code of Ordinances, City of Grapevine, Texas, all applicants for subdivision of land shall submit to the director of public works an erosion and sedimentation control plan for approval prior to the commencement of construction. The erosion and sedimentation control plan shall be included in the engineering construction plans. No construction may commence until such time that the erosion and sedimentation control plan has been reviewed and approved by the department of public works. (Ord. No. 87-45, § l(Art. IV, §A), 84-87) Sec. B. - Erosion andim n i sed a tat on control plan. (a) The objective of the erosion and sedimentation control plan is to prevent public erosion nuisances (see Article II, section B). The prevention of public erosion nuisances can be promoted, in part, by the following goals: (1) Reduce sedimentation in streams, creeks, lakes, waterways, storm drains, etc. (2) Protect the quality of the water in the City of Grapevine. (3) Provide, protect and preserve wildlife habitat. (4) Provide for restoration of sites to reduce the negative environmental impacts of construction activity. (b) The following considerations, at a minimum, should be addressed in any erosion and sedimentation control plan submitted to the director of public works: (1) Limit the size of disturbed areas to the greatest extent possible. (2) Stabilize any disturbed area as soon as possible. (3) For construction activities in waterways, the following additional requirements must be met: a. At the end of each work day, the contractor shall remove all loose excavated material from all water channels. b. No construction or fill materials can be stored within the limits of the channel. All equipment and materials storage and staging areas must have erosion controls. c. Rack berms or sand bag berms shall be used to entrap sediment. d. Flooding potential should be considered when locating the control measures. (4) Controls are required to intercept silt from all disturbed areas. (5) Keep the velocities of stormwater runoff below the erosive level. (6) Protect steep areas and areas disturbed by development activity from upstream runoff. (7) Capture and filter/detain stormwater runoff. (8) Minimize the extent of sediment leaving the project site. (9) Reduce flooding hazards and silt removal cost associated with excessive sediment accumulation in storm drains and waterways. (10) Reduce the concentration of stormwater runoff and promote sheet flow to the greatest extent possible. (11) Revegetate all disturbed areas with a rapid, vigorous growth of long-term vegetation composed of a mixture of grasses, (orbs and woody plants. (12) Provide sedimentation and/or filtration ponds to maintain and improve water quality. (13) Erosion control plans should be phased to accommodate changes in drainage patterns that occur during development. (14) Reduce the silt leaving a construction site on the wheels of construction vehicles by providing vehicle washing areas and/or stabilized construction entrances and exits. (15) Preserve and protect existing vegetation to the greatest extent possible. (16) Planning should consider the natural topography and soil conditions in an attempt to limit the erosion potential. (17) Design erosion/sedimentation controls to harmonize with the natural character of the land. (18) When storm drain inlets must be protected, a perimeter filtration dike shall be used (triangular filtration dike or hay bale dike). (c) The above4isted considerations are illustrative only and are not to be considered an exhaustive list of the criteria an effective erosion and sedimentation control plan should address in order to prevent a public erosion nuisance. It shall be the sole responsibility of the applicant to prepare and submit an erosion and sedimentation control plan. (Ord. No. 8745, § 1(Art. IV, § B), 8-487) Sec. C. - Effect of approval. (a) It is to be understood that the approval of an erosion and sedimentation control plan by the department of public works does not constitute a recognition by the city that the erosion and sedimentation control plan will prevent any, or all, public erosion nuisances. By approval of the erosion and sedimentation control plan, the city does not warrant that the erosion and sedimentation control plan will be sufficient to prevent a public erosion nuisance, and the city waives no rights to pursue any legal remedies, both under this ordinance and all other applicable ordinances and laws. (b) If for any reason, after an erosion and sedimentation control plan is approved by the department of public works, a public erosion nuisance occurs on property addressed by said erosion and sedimentation control plan, the approval of said erosion and sedimentation control plan shall not be a defense or bar to prosecution under this ordinance. (Ord. No. 87-45, § I (An.. IV, § Q, 8-487) Sec. D. - Warning and disclaimer of liability. The planning considerations given in this ordinance for erosion controls rely on a degree of erosion and sedimentation control and flood protection that is considered reasonable for regulatory purposes and that is based on scientific, engineering and economic considerations. This ordinance does not imply that erosion and sedimentation controls will survive inundation by runoff from storms or that land below such controls will be free from flooding or flood damages. This ordinance shall not create liability on the part of the City of Grapevine, or any officer or employee thereof, for any flood damages or erosion or sedimentation damages, whether to persons or property, that result from reliance on this ordinance or any administrative decision lawfully made thereunder. (Ord. No. 8745, § 1(Art. IV, §O), 8-487) Sec. E. - Surety for permanent erosion controls in new subdivisions. (a) The applicant shall provide a suretyin the form of cash, certificate of deposit, surety bond or irrevocable letter of credit acceptable to the city to ensure that vegetative cover and other permanent erosion control measures are installed, maintained and functioning properly at the end of a two-year period from the date offinal acceptance of the dedicated streets and/or utilities by the City of Grapevine. This surety shall be given to the city before the final acceptance of the streets and/or utilities. This surety shall be in the amount estimated by the developer, which is 100 percent of the cost of constructing and maintaining the permanent erosion controls for atwo-year period. However, such estimate is subject to review by the director of public works and may be rejected, and the surety not accepted, if the director of public works deems the estimate not to be a reasonable approximation of the costs of constructing and maintaining the erosion controls. (b) Should the vegetative cover die or become sparse or the erosion controls fail to be maintained or are not functioning during this two-year period, the city may notify applicant in writing. The applicant has ten days after being notified to begin correcting the problems. If no corrections are started, the city may make the necessary repairs by exercising the surety or billing the applicant. If at the end of the two-year period the vegetative cover is still not established or is sparse, or the erosion controls are not functioning, the city may exercise the surety and have the erosion controls installed and established. (c) The above procedures for ensuring that vegetation is established shall apply to all projects, whether or not the vegetation is the long-term maintenance responsibility of the city. Any vegetative cover which Is planted and is a permanent part of the improvement project will not be accepted by the city until the growth has been established and maintained by the developer for a two-year period from the date offinal acceptance ofthe subdivision. - (d) After the two-year period has elapsed, the owner of the property shall be responsible for maintaining the erosion controls in good working order. If any future owner modifies or disturbs the erosion controls for the area, that owner must restore or replace the permanent erosion controls at the conclusion of the disturbing activity. (Ord. All development, improvement and construction on any land which is in violation of the provisions of this ordinance may be halted and stopped by order of the director of public works.
