Tate Avenue and is platted as Lot 6, Block 1, The Crossroads of DFW Addition. The site contains 51,423 square feet and has approximately 242 feet of frontage along William D. Tate Avenue and 377 feet of frontage along Crossroads Drive. REQUESTED CONDITIONAL USE AND COMMENTS: The applicant is requesting a conditional use permit to amend the previously approved site Nan of CU04 -18 (Ord. 04 -36) for a planned commercial center with the possession, storage, retail sales, and on- premise consumption of alcoholic beverages _(_beer, wine, and mixed beverages) in conjunction with a restaurant, specifically to revise the floor plan and exterior elevations. The applicant intends to remodel the existing 6,603 - square foot restaurant by modifying the existing entry feature, remove most of the windows in the outdoor dining area, replacing them with two garage type doors and minor modifications to the floor plan and seating configurations. The restaurant will seat a total of 246 patrons -208 seats inside and 38 seats in an outdoor patio area requiring 82 parking spaces; 82 are provided. O:1ZMC U 11 -03.4 1 3:19 PM 03/09/11 PRESENT ZONING AND USE: The property is currently zoned "CC" Community Commercial District with a planned commercial center designation. The subject property is developed as Buffalo Wild Wings. HISTORY OF TRACT AND SURROUNDING AREA: The subject and surrounding property was zoned "1 -1" Light Industrial District prior to the 1984 City Rezoning. The subject property was rezoned from "GU" Governmental Use District and "PID" Planned Industrial Development District to "CC" Community Commercial District with a master site plan for a Planned Commercial Center in conjunction with an Outback Steakhouse (Z92 -04 and CU92 -14). TGI Fridays amended the approved site plan (CU92 -20) at the December 15, 1992 joint public hearing and developed a restaurant with on- premise consumption of alcoholic beverages and a 40 -foot pole sign. California Pizza Kitchen was approved at the January 18, 1994 joint public hearing (CU93 -14) which also allowed for a restaurant with on- premise consumption of alcoholic beverages and a 40 -foot pole sign.. CU94 -03 was approved by Council on March 22,1994 and allowed TGI Fridays to consolidate two smoking areas into one area with an approved floor plan. CU94 -10 was approved by Council on May 17, 1994 and allowed for the development of a Don Pablos Restaurant with on- premise consumption of alcoholic beverages and a 40 -foot pole sign. CU94 -11 was also approved at the May 17, 1994 joint public hearing which established a Boston Chicken Restaurant with a 40 -foot pole sign within the planned commercial center. CU94 -25 and CU94 -26 were heard and approved at the September 20, 1994 joint public hearing — CU94 -25 established a Red Robin Restaurant with on- premise consumption of alcoholic beverages and CU94 =26 allowed changes to the floor plan for Don Pablo's restaurant. CU94 -36 was approved at the December 20, 1994 joint public hearing and allowed for additional wall signage for the California Pizza Kitchen. CU95 -07 established Denny's Restaurant with a 40 -foot pole sign and was approved at the May 16, 1995 joint public hearing. CU95 -18 was approved at the August 15, 1995 joint public hearing which allowed for a 40 -foot pole sign and a 20 foot pole sign for Red Robin Restaurant. CU98 -08 was approved on April 21, 1998 at the joint public hearing, which allowed for a 781 square foot expansion to the existing restaurant. CU98 -29 was approved in July 1998, approving a revision to the floor plan of TGI Friday's Restaurant. The Site Plan Review Committee approved CU01 -61 in October 2001 allowing interior and exterior renovations to TGI Friday's. The work was not started and the conditional use permit expired. At the May 20, 2003 Council approved a Conditional Use Permit (CU03 -12) to modify the floor plan and exterior elevations for TGI Friday's. Conditional Use Request CU04 -18 was approved by Council at the May 18, 2004 meeting which allowed for on- premise alcohol beverages sales in conjunction with a restaurant (Buffalo Wild Wings) at the northeast corner of Crossroads Drive and William D. Tate Avenue. Conditional Use Request (CU04 -36) and Special Use (SU04 -03) were approved by City Council at the October 19, 2004 meeting which allowed for on- premise alcohol beverages sales and consumption and one pool table in conjunction with a restaurant (Boston's The Pizza Gourmet). The Site Plan Review Committee approved CU05 -34 on May 25, 2005 allowed a 159 - square foot, 40 -foot pole 0AWL1=11 -03.4 2 6:34 PM 03/06/11 sign for Buffalo Wild Wings. The Site Plan Review Committee approved CU06 -43 on September 28, 2006 allowing a 603 square foot outdoor dining area for Buffalo Wild Wings. The Site Plan Review Committee approved CU06 -57 on December 21, 2006 allowing a patio cover for Buffalo Wild Wings. A Conditional Use Request (CU09 -01) and Special Use Request (SU09 -0 1) was considered and denied by Council at their February 17, 2009 meeting in which the applicant requested to add outside dining, a new 40 -foot pole sign and one billiard table to the former TGI Friday's for a new restaurant concept called the Tilted Kilt. Conditional Use Request CU10 -20 was approved by Council at the September 21., 2010 meeting which allowed for on- premise alcohol beverages sales, outside. dining, outdoor speakers and two pole signs in conjunction with a restaurant (Plucker's Wing Bar) within the former Pablo's[Fio ,toe's building on Crossroads Drive. To the west, Classic Chevrolet has be granted numerous conditional use permits (CU91- 01, CU92 -01, CU92 -16, CU94 =02) for a car dealership with automobile repair, 40 -foot pole signs, a used car showroom with eight service bays, parts storage, sales offices and a customer lounge area. CU95 -15 was approved by Council on June 20, 1995 and allowed Classic Chevrolet a 6.354 acre expansion to develop a paint and body shop, a used car sales building, with display and inventory parking. CU96 -31 was approved by Council on November 19, 1996 and allowed for an additional pole sign and the revision of sign copy on another. The City Council approved CU98 -71 in January, 1999 permitting the installation of shade structures over the display parking area. The Site Plan Review Committee approved CU07 -06 on February 28, 2007 permitting the installation of a 32 -foot aluminum arched entry feature to the existing main showroom and additional wall signage. The Site Plan Review Committee approved CU09 -25 on July 22, 200 for a 600 square foot warranty office addition. Conditional Use Request CU1Q -33 was approved by Council at the January 5, 2010 meeting which allowed for a new non - public tunnel type car wash. The Hayley Addition to the north, another planned commercial center also has numerous conditional use permits for restaurants with on- premise alcoholic beverage sales, 40 -foot pole signs, several retail stores, 40 -foot pole signs and numerous conditional use permits for restaurants with on- premise alcoholic beverage sales including Uncle Julio's which the City Council approved CU06 -08 on April 18, 2008 on the site of a former movie theatre. SURROUNDING ZONING AND EXISTING LAND USE: NORTH: "HC" Highway Commercial District - La Madeleine, Chili's Grill and Bar, Romano's Macaroni Grill and P.F. Chang's Chinese Bistro SOUTH: "CC" Community Commercial District— Boston's Pizza, Pluckers Wing Bar, Red Robin and Hooter's. EAST: "CC" Community Commercial - Outback Steakhouse, Tilted Kilt, California Pizza Kitchen, and Original Pancake House 0:1ZCUkCW 1 -03.4 3 6:34 PM 03/06/11 WEST: "CC" Community Commercial District - Classic Chevrolet AIRPORT IMPACT: The subject tract is located within "Zone B" Middle Zone of Effect as defined on the "Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" map. In Zone B, the following uses may be considered only if sound treatment is included in building design: multi family apartments, motels, office buildings, movie theaters, restaurants, and personal and business services. Single family residential and sound sensitive uses such as schools and churches should avoid this zone. The applicant's proposal is an appropriate use in this noise zone. A portion of the planned commercial center at the southwest comer is located within "Zone C" zone of greatest effect as defined on the "Aircraft Sound Exposure: Dallas /Fort Worth Regional Airport Environs" map. In Zone C, industrial and commercial uses that can tolerate a high level of sound exposure are appropriate. The applicant's proposal is an appropriate use in this noise zone. MASTER PLAN APPLICATION: The Master Plan designates the subject property as a Commercial land use. This an existing Buffalo Wild Wings restaurant that is being updated to provide the patron a more enjoyable experience on the service and aesthetic end of things, as well as to accommodate the new Buffalo Wild Wings corporate tradedress on interior and exterior. That scope of work includes the following: Exterior- Interior- • Removal of surface mounted architectural moldings from existing front fagade. Removal of this trim accommodates aluminum pre - finished composite metal covered soffit to be added. • Buffalo Wild Wings tradedress colors to be applied via building's existing finishes being painted. Existing eifs is to be repaired /patched as necessary and existing brick finish to remain un- touched. • New awning lights are to be added over existing awnings. • New trough up- lights are to be installed around new soffit to .highlight re finished entry feature. AN ORDINANCE ISSUING A CONDITIONAL USE PERMIT IN ACCORDANCE WITH SECTION 48 OF ORDINANCE NO 82 =73, THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF GRAPEVINE, TEXAS, SAME BEING ALSO KNOWN AS APPENDIX "D" OF THE CITY CODE, BY GRANTING CONDITIONAL USE PERMIT CU11 -03 AMENDING THE SITE PLAN APPROVED BY ORDINANCE NO: 2004 -36 TO REVISE THE FLOOR PLAN AND EXTERIOR ELEVATIONS OF A RESTAURANT IN A DISTRICT ZONED "CC" COMMUNITY COMMERCIAL DISTRICT REGULATIONS ALL IN ACCORDANCE WITH A SITE PLAN APPROVED PURSUANT TO SECTION 47 OF ORDINANCE NO. 82 -73 AND ALL OTHER CONDITIONS, RESTRICTIONS AND SAFEGUARDS IMPOSED HEREIN; adequacy of parking as determined by requirements of this ordinance for off- street parking facilities; location of ingress and egress points for parking and off - street locating spaces, and protection of public health by surfacing on all parking areas to control dust; effect on the promotion of health and the general welfare; effect on light and air; the effect on the overcrowding of the land; the effect on the concentration of population; the effect on the transportation, water, sewerage, schools, parks and other facilities; and WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing called by the City Council of the City of Grapevine, Texas, did considerthe following factors in making a determination as to whether this requested conditional use permit should be granted or denied; effect on the congestion of the streets, the fire hazards, panics and other dangers possibly present in the securing of safety from same, the effect on the promotion of health and the general welfare, effect on adequate light and air, the effect on the overcrowding of the land, the effect on the concentration of population, the effect on the transportation, water, sewerage, schools, parks and other public facilities; and WHEREAS, all of the requirements of Section 48 of Ordinance No. 82 -73 have been satisfied by the submission of evidence at a public hearing; and WHEREAS, the City Council further considered among otherthingsthe characterof the existing zoning district and its peculiar suitability for particular uses and with the view to conserve the value of buildings and encourage the most appropriate use of land throughout this City; and WHEREAS, the City Council of the City of Grapevine, Texas, does find that there is a public necessity for the granting of this conditional use permit, that the public demands it, that the public interest clearly requires the amendment, that the zoning changes do not unreasonably invade the rights of those who bought or improved property with reference to the classification which existed at the time their original investment was made; and WHEREAS, the City Council of the City of Grapevine, Texas, does find that the conditional use permit lessens the congestion in the streets, helps secure safety from fire, panic and other dangers, prevents the overcrowding of land, avoids undue concentration of population, facilitates the adequate provisions of transportation, water, sewerage, schools, parks and other public requirements; and WHEREAS, the City Council of the City of Grapevine, Texas, has determined that there is a necessity and need for this conditional use permit and has also found and determined that there has been a change in the conditions of the property surrounding and in close proximity to the property requested for a change since this property was originally classified and, therefore, feels that the issuance of this conditional use permit for the particular piece of property is needed, is called for, an is in the best interest of the public at large, the citizens of the City of Grapevine, Texas, and helps promote the general health, safety and welfare of this community. ORD. NO. 2 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That the City does hereby issue a conditional use permit in accordance with Section 48 of Ordinance No. 82 -73, the Comprehensive Zoning Ordinance of the City of Grapevine, Texas, same being also known as Appendix "D" of the City Code, by granting Conditional Use Permit CU11 -a3 amending the site plan approved by Ordinance No. 2004 -36 for a planned commercial center with the possession, storage, retail sale, and on- premise consumption of alcoholic beverages (beer, wine, and mixed beverages), specifically to revise the floor plan and exterior elevations in conjunction with a restaurant (Buffalo Wild Wings) in a district zoned "CC" Community Commercial District Regulations within the following described property: Lot 6, Block 1, Crossroads at DFW (1525 William D. Tate Avenue) all in accordance with a site plan approved pursuant to Section 47 of Ordinance No. 82 -73, attached hereto and made a part hereof as Exhibit "A and all other conditions, restrictions, and safeguards imposed herein, including but not limited to the following: None. Section 2. That the City Manager is hereby directed to amend the official zoning map of the City of Grapevine, Texas, to reflect the herein conditional use permit. Section 3. That in all other respects the use of the tract or tracts of land herein above described shall be subject to all the applicable regulations contained in said City of Grapevine zoning ordinance and all other applicable and pertinent ordinances of the City of Grapevine, Texas. Section 4. That the zoning regulations and districts as herein established have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the general welfare of the community. They have been designed with respect to both present conditions and the conditions reasonably anticipated to exist in the foreseeable future; to lessen congestion in the streets; to secure safely from fire, panic, flood and other dangers; provide adequate light and air; to prevent overcrowding of land, to avoid undue concentration of population; facilitate the adequate provisions of transportation, water, sewerage, drainage and surface water, parks and other public. requirements, and to make adequate provisions forthe normal business, commercial needs and development of the community. They have been made with reasonable consideration, among other things, of the character of the district, and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. Section 5. That this ordinance shall be cumulative of all other ordinances of the City of Grapevine, Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances which are in direct conflict with the provisions of this ordinance. Section 6. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of ORD. NO. 3 land described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the tract or tracts of land described herein. Section 7. That any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Thousand Dollars ($2,000.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 8.
