CHAIRMAN ATTEST: SECRETARY NOTE: Planning and Zoning Commission continued with the Joint Public Hearing 071707 VA P & Z JOINT PUBLIC HEARING JULY 17, 2007 STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Planning and Zoning Commission of the City of Grapevine, Texas met in Joint Public Hearing with the City Council, on this the 19th day of June 2007, in the City Council Chambers, 200 South Main Street, 2nd Floor, Grapevine, Texas with the following members present -to -wit: Larry Oliver Chairman Chris Coy Member Danette Murray Member B J Wilson Member Rob Undersander Member Becky St. John Member Mark Lowery Alternate Constituting a quorum with Vice -Chairman, Herb Fry absent and the following City Staff: Scott Williams Ron Stombaugh Albert Triplett Connie Cook CALL TO ORDER Development Services Director Planning and Development Manager Planner II Development Services Assistant Mayor Pro Tem Ware called the joint meeting to order at 7:31 p.m. and Chairman Oliver called the Planning and Zoning Commission deliberation session to order at 8:35 p.m. INVOCATION Commissioner Chris Coy delivered the Invocation. JOINT PUBLIC HEARINGS ZONE CHANGE REQUESTS Z07-09 & CONDITIONAL USE APPLICATION CU07-09, LEGACYTEXAS BANK First for the Commission to consider and make a recommendation to the City Council was zoning change application Z07-09 and conditional use application CU07-17, submitted by Legacy Texas Bank for property located at 750 West Dallas Road and platted as Lot 1 R1 A, Block 1R, Lipscomb and Daniel Addition. The applicant was requesting to rezone 0.918 acres from "LI" Light Industrial District to "CC" Community Commercial District and a conditional use permit allowing a drive through banking facility. 071707 3 P & Z JOINT PUBLIC HEARING JULY 17, 2007 Mr. Troy Elias, representing Legacy Texas Bank, was available for questions and requested favorable consideration of the applications. With no further questions, guests to speak, one letter of support, the public hearing closed. In the Commissioner's deliberation session after a brief discussion B J Wilson moved to approve the zoning change application Z07-09 and conditional use application CU07- 17. Chris Coy seconded the motion, which prevailed by the following vote: Ayes: Oliver, Coy, Murray, Wilson, St. John and Lowery Nays: Undersander CONDITIONAL USE PERMIT CU07-15 BAYLOR HOSPITAL Next for the Commission to consider and make recommendation to the City Council was conditional use application CU07-15 submitted by HDR Architecture, Inc. for property located at 1650 & 1680 West College Street and platted as Lot 1A, Block A, Grapevine Medical Center at Grapevine. The applicant was requesting a conditional use permit to amend the previously approved site plan of CU01-26 (Ord. 01-48) for a hospital specifically to allow a two story, 32,000 square foot addition to the south tower and the development of a new central utility plant. Ms. Bonnie Grigsby, project manager for C.B. Richard Ellis, was available for questions and requested favorable consideration of the application. Discussion was held regarding the impact of the new utility plant in relation to losing parking spaces, and whether or not the existing utility plant would be demolished. Mr. Darius Sheriff, project manager with HDR Architecture, stated that only ten parking spaces would be affected and that even with those removed they still would meet parking requirements. The Council and Commission had concerns regarding lack of current parking spaces and the impact the addition would have on the site. Ms. Grigsby stated that there were future plans for a 180 space parking lot to the west of the existing emergency department, south of the proposed utility plant to be submitted within the next six months. With no further questions, guests to speak, nor letters or petitions, the public hearing was not closed. In the Commissioner's deliberation session the Commission discussed the need for additional parking on the site which could be a factor when considering future amendments to the site plan for the hospital. Chris Coy moved to approve conditional use application CU07-15, expressing concern with the existing utility plant and the 071707 51 P & Z JOINT PUBLIC HEARING JULY 17, 2007 intentions for it in the future. Mark Lowery seconded the motion, which prevailed by the following vote: Ayes: Oliver, Coy, Murray, Wilson, Undersander, St. John and Lowery Nays: None HISTORIC LANDMARK APPLICATION HL07-01 JOHNSON -MARTIN HOUSE Next for the Commission to consider and make recommendation to the City Council was historic landmark application HL07-01 submitted by Wanda F Howard for property located at 614 Estill Street and platted as Lot 3, Block 103, College Heights Addition. The applicant was requesting designation as a historical landmark sub -district. Such sub -district may include buildings, land, areas, or districts or historical, architectural, archaeological or cultural importance or value that merit protection, enhancement, and preservation in the interest of the culture, prosperity, education, and welfare of the people. Mr. Skip Blake, representing applicant Wanda Howard, was available for questions and requested favorable consideration of the application. With no further questions, guests to speak, two letters of support, one of no opinion, the public hearing was closed. In the Commissioner's deliberation session, B J Wilson moved to approve historic landmark application HL07-01. Danette Murray seconded the motion, which prevailed by the following vote: Ayes: Oliver, Coy, Murray, Wilson, Undersander, St. John and Lowery Nays: None HISTORIC LANDMARK APPLICATION HL07-02 MILES -CHAMBERS HOUSE Next for the Commission to consider and make recommendation to the City Council was historic landmark application HL07-01 submitted by the City of Grapevine for property located at 626 South Church Street and platted as Lots 2A and 2B, Block 24, City of Grapevine Addition. The applicant was requesting designation as a historical landmark sub -district. Such sub -district may include buildings, land, areas, or districts or historical, architectural, archaeological or cultural importance or value that merit protection, enhancement, and preservation in the interest of the culture, prosperity, education, and welfare of the people. Staff was available for questions and requested favorable consideration of the application. 071707 5 P & Z JOINT PUBLIC HEARING JULY 17, 2007 With no further questions, guests to speak, one letter of protest, the public hearing was closed. In the Commission's deliberation session, B J Wilson moved to approve historic landmark application HL07-02. Mark Lowery seconded the motion, which prevailed by the following vote: Ayes: Oliver, Coy, Murray, Wilson, Undersander, St. John and Lowery Nays: None AM07-04 ZONING ORDINANCE AMENDMENTS TO SECTION 52 TREE PRESERVATION Next for the Commission to consider and make a recommendation to the City Council was AM07-04 zoning ordinance amendments to Section 52, Tree Preservation relative to tree pruning restrictions into and across public rights-of-way. Discussion was held regarding the need to make changes to the Tree Preservation ordinance relative to the pruning of trees on private property adjacent to public rights-of- way. Currently the ordinance required private property owners adjacent to rights-of-way to trim trees to a height of ten feet. Given the heights of emergency vehicles in use today Staff recommended increasing this height to fourteen (14) feet. City Manager, Rumbelow stated that it was not really a zoning issue but rather a public safety issue; it had been several years since the tree ordinance had been looked at. Several council members expressed concern that the burden on homeowners of keeping the trees trimmed an additional four (4) foot could be significant, and suggested reducing the impact by requiring the fourteen (14) foot clearance only on the center of the road. Mr. Rumbelow suggested that the case be tabled, allowing a joint workshop and re -advertisement. With no further questions, guests to speak, nor letters or petitions, the public hearing was tabled. In the Commissioner's deliberation session after a brief discussion, Chris Coy moved to table AM07-04 in order to hold a joint workshop with City Council to get a better understanding of the Tree Preservation Ordinance. Rob Undersander seconded the motion, which prevailed by the following vote: Ayes: Oliver, Coy, Murray, Wilson, Undersander, St. John and Lowery Nays: None 071707 P & Z JOINT PUBLIC HEARING JULY 17, 2007 CONSIDERATION OF MINUTES Next for the Commission to consider were the minutes of the June 19, 2007, planning and Zoning joint public hearing Chris Coy Murray moved to approve the Planning and Zoning Commission minutes of June 19, 2007.
