HomeMy WebLinkAboutORD 2000-040 ORDINANCE NO. 2000-40 ,'..'w AN ORDINANCE OF THE CITY COUNCIL OF THE C TY OF GRAPEVINE, TEXAS, ABANDONING AND VACATING A PORTION OF THE EASY STREET RIGHT-OF-WAY IN THE CITY OF GRAPEVINE, TEXAS AS HEREINAFTER DESCRIBED; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, the owner of Tract 4, Sunshine Harbor Industrial Addition (as filed in Volume 388-39, Page 14, Plat Records of Tarrant County, Texas), the property containing said right-of-way, more specifically described in Exhibits "1" and "2" attached hereto and incorporated herein for all purposes, has requested the said right-of-way, as hereinafter described, be abandoned and vacated; and WHEREAS, the said right-of-way is not needed for public use and will not be needed in the future for public use; and WHEREAS, abandoning and vacating the said right-of-way will relieve the City of Grapevine, Texas from the cost and expense of maintaining said property. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That the said portion of right-of-way for Easy Street, described in Exhibits "1" and "2", attached hereto and incorporated herein for all purposes, is hereby abandoned and vacated for public use and the same is hereby abandoned and vacated insofar as all public right, title, and interest in and to said described portion of said right-of- way is concerned. Section 2. The fact that the said right-of-way is no longer needed by the public for public usage or traveling and would create a hardship or burden upon the City of Grapevine to keep open and maintain such right-of-way and such street creates an urgency and an emergency for the immediate preservation of the public health, safety, and general welfare which requires that this ordinance shall take effect immediately from and after its passage and it is accordingly so ordained. Section 3. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of any section, subsection, word, sentence or phrase shall be held to be invalid, it shall not affect the remaining part of this ordinance. / . Section 4. The fact that the drainage easement is no longer needed by the public for public usage and would create a hardship or burden upon the City of Grapevine to keep open and maintain such drainage easement creates an urgency and an emergency for the immediate preservation of the public health, safety, and general welfare which requires that this ordinance shall take effect immediately from and after its passage and it is accordingly so ordained. NO. 2000-40 2 EXHIBIT_I._ TO ateiaievo- Pag© of •:.° EXHIBIT NO. 1 —6,000 S.F.TRACT 50' R.O.W.ABANDONMENT EASY STREET 4'nSW BEING; a lot, tract or parcel of land located in the Esther Moore Survey, Abstract No. 1029, in the City of Grapevine, Tarrant County, Texas, and being part of the right-of-way dedicated for Easy Street, as shown - on the correction plat for Sunshine Harbor Industrial Addition, an addition to the City of Grapevine recorded in Volume 388-98, Page 38, of the Plat Records of Tarrant County, Texas (P.R.T.C.T.), subject tract being more particularly described as follows; BEGINNING; at al/2 inch iron rod with NDM cap found, said iron rod being located at the intersection of an easterly right-of-way line of Easy Street (50 foot R.O.W.), and a southeasterly line of a Dallas Area Rapid Transit right-of-way; THENCE; South 09°58'23" East, leaving the southeasterly line of the Dallas Area Rapid Transit right-of- way, and with the said easterly right-of-way line of Easy Street, a distance of 119.98 feet to a 1/2 inch iron rod with NDM cap found for corner, said iron rod being located at a point of intersection of said Easy Street; THENCE; South 80°08'59" West,across existing Easy Street right-of-way,a distance of 50.00 feet to a 3/8 inch iron rod found for corner, said iron rod being a point of intersection on a westerly right-of-way line of Easy Street; THENCE;North 09°58'23" West,with said westerly line of Easy Street, a distance of 120.00 feet to a 5/8 inch iron rod found for corner, said iron rod being located on the aforementioned southeasterly line of the Dallas Area Rapid Transit right-of-way; THENCE; North 80°10'00" East, with said southeasterly Dallas Area Rapid Transit right-of-way line, a distance of 50.00 feet to the POINT OF BEGINNING of herein described tract, containing 6,000 square feet of land,more or less.
