MEETING DATE: JULY 5, 2011 SUBJECT: CONSIDER APPROVAL TO AMEND THE AGREEMENT BETWEEN OWNER AND CONSTRUCTION MANAGER, DEAN ELECTRIC INC. dba DEAN CONSTRUCTION WHICH SHALL ESTABLISH A GUARANTEED MAXIMUM PRICE AND CONTRACT TIME FOR WORK FOR THE LOW WATER BOAT RAMP IMPROVEMENTS AT MEADOWMERE PARK RECOMMENDATION: Staff recommends the City Council consider approving Amendment No. 1 with Dean Construction for a guaranteed maximum price and contract time for the construction of a low water boat ramp, restroom facility, picnic pavilion and other improvements at Meadowmere Park in the amount not to exceed $387,053.55. FUNDING SOURCE: Funds are available from a $470,000 grant from the Texas Parks & Wildlife Department. The accounts are: 113048850- 312 -10 & 113 - 4899 -312 -10 —Grant 121- 48850- 312 -09- 000004 & 121- 48899 - 312 -09- 000004 - City BACKGROUND: The City Council approved a resolution at the September 16, 2008 meeting to authorize and direct staff to participate in the State Boating Access Grant Program with the Texas Parks & Wildlife Department for the development of a low water boat ramp, restroom facility, picnic pavilion and other miscellaneous improvements at Meadowmere Park. The total estimated cost of the project was $700,000 with the City's match being $200,000. At the April 29, 2009 meeting, the Council approved a contract with MHS Planning & Design for the design of the low water boat ramp and other improvements at Meadowmere Park. The Council also approved a Construction Manager at Risk contract with Dean Construction at the November 2, 2010. June 29, 2011 (3:48PM) The total cost of construction of the low water boat ramp and other improvements at Meadowmere Park will be approximately $670,000 and the City's part of the project is approximately $200,000. Staff recommends approving Amendment No. 1 pursuant to Section 2.2 of the Agreement dated November 4, 2010 with Dean Construction for a Guaranteed Maximum Price and Contract Time for the construction of a low water boat ramp, res #room facility, picnic pavilion and other improvements at Meadowmere Park. The bid form for the Meadowmere Park project has changed. The revised bid formwhich is attached shall be used in lieu of the original bid form. The changes in the bid form are: a. Bid Item #1: Erosion Control -the requirement to develop a Storm Water Pollution Prevention Plan (SWPPP) plan has been removed from this item. The contractor will be provided with the SWPPP plan. b_ Bid Item #6: Eastern. Courtesy Dock - the provision of the concrete headwall for the courtesy dock has been removed from this bid item and is now included in new bid item #4b - Headwall. c.
