HomeMy WebLinkAboutPZ Item 10- Minutes P & Z JOINT PUBLIC HEARING MAY 19, 2009 STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Planning and Zoning Commission of the City of Grapevine, Texas met in Special Briefing Session on this the 19th day of May 2009 at 7:00 p.m. in the Planning and Zoning Conference Room, 200 South Main Street, 2nd Floor, Grapevine, Texas with the following members present-to-wit: Larry Oliver Chairman B J Wilson Member Mark Lowery Member Monica Hotelling Member Gary Martin Member Jimmy Fechter Member Elaine Martin Alternate constituting a quorum with Herb Fry and Wayne Szot absent and the following City Staff: Ron Stombaugh Planning and Development Manager Albert Triplett Planner II Susan Batte Planning Technician CALL TO ORDER Chairman Oliver called the meeting to order at 7:01 p.m. ITEM 1. BRIEFING SESSION First for the Commission to review and consider was the proposed rezoning of recently acquired property along West State Highway 114. At the November 18, 2008 meeting the City Council considered and approved a boundary adjustment with the City of Southlake in the general vicinity of West Northwest Highway and West State Highway 114. This was done in an effort to eliminate an erratic boundary line that was confusing to emergency responders in both cities and to improve the economic development potential of several viable properties within Grapevine that were compromised by the current boundary line. This adjustment was later approved by the Southlake City Council at their December 2, 2008 meeting. The area acquired by the City of Grapevine from the City of Southlake totaled 18.22 acres and is now zoned "R-20" Single Family District—the designation that is given to all newly acquired/annexed property prior to consideration of appropriate zoning. An undeveloped tract near the northeast corner of Austin Oaks Drive and the westbound service road of West State Highway 114 is 1.72 acres in size. A developed area which 051909 1 P & Z JOINT PUBLIC HEARING MAY 19, 2009 ` ''` includes a small multi-tenant retail building and a parking lot for the former Albertson's Shopping Center that has frontage along the West State Highway 114 service road and Park Boulevard contains 5.15 acres. The remaining land, totaling 11.35 acres is TxDOT right-of-way frontage that extends from Austin Oaks Drive south to the city limit boundary line with the City of Southlake. After a brief discussion it was the consensus of the Commission to allow the property owner to request to rezone Tracts 2C, 2D and a portion of Tract 2E3, Abstract 458, Thomas Easter Survey as it develops and require the developer to continue the masonry fence as constructed on the Westgate Plaza Addition. It was also the consensus of the Commission to authorize the City of Grapevine to initiate a zone change request to rezone Tracts 2E5, 2E6, 2E2, 2E5C and 2E9B of Abstract 458, Thomas Easter Survey to "CC" Community Commercial and Lot 3A, Grapevine Plaza Addition to "CN" Neighborhood Commercial. ITEM 2. BRIEFING SESSION Chairman Oliver announced the Planning and Zoning Commission would conduct a briefing session relative to the following cases: CU09-08 BACK PORCH GRILL CU09-09 & PD09-03 FOURMILE HOLDINGS CU09-10 1ST PRESBYTERIAN CHURCH CU09-11 PEACE BURGER GRILL to discuss development issues. ADJOURNMENT After a brief discussion, Chairman Oliver adjourned the meeting at 7:21 p.m. PASSED AND APPROVED BY THE PLANNING AND ZONING COMMISSION OF THE CITY OF GRAPEVINE, TEXAS ON THIS THE 16TH DAY OF JUNE 2009. APPROVED: CHAIRMAN ATTEST: 051909 2 P & Z JOINT PUBLIC HEARING MAY 19, 2009 Ms. Kim Newton and Ms. Rachel McGallan, the restaurant owners, informed the City Council and Planning and Zoning Commission that they intend to do a 1,762 square foot expansion to the north with seating for 85 customers. This area will serve as a non- smoking area. With no further questions, guests to speak, one letter of support, the public hearing was closed. In the Commission's deliberation session, Monica Hotelling moved to approve conditional use application CU09-08. Jimmy Fechter seconded the motion, which prevailed by the following vote: Ayes: Oliver, Wilson, Hotelling, Lowery, G. Martin, and E. Martin Nays: None CONDITIONAL USE APPLICATION CU09-09 AND PLANNED DEVELOPMENT OVERLAY PD09-03 - FOURMILE HOLDINGS Next for the Commission to consider and make recommendation to the City Council was conditional use application CU09-09 and planned development overlay application PD09-03 submitted by Fourmile Holdings for property located at 810 Mustang Drive and proposed to be platted as Lots 10R1, 10R2 & 10R3, Metroplace 2nd Installment Addition. The applicant was requesting a conditional use application to establish a planned business park and a planned development overlay application to vary from the front yard setback requirements. The applicant requested that the public hearing be tabled in order to explore options relative to the subdivision of the property. With no further questions, guests to speak, nor letters or petitions, the public hearing was tabled to June 16, 2009. CONDITIONAL USE APPLICATION CU09-10 - FIRST PRESBYTERIAN CHURCH OF GRAPEVINE Next for the Commission to consider and make recommendation to City Council was conditional use application CU09-10 submitted by First Presbyterian Church of Grapevine for property located at 1002 Park Boulevard and platted as Lot 1, Block 1, First Presbyterian Church Addition. The applicant was requesting a conditional use permit to allow a ground sign with changeable copy in the "R-7.5" Single Family District for an existing church. Mr. Rick Wilhelm, representing the applicant, was available to answer questions and requested favorable consideration of the application. 0 051909 5 P & Z JOINT PUBLIC HEARING MAY 19, 2009 With no further questions, guests to speak, three letters of support, the public hearing was closed. In the Commission's deliberation session, Mark Lowery moved to approve conditional use application CU09-10. Elaine Martin seconded the motion, which prevailed by the following vote: Ayes: Oliver, Wilson, Hotelling, Lowery, Fechter, G. Martin, and E. Martin Nays: None CONDITIONAL USE APPLICATION CU09-11 - PEACE BURGER GRILL Next for the Commission to consider and make recommendation to City Council was conditional use application CU09-11 submitted by Jose Segovia for property located at 1228 William D Tate Avenue and platted as Parcel E, Grapevine Towne Center Addition. The applicant was requesting a conditional use permit to amend the previously approved site plan of CU92-05 (Ord. 92-24) for the possession, storage, retail sale and on-premise consumption of alcoholic beverages (beer, wine and mixed beverages) in conjunction with a restaurant, specifically to revise the floor plan for a new restaurant. Mr. David Fisher, representing the applicant, was available to answer questions and requested favorable consideration of the application. With no further questions, guests to speak, nor letters or petitions, the public hearing was closed. In the Commission's deliberation session, B J Wilson moved to approve conditional use application CU09-11. Monica Hotelling seconded the motion, which prevailed by the following vote: Ayes: Oliver, Wilson, Hotelling, Lowery, Fechter, G. Martin, and E. Martin Nays: None END OF PUBLIC HEARING CONSIDERATION OF MINUTES Next for the Commission to consider were the minutes of the April 21, 2009 Workshop and the April 21, 2009 Planning and Zoning joint public hearing. Monica Hotelling moved to approve the Planning and Zoning Commission minutes of April 21, 2009 Workshop and the April 21, 2009 Planning and Zoning joint public hearing as written.
