RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS GRANTING TARRANT COUNTY THE
AUTHORITY TO ACQUIRE AND, IF NECESSARY, ORDER
THE CONDEMNATION AND APPROPRIATION OF CERTAIN
RIGHTS-OF-WAY IN, OVER AND THROUGH PROPERTY
SITUATED ALONG A STATE ON SYSTEM BRIDGE
PROJECT KNOWN AS F.M. 2499 AT DENTON CREEK, A
PORTION OF WHICH PROJECT IS WITHIN THE CITY
LIMITS OF THE CITY OF GRAPEVINE, TARRANT COUNTY
TEXAS AND NEEDED FOR THE IMPROVEMENT OF F.M.
2499 AT DENTON CREEK AND PROVIDING AN EFFECTIVE
DATE
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS:
Section 1. That the City Council does hereby grant to Tarrant County, Texas, the
authority to determine the required public necessity for the acquisition of certain interests
in property situated along F.M. 2499 at Denton Creek within the City of Grapevine for the
improvement of F.M. 2499 at Denton Creek; and for this project the State of Texas requires
the acquisition of certain right-of-way in, over and through said land needed for the purpose
of constructing said improvements, using and maintaining a public street and bridge with
drainage facilities, as may be required, and the right to construct, operate and maintain
water, sanitary sewer or other public utilities in or upon said right-of-way required for the
widening of F.M. 2499 at Denton Creek.
Section 2. That the Texas Department of Transportation has completed the plans
and specifications and right-of-way acquisition documents for the project and Tarrant
County is hereby authorized to determine which property interests within the City of
Grapevine are necessary for the acquisition of right-of-way interests for this project.
Section 3. That if it is determined that a bona fide offer has been made to the
property owner, in compliance with the law, and that Tarrant County cannot agree, and has
been unable to agree with said property owner(s) as to the value of the property in question
or as to damages legally allowable by law, and such offers had in all things been approved,
ratified and confirmed, then the City Council of the City of Fort Worth hereby authorizes
Tarrant County to order the condemnation and appropriation of the necessary right-of-way
interests in, over and through the property situated along F.M. 2499 at Denton Creek in the
City of Grapevine, Tarrant County, Texas, needed for the improvement of F.M. 2499 at
Denton Creek by exercising the power of eminent domain set forth in Chapter 21 of the
Property Code, V.T.C.A., and all applicable provisions of the Charter of the City of
Grapevine, Texas.
I Section 4. That the County Attorney or his designee is hereby authorized to file
the necessary papers and take whatever action is needed for the prompt acquisition of the
required right-of-way interests in the referenced property location.
Section 5. That this resolution shall take effect from and after the date of its
passage.
