MEETING DATE: MARCH 1, 2011 SUBJECT: APPROVAL TO ESTABLISH A SOLE SOURCE CONTRACT FOR THE PURCHASE OF BASEBALL FIELD MATERIAL RECOMMENDATION: City Council to consider establishing an annual contract to MasterTurf Products and Services, Inc. and consider them a sole source provider for infield soil turf mixture and conditioner that establishes fixed annual pricing. Total annual expenditures will not exceed the budgeted amount of $30,000. FUNDING SOURCE: Funds are available in account 100 -43355 -312 -3 General Fund /Recreation Facilities Maintenance /Parks Maintenance. BACKGROUND: This procurement will be made as a sole source in accordance with Local Government Code Chapter 252, Subchapter B, Section 252.022 (A) (7) (A). This request is to establish fixed annual pricing for the purchase of infield soil turf mixture and conditioner at the City baseball fields. The MasterSeal products recommended was tested on baseball fields in 2007108. The product material tested very well and as a result all fields were not closed at any time during the spring and summer rains. The material will be ordered on an as- needed basis to recondition the baseball and softball fields and replace the infield material. MasterTurf Products and Services, Inc. is the sole provider of the MasterSeal Products and this product cannot be purchased through competitive bidding. Attached is the company's sole source letter. If approved this will establish fixed annual pricing for one, 12 -month term, with four optional 12 -month renewals. This contract period would be for the initial 12 month term. MasterTurf Products and Services, Inc. provided this service in the past with satisfactory results and is willing to contract for another year with no increase in the current pricing. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, AUTHORIZING THE CITY MANAGER OR THE CITY MANAGER'S DESIGNEE TO DECLARE MASTERTURF PRODUCTS AND SERVICES INC A SOLE SOURCE PROVIDER FOR MASTERSEAL PRODUCTS AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City of Grapevine, Texas is a local government in the State of Texas and as such is empowered by the Texas Local Government Code Chapter 252, Subchapter B, Section 252.022 (a) (7) (A) to consider items available from only one source as an exception to the bidding requirements of the State of Texas; and WHEREAS, Masterturf Products and Services Inc is the sole distributor of MasterSeal Products; and WHEREAS, the City of Grapevine, Texas has tested MasterSeal products against other products and have used MasterSeal products on their baseball and softball fields since 2007 resulting in a higher quality of surface that allows in a continuation of usage. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated in the above preamble are true and correct and are incorporated herein as if copied in their entirety. Section 2. That the City Manager, or his designee, is authorized to take all steps necessary to establish an annual contact with Masterturf Products and Services Inc in the total annual amount of $30,000.00.
