HomeMy WebLinkAboutRES 2009-011 RESOLUTION NO. 2009-11 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS CANCELLING THE MAY 9, 2009 REGULAR CITY OFFICER ELECTION AND DECLARING EACH UNOPPOSED CANDIDATE ELECTED TO OFFICE; REPEALING INCONSISTENT RESOLUTIONS AND PROVIDING AN EFFECTIVE DATE WHEREAS, in accordance with the Texas Election Code, the Grapevine City Council adopted Resolution No. 2009-04 on February 3, 2009 ordering an election to be held on May 9, 2009 for the purpose of electing the Mayor, Council Members Place 1 and Place 2 to serve on the City Council in the City of Grapevine; and WHEREAS, no proposition is to appear on the ballot in that election; and WHEREAS, the filing deadlines for placement on the ballot and declaration of write-in candidacy has passed; and WHEREAS, the City Secretary has certified in writing that each candidate on the ballot is unopposed for election to office; and WHEREAS, in these circumstances Subchapter C of Chapter 2 of the Election Code authorizes a governing body to declare each unopposed candidate elected to office and cancel the election. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated in the preamble are true and correct as if copied herein in their entirety. Section 2. That the following candidates, who are unopposed in the May 9, 2009 City Officer Election are hereby declared elected to office, and shall be issued a certificate of election after election day, in accordance with the Texas Election Code: Mayor William D. Tate City Council Place 1 C. Shane Wilbanks City Council Place 2 Sharron Spencer Section 3. That the City Secretary is directed to post a copy of this resolution at each designated polling place on May 9, 2009. Section 4. That this resolution shall repeal every prior resolution in conflict herewith, but only insofar as the portion of such resolution shall be in conflict, and as to all other sections of resolutions not in direct conflict herewith, this resolution shall be and is hereby made cumulative. Section 5. That this resolution shall take effect from and after the date of its passage. PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS on this the 24th day of March, 2009.
