SUBJECT: RECOVERY ACT - ENERGY EFFICIENCY AND
CONSERVATION BLOCK GRANTS - FORMULA GRANTS
PROGRAM RESOLUTION
RECOMMENDATION:
City Council consider adopting a resolution certifying the City of Grapevine's eligibility for
the Recovery Act — Energy Efficiency and Conservation Block Grants - Formula Grants
Program, designating the City Manager as the City's representative for dealing with the
Department of Energy (DOE), authorizing staff to submit an application to the DOE for
funding of the energy efficiency project in Grapevine, and take any necessary action.
BACKGROUND:
The American Recovery and Reinvestment Act of 2009, Public Law 111-5, (Recovery
Act) appropriates funding for the Department of Energy (DOE) to issue/award formula-
based grants to cities under the Energy Efficiency and Conservation Block Grant
(EECBG) Program. The City of Grapevine's designated funding is $503,000. DOE's
authorization for this program is set forth in Title V, Subtitle E of the Energy
Independence and Security Act (EISA) of 2007.
Projects under this announcement will be funded, in whole or in part, with funds
appropriated by the Recovery Act. The Recovery Act's purpose is to stimulate the
economy and to create and retain jobs. Accordingly, special consideration will be given
to projects that promote and enhance the objectives of the Act, especially job creation,
preservation and economic recovery, in an expeditious manner.
Special terms and conditions may apply to projects funded by the Act relating to:
• Reporting, tracking and segregation of incurred costs;
• Reporting on job creation and preservation;
• Publication of information on the Internet;
• Access to records by Inspectors General and the Government Accountability
Office;
• Prohibition on use of funds for gambling establishments, aquariums, zoos, golf
courses or swimming pools;
• Ensuring that iron, steel and manufactured goods are produced in the United
States;
• Ensuring wage rates are comparable to those prevailing on projects of a
similar character;

• Protecting whistleblowers and requiring prompt referral of evidence of a false
claim to an appropriate inspector general; and
• Certification and Registration.
The following projects are proposed. The projects, in addition to reducing our carbon
footprint, also meet target criteria for implementing a green house gas emissions
reductions plan in accordance with ICLEI milestones. These projects were previously
presented to the Council in the May workshop.

CERTIFICATION
The City of Grapevine herein certifies that all laborers and mechanics on projects
funded directly by or assisted in whole or in part by and through funding
appropriated by the ARRA Energy Efficiency and Conservation Block Grant —
Formula Grant will be paid wages at rates not less than those prevailing on
projects of a character similar in the locality as determined by subchapter IV of
Chapter 31 of title 40, United States Code (Davis-Bacon Act).

GRAPEVINE, TEXAS HEREINAFTER REFERRED TO AS
"APPLICANT", DESIGNATING CERTAIN OFFICIALS AS
BEING RESPONSIBLE FOR, ACTING FOR, AND ON
BEHALF OF THE "APPLICANT" IN DEALING WITH THE
U.S. DEPARTMENT OF ENERGY NATIONAL ENERGY
TECHNOLOGY LABORATORY, HEREINAFTER
REFERRED TO AS "GRANTOR", FOR THE PURPOSE OF
PARTICIPATING IN THE RECOVERY ACT — ENERGY
EFFICIENCY AND CONSERVATION BLOCK GRANTS —
FORMULA GRANTS PROGRAM, HEREINAFTER
REFERRED TO AS THE "PROGRAM"; CERTIFYING THAT
THE "APPLICANT" IS ELIGIBLE TO RECEIVE PROGRAM
ASSISTANCE; CERTIFYING THE NAME AND CONTACT
INFORMATION OF THE CITY MANAGER; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the "Applicant" is fully eligible to receive assistance under the
"Program"; and,
WHEREAS, the "Applicant" is desirous of authorizing an official to represent and
act for the "Applicant" in dealing with the "Grantor" concerning the "Program".
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS:
Section 1. That the "Applicant" hereby certifies that it is eligible to receive
assistance under the "Program" based on Title V, Subtitle E, Energy Efficiency and
Conservation Block Grants, Sections 541(3)(A) or 541(3)(B) of EISA 2007, Public Law
110-140.
Section 2. That the "Applicant" hereby authorizes and directs its City Manager
to act for the "Applicant" in dealing with the "Grantor" for the purpose of the "Program,"
and the City Manager is hereby officially designated as the representative in this regard.
Contact information for the City Manager is hereby certified as 200 South Main Street,
Grapevine, Texas, 76051, 817-410-3103.
Section 3. That the "Applicant" hereby specifically authorizes the official to
make application to the "Grantor" concerning the project known as Energy Efficiency in
Grapevine, Texas.
Section 4. That this resolution shall take effect from and after the date of its
passage.
