The property contains 57.19 acres and has approximately 976 feet of frontage along Westport Parkway and DFW g 1 1,120 feet of frontage along Stone-Myers Parkway. I — 0 REQUESTED ZONE CHANGE, CONDITIONAL USE, AND PLANNED DEVELOPMENT OVERLAY AND COMMENTS: The applicant is requesting a zone change to rezone approximately 32.57 acres from "LI" Light Industrial District and 24.62 acres from "BP" Business Park District to "CC" Communily Commercial District Primarily forthe development of a nonprofit institution. The applicant is also seeking a conditional use permit to establish a nonprofit institution to be utilized as a women's shelter. Lastly, a planned development overlay is also being requested to include but not be limited to deviation from the building separation requirement and to allow residential uses in the "CC" Community Commercial District It is the applicant's intent to utilize 49.5 acres of the subject property forthe development of a nonprofit, institutional women's shelter that will offer housing and a variety of counseling, 0:2CUIZ12-10.4,CU12-33.4,PD12-06.4 1 August 14,2012(8:12AM) training, and educational services to at-risk women and their children for a period of time up to thirty months in length. This is a multi-phase project that will ultimately consist of housing for 96 families, multipurpose counseling centers, a welcome center, a storage warehouse, and walking trails. The first phase will consist of six residential structures that will house 24 families, the first of four counseling centers, the welcome center, and storage warehouse. The applicant is requesting a planned development overlay to allow residential uses in the "CC" Community Commercial District and to reduce building separation relative to the residential units. As the ordinance is currently written, there is no provision within the"CC" Community Commercial District guidelines to allow for this type of institutional residential use. Building separation within the "CC" Commercial District is 40-feet. The applicant is requesting separation of no less than 23-feet to create a neighborhood environment and encourage direct interaction between residents. See the attached material. PRESENT ZONING AND USE: The property is currently zoned "BP" Business Park District and "LI" Light Industrial District and is undeveloped except for a gas well site (10 wells) located at the eastern edge of the site. HISTORY OF TRACT AND SURROUNDING AREA: The Stone property was not zoned when it was a part of unincorporated Tarrant County. When the property was annexed into the City on July 20, 1993, it was automatically zoned "R-20"Single Family. The Stone property since its annexation has remained zoned "R-20" Single Family and has remained undeveloped. Located to the south, the original Pavestone property and other surrounding areas were rezoned in the 1984 City Rezoning from "R-1" Single Family District to "PID" Planned Industrial Development. Z95-15 (Ord. 95-94) rezoned 7.975 acres from "R-20" Single Family District to"PID" Planned Industrial Development District. CU95-30(Ord.95-95)was approved to allow outside storage in conjunction with a manufacturing establishment. The only development to occur in the area is the existing Pavestone development. Council approved a revision to the Pavestone site plan at their November 18, 1997 joint public hearing (CU97-57; Ord. 97-124)specifically allowing a reduction in overall square footage of the future production facilities from 72,000 square feet to 55,403 square feet and allowed the addition of a new mixer housed within a 42-foot high penthouse. The property to the west, formerly a portion of the A.C. Stone tract was rezoned to the "LI" Light Industrial District in November, 1996 (Case No. Z96-22, Ord. No. 96-91). The site was subsequently developed as the Westport Business Park. The property to the east was rezoned from "R-1" Single Family District to "PID" Planned Industrial Development District during the 1984 City Rezoning. Zone Change Z98-19, approved in August, 1998, rezoned the a portion of the A.C. Stone Tract from the "R-20", Single Family District to the"LI", Light 0:2CU/Z12-10.4,CU12-33.4„P012-06.4 2 August 16,2012(9:08AM) Industrial District for the development of Frank Parra Dodge. The property to the north was rezoned from "I-1" Light Industrial District to"PID" Planned Industrial Development District during the 1984 City Rezoning. Zone Change Z86-15 rezoned the property from "PID" Planned Industrial Development District to "CC" Community Commercial District. At the January 18, 2000 meeting the subject tract and surround area comprising some 90 acres was rezoned from "R-20" Single Family District and "LI" Light Industrial District to "CC" Community Commercial District and "BP" Business Park District for future development. Near the subject property to the northwest Council approved a conditional use permit (CU06-45) at their October 17, 2006 meeting which allowed for a 121,000 square foot freight-forwarding warehouse and outside storage. This project was never developed. A special use permit(SU09-10)was approved by Council at their February 16,2010 meeting to allow oil/gas well drilling on the subject site specifically for four natural gas wells. An additional six natural gas wells were approved by the Site Plan Review Committee at their October 6, 2010 meeting establishing a total of 10 wells on the site. SURROUNDING ZONING AND EXISTING LAND USE: NORTH: Dallas/Fort Worth International Airport SOUTH: "BP" Business Park District and "LI" Light Industrial District—Westport Business Park EAST: "LI" Light Industrial Park—Westport Business Park and Dallas/Fort Worth International Airport WEST: "CC" Community Commercial District and "PID" Planned Industrial Development District—vacant property, Classic Chevrolet, Grapevine Dodge AIRPORT IMPACT: The subject tract is located within both "Zone A" Zone of Minimal Effect and "Zone B" Middle Zone of Effect as defined on the "Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" Map. Few activities will be affected by aircraft sounds in "Zone A" except for sound sensitive activities such as auditoriums, churches, schools, hospitals, and theaters. In "Zone B"the following uses may be considered only if sound treatment is included in building design: multifamily apartments, motels, office buildings, movie theaters, restaurants, and personal and business services. Single family residential and sound sensitive uses such as schools and churches should avoid this zone. The applicant's proposal is an appropriate use in this noise zone. MASTER PLAN APPLICATION: The Master Plan designates the subject property as an Industrial/Commercial land use. First Friday is real talk, real women, real life. Many testimonies exist of Ihow lives have been transformed through the First Friday events, as well as through special classes and workshops. In addition, a financial assistance program is offered to women who need a one-time, small grant that would be life-changing, Women have received monies for rent, auto repairs, dental assistance, etc. We offer women a hand up— not a handout. We are privately funded by donors, and by the Rose Family Foundation. In a word, we are re-gifting what God has given us in order to love God and love others, fulfilling the Greatest Commandment. The First Friday volunteers, Founders and attendees represent all ages, races, incomes and denominations. Everyone is welcome at First Friday. We are not supported by any church or group...we are women offering women a hand up. And, we have great plans to do more. Since the group began, we have envisioned that First Friday would grow deeper and wider. We are loving and "feeding" people mentally and spiritually, but also believe we are called to "feed"them physically. So in 2010, we applied and received nonprofit status with the name "projectHandUp." The new projectHandUp is the 501(c)3 umbrella organization that will extend the benevolent reach of First Fridaywith the following proposed venture. This proposal establishes The Gatehouse at Grapevine as a residential support community, where at- risk women and children can recover from dire circumstances, and build happy and healthy lives. The Gatehouse is about refuge, resources and relationships to transform lives for long-term change. For those women who are ready for the change, we will offer them the opportun'rfy and security to permanently stop the endless cycle of poverty, homelessness, helplessness and abuse. The Program: Refuge, Resources and Relationships for long-term change The Gatehouse will serve as a residential home and support community for at-risk women and their children for two and one-half years. With minimal cost for the guest resident in this disciplined and compassionate environment, it is our goal for the guests to move from painful places to find healing and master life skills. The result? Physically, emotionally and spiritually healthy, educated, employed and competent parents and children who contribute to the Grapevine community, and beyond. In addition, The Gatehouse will open its counseling services and educational events to women throughout the greater Grapevine area. We are committed to excellence and best practices, providing a program that can be respected and duplicated nationwide. Note: The Gatehouse MY focus on long-term change. We will not compete with other agencies or the emergency services that Grapevine already has in place. We value the spirit of collaboration and support the existing efforts of the many organizations that the City currently supports. Tha Pwficipants: Women and 'heir C4"tildren in A41-Disk Circumstances The typical program participant is a single woman, with or without children, who is either unemployed or significantly under-employed; generally fleeing or trying to recover from a domestic violence situation; and suffering from emotional, spiritual and economic stress. The participant and her children suffer unaddressed medical and dental problems, and she carries financial debt that is frequently a result from her abusive situation. We understand that the participant is willing, capable, and able to work, but will need counseling and encouragement, and continuing education to re- position her for future success. Referral sources will include shelters, private recommendations, or community and faith-based organizations, Note: We will not be equipped to host felons, those with active addictions, or those families involved in CPS cases. Applicants are required to: — complete a personal/family history long-form questionnaire — pass a Background Check — undergo a thorough interview process — agree with and sign a 'Program Participation' contract, which details the expectations of the applicant's engagement in the community, including commitments to: • attend classes, counseling sessions, life-skills training sessions and support group meetings; • develop and implement a short and long-term plan for the duration of the applicant's stay at The Gatehouse; • secure employment within two months of arriving in the Community: and • further her education, commit to remain substance-use and abuse-free throughout their stay —commit to contribute to the Community through assigned chores and volunteer activifiies Program Process: Phase I -- Approximately Three Weeks to One Month This is a sensitive, change-of-life transition that involves many business details: Application process, as described above Acceptance and Intake or Denial of Services and Referrals made to other resources Move-in and House Blessing Event First Seven Day Adjustment Period Phase 2 - Up to Three Months The next phase assesses Individual needs and prioritizes support services: Review legal, medical, transportation, childcare, employment, education, counseling, food, etc. Develop short-and long-term goals Begin work on accomplishing short-term goals/Life Skills as approved/aided by Advisor Begin Support Services as appropriate (counseling, parenting, budgeting, medical assistance) Enroll in JPS Public Health System Phase 3 - Up to Three Months As the client settles into the safe community, it's time to find work: Effort to secure employment Engage in job-skills training as appropriate, begin enrollment process for further education Continue to advance short-term goals and Life Skills achievement Begin a Savings Plan Phase 4 - Up to 18 Months The client is more settled, and has returned to the workplace. Included in the development project, the proposed event center will be an additional rental facility available to Grapevine residents, corporate meeting planners, non-profits and for the millions of visitors who come to the city every year. PROVIDING A PENALTY NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED UPON EACH DAY DURING OR ON WHICH A VIOLATION OCCURS; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, an application was made .requesting issuance of a conditional use permit by making applications for same with the Planning&Zoning Commission of the City of Grapevine, Texas, as required by State statutes and the zoning ordinance of the City of Grapevine, Texas, and all the legal requirements,conditions and prerequisites having been complied with, the case having come before the City Council of the City of Grapevine, Texas, after all legal notices requirements, conditions and prerequisites having been complied with; and WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing called by the City Council did consider the following factors in making a determination as to whether this requested conditional use permit should be granted or denied: safety of the motoring public and the pedestrians using the facilities in the area immediately surrounding the site; safety from fire hazards and measures for fire control; protection of adjacent property from flood or water damages, noise producing elements, and glare of the vehicular and stationary lights and effect of such lights on established character of the neighborhood; location, lighting, and types of signs and relation of signs to traffic control and adjacent property; street size and adequacy of width for traffic reasonably expected to be generated by the proposed use around the site and in the immediate neighborhood; adequacy of parking as determined by requirements of this ordinance for off-street parking facilities; location of ingress and egress points for parking and off-street locating spaces, and protection of public health by surfacing on all parking areas to control dust; effect on the promotion of health and the general welfare; effect on light and air; the effect on the overcrowding of the land; the effect on the concentration of population; the effect on the transportation, water, sewerage, schools, parks and other facilities; and WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing called by the City Council of the City of Grapevine,Texas,did considerthe following factors in making a determination as to whether this requested conditional use permit should be granted or denied; effect on the congestion of the streets, the fire hazards, panics and other dangers possibly present in the securing of safety from same, the effect on the promotion of health and the general welfare, effect on adequate light and air, the effect on the overcrowding of the land, the effect on the concentration of population, the effect on the transportation, water, sewerage, schools, parks and other public facilities; and WHEREAS, all of the requirements of Section 48 of Ordinance No. 82-73 have been satisfied by the submission of evidence at a public hearing; and WHEREAS,the City Council further considered among otherthings the character of the existing zoning district and its peculiar suitability for particular uses and with the view to conserve the value of buildings and encourage the most appropriate use of land throughout this City; and WHEREAS,the City Council of the City of Grapevine, Texas, does find that there is a public necessity for the granting of this conditional use permit, that the public demands it, that the public interest clearly requires the amendment, that the zoning changes do not unreasonably invade the rights of those who bought or improved property with reference to the classification which existed at the time their original investment was made; and WHEREAS, the City Council of the City of Grapevine, Texas, does find that the conditional use permit lessens the congestion in the streets, helps secure safety from fire, panic and other dangers, prevents the overcrowding of land,avoids undue concentration of population, facilitates the adequate provisions of transportation,water,sewerage, schools, parks and other public requirements; and WHEREAS, the City Council of the City of Grapevine, Texas, has determined that there is a necessity and need for this conditional use permit and has also found and determined that there has been a change in the conditions of the property surrounding and in close proximity to the property requested for a change since this property was originally classified and, therefore, feels that the issuance of this conditional use permit for the particular piece of property is needed, is called for, and is in the best interest of the public at large,the citizens of the City of Grapevine,Texas, and helps promote the general health, safety and welfare of this community. ORD. NO. 2 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That the City does hereby issue a conditional use permit in accordance with Section 48 of Ordinance No. 82-73,the Comprehensive Zoning Ordinance of the City of Grapevine,Texas, same being also known as Appendix"D"of the City Code, by granting Conditional Use Permit CU 12-33 to establish a nonprofit institution specifically to be utilized as a women's shelter in a district zoned "CC"Community Commercial District Regulations within the following described property: Lots 1 and 2, Block 1, The Gatehouse in Grapevine (670 Westport Parkway)all in accordance with a site plan approved pursuant to Section 47 of Ordinance No. 82-73, attached hereto and made a part hereof as Exhibit "A", and all other conditions, restrictions, and safeguards imposed herein, including but not limited to the following: None. Section 2. That the City Manager is hereby directed to amend the official zoning map of the City of Grapevine, Texas, to reflect the herein conditional use permit. Section 3. That in all other respects the use of the tract or tracts of land herein above described shall be subject to all the applicable regulations contained in said City of Grapevine zoning ordinance and all other applicable and pertinent ordinances of the City of Grapevine, Texas. Section 4. That the zoning regulations and districts as herein established have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the general welfare of the community. They have been designed with respect to both present conditions and the conditions reasonably anticipated to exist in the foreseeable future; to lessen congestion in the streets;to secure safely from fire, panic, flood and other dangers; provide adequate light and air; to prevent overcrowding of land, to avoid undue concentration of population; facilitate the adequate provisions of transportation,water, sewerage, drainage and surface water, parks and other public requirements, and to make adequate provisions forthe normal business,commercial needs and development of the community. They have been made with reasonable consideration, among other things, of the character of the district, and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. Section 5. That this ordinance shall be cumulative of all other ordinances of the City of Grapevine, Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances which are in direct conflict with the provisions of this ordinance. Section 6. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of land described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the tract or tracts of land described herein. ORD. NO. 3 Section 7. That any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Thousand Dollars ($2,000.00)and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 8. That the fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its final passage, and it is accordingly so ordained.
