GrapeFest Co-Chairs, Carol and Michael Marchant, to present information th regarding the 36 Annual GrapeFest – A Texas Wine Experience presented by the Bank of the West that will take place September 15-18, 2022. PUBLIC HEARINGS AND RELATED ITEMS 5. City Council to conduct a public hearing relative to the Fiscal Year 2022-2023 annual operating budget and take any necessary action. 6. Consider Ordinance No. 2022-054 adopting the Fiscal Year 2022-2023 City of Grapevine Annual Operating Budget and take any necessary action. 7. Consider Ordinance No. 2022-055 adopting an ad valorem tax rate of 0.271775 per $100 valuation for tax year 2022 and fiscal year 2023 and take any necessary action. NEW BUSINESS 8. Consider Ordinance No. 2022-056 amending the Grapevine Code of Ordinances, Chapter 16, Parks and Recreation, Section 16-32 (A) implementing new rates for the golf fees effective October 1, 2022 for the Grapevine Municipal Golf Course and adding provision to allow Golf Course Director of Operations to adjust rates to maintain the 50 percentile market rate equivalent with City Manager approval, and take any necessary action. 9. Consider Ordinance No. 2022-057 amending Ordinance No. 95-35, as amended, to renew the franchise agreement with Republic Services to provide cart trash service and extend the term of the franchise, consider Ordinance No. 2022-058 amending the Grapevine Code of Ordinances, Chapter 25 Utilities and Services, Article III Solid Waste Disposal relative to residential solid waste and recycling collection rates and take any necessary action. 10. Consider lighting improvements in public parking lots and associated pedestrian access improvements to serve the downtown area by awarding informal requests for quotes for HDPE conduit installation from Predur Underground Construction Inc.; Hydrovac services from AIMS Companies; and traffic light poles from Wholesale Electric Supply; Ordinance No. 2022-059 appropriating the funds; and take any necessary action. CONSENT AGENDA Consent items are deemed to need little Council deliberation and will be acted upon as one business item. Any member of the City Council or member of the audience may request that an item be withdrawn from the consent agenda and placed before the City Council for full discussion. Consider an annual insurance policy for Medical and Rx Stop Loss with HCC. Chief Financial Officer and Human Resources Director recommend approval. 12. Consider the renewal of a service contract for datacenter system and network administration from LEAF TCS. Chief Technology Officer recommends approval. 13. Consider entering into an Interlocal Agreement for mutual access to Bibliotheca cloudLibrary digital resources for the Library. Acting Library Director recommends approval. City Council September 6, 2022 Page 2 14. Consider contracts with Smith Lawn and Tree, as the primary vendor, and Arbor Masters Tree Service, as the secondary vendor, for tree maintenance services. Parks and Recreation Director recommends approval. 15. Consider the purchase of a drone light show for the City of Grapevine holiday light show from Sky Elements, LLC and Ordinance No. 2022-060 appropriating the funds. Parks and Recreation Director recommends approval. 16. Consider Resolution No. 2022-011 authorizing the second amendment to the Ground and Tower Lease Agreement with T-Mobile West, LLC for the purpose of installing, operating, and maintaining a communications facility on the Dove water tower, 1702 Sagebrush Trail. Public Works Director recommends approval. 17. Consider the disposition of public land at 1937 Camelot Drive to the property owners at 1929 Camelot Drive and 1943 Camelot Drive. Public Works Director recommends approval. 18. Consider an Interlocal Agreement with the City of Euless for an emergency water interconnect. Public Works Director recommends approval. 19. Consider an informal request for quote for an annual contract for generator maintenance with Diversified Power Systems. Public Works Director recommends approval. 20. Consider annual contract for the purchase of various fuels with US Oil. Public Works Director recommends approval. 21. Consider changing the start time of the October 4, 2022 City Council meeting to 5:30 p.m. to allow the City Council to attend neighborhood National Night Out events. Invocation Mayor Pro Tem Darlene Freed gave the invocation. Item 2. Posting of the Colors and Pledges of Allegiance The Order of the Arrow posted the colors and lead the Pledges of Allegiance. Item 3. Citizen Comments Aram Azadpour, PO Box 2644, Grapevine refenced an email he sent to City Council regarding the compensation of the Municipal Judge. He provided the email and requested it be made part of the permanent record. The email is attached to the final minutes. Tiffany Teal, 3225 West Grapevine Mills Boulevard, Grapevine described the rent increases and management of the Terrawood Apartments. PRESENTATIONS Item 4. GrapeFest Co-Chairs, Carol and Michael Marchant, to present information th regarding the 36 Annual GrapeFest – A Texas Wine Experience presented by the Bank of the West that will take place September 15-18, 2022. Carol and Michael Marchant updated Council on the activities planned for this year’s GrapeFest including the Choice Wine Tasting Classic, the Liberty Park Place Wine Experience, the Charcuterie Workshops, the Champagne Terrace, the live music areas with headliners Taylor Dayne and Jack Ingram, the Kid Zone, the GrapeStomp and the Champagne Cork Shoot-Off. Mr. Marchant also thanked the Grapefest volunteers. PUBLIC HEARINGS AND RELATED ITEMS Item 5. City Council to conduct a public hearing relative to the Fiscal Year 2022-2023 annual operating budget and take any necessary action. Mayor Tate declared the public hearing open. Chief Financial Officer Greg Jordan presented this item along with items 6 and 7. The Fiscal Year 2022-2023 budget was designed with inflation pressures and compensation needs considered. This year’s budget is a 12% increase from the Fiscal Year 2021-2022 budget for a total of $191,280,511. No one spoke during the public hearing and there was no correspondence to report. Consider Ordinance No. 2022-054 adopting the Fiscal Year 2022-2023 City of Grapevine Annual Operating Budget and take any necessary action. Chief Financial Officer Jordan presented this item at the same time he presented item 5. Motion was made to approve Ordinance No. 2022-054 adopting the Fiscal Year 2022- 2023 City of Grapevine Annual Operating Budget. Consider Ordinance No. 2022-055 adopting an ad valorem tax rate of 0.271775 per $100 valuation for tax year 2022 and fiscal year 2023 and take any necessary action. Chief Financial Officer Jordan presented this item to Council and stated this tax rate was a decrease of 0.013% from the previous budget. Motion was made to approve Ordinance No. 2022-055 adopting an ad valorem tax rate of 0.271775 per $100 valuation for tax year 2022 and fiscal year 2023. Consider Ordinance No. 2022-056 amending the Grapevine Code of Ordinances, Chapter 16, Parks and Recreation, Section 16-32 (A) implementing new rates for the golf fees effective October 1, 2022 for the Grapevine Municipal Golf Course and adding provision to allow Golf Course Director of Operations to adjust rates to maintain the 50 percentile market rate equivalent with City Manager approval, and take any necessary action. The proposed rates will th keep the Grapevine Municipal Golf Course in the 50 percentile of the Metroplex public golf courses. Motion was made to approve Ordinance No. 2022-056 amending the Grapevine Code of Ordinances, Chapter 16, Parks and Recreation, Section 16-32 (A) implementing new rates for the golf fees effective October 1, 2022 for the Grapevine Municipal Golf Course and adding provision to allow Golf Course Director of Operations to adjust rates to maintain the 50th percentile market rate equivalent with City Manager approval Motion: Slechta Second: O’Dell Ayes: Tate, Freed, Rogers, Coy, O’Dell, Slechta and Leal Nays: None Approved: 7-0 ORDINANCE NO. 2022-056 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS AMENDING THE CODE OF ORDINANCES CHAPTER 16 PARKS AND RECREATION, SECTION 16-32(A) RELATIVE TO GRAPEVINE MUNICIPAL GOLF COURSE FEES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF FIVE HUNDRED DOLLARS ($500.00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH AN OFFENSE OCCURS OR CONTINUES; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE Item 9. Consider Ordinance No. 2022-057 amending Ordinance No. 95-35, as amended, to renew the franchise agreement with Republic Services to provide cart trash service and extend the term of the franchise, consider Ordinance No. 2022-058 amending the Grapevine Code of Ordinances, Chapter 25 Utilities and Services, Article III Solid Waste Disposal relative to residential solid waste and recycling collection rates and take any necessary action. Environmental Services Manager Dewey Stoffels presented this item and answered questions from Council. The Fiscal Year 2023 residential rate for solid waste disposal will be $16.91. The rate will adjust to $18.29 in Fiscal Year 2024 with further rate increases based on the formula of Consumer Price Index for Garbage and Trash. In 2024, Republic Services will begin roll-cart trash pickup services. Motion was made to approve Ordinance No. 2022-057 amending Ordinance No. 95-35, as amended, to renew the franchise agreement with Republic Services to provide cart trash service and extend the term of the franchise and consider Ordinance No. 2022-058 City Council September 6, 2022 Page 4 amending the Grapevine Code of Ordinances, Chapter 25 Utilities and Services, Article III Solid Waste Disposal relative to residential solid waste and recycling collection rates. Development Engineer and Construction Manager John Robertson presented this item to Council and answered their questions. The proposed plan includes pedestrian access improvements on Main Street between Dallas Road and Northwest Highway, and improvements of street lighting in several parking lots along Main Street for an estimated amount of $275,000. Motion was made to approve the informal request for quotes for conduit installation, Hydrovac services and traffic light poles; and Ordinance No. 2022-059 appropriating funds in the Capital Projects Streets Fund. Consider an annual insurance policy for Medical and Rx Stop Loss with HCC. Chief Financial Officer Jordan and Human Resources Director Rachel Huitt recommended approval of the annual insurance policy for Medical and Rx Stop Loss insurance for an estimated amount of $810,000. Consider the renewal of a service contract for datacenter system and network administration from LEAF TCS. Chief Technology Officer Tessa Allberg recommended approval of the renewal of the service contract with LEAF TCS to provide services to include virtual network system administration and support, datacenter physical network support and maintenance, network infrastructure planning/troubleshooting, and system and network monitoring for an amount not to exceed $80,000. Acting Library Director Chad Hetterley recommended approval of the Interlocal Agreement to expand public access to digital content by sharing Biblioteca cloudLibrary digital resources with other participating Texas libraries for an amount not to exceed $11,000. Parks and Recreation Director Chris Smith recommended approval of the agreements to establish fixed hourly rates for a variety of tree maintenance services on an as-needed basis for an estimated annual amount of $350,000. Consider the purchase of a drone light show for the City of Grapevine holiday light show from Sky Elements, LLC and Ordinance No. 2022-060 appropriating the funds. Parks and Recreation Director Smith recommended approval of the purchase of a drone light show to be held on December 3 and 17. The appropriating of funds of $22,000 will be available in the Special Revenue Fund resulting from sponsorship contributions from Hotel VIN and Harvest Hall. Consider the disposition of public land at 1937 Camelot Drive to the property owners at 1929 Camelot Drive and 1943 Camelot Drive. Public Works Director Bryan Beck recommended approval of the disposition of the vacant lot located at 1937 Camelot Drive to the adjacent homeowners. Public Works Director Beck recommended approval of an Interlocal Agreement with the City of Euless for an interconnect that is approximately 550’ west of the Euless Grapevine Road/Main Street and Glade Road intersection. Assistant City Manager Jennifer Hibbs introduced Chris Mayo with T-Mobile West, LLC who answered questions from Council about coverage and future antennas. Motion: Rogers Second: Coy Ayes: Tate, Freed, Rogers, Coy, O’Dell, Slechta and Leal Nays: None Approved: 7-0 RESOLUTION NO. 2022-011 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS AUTHORIZING THE SECOND AMENDMENT TO THE GROUND AND TOWER LEASE AGREEMENT WITH T-MOBILE WEST LLC, FOR THE INSTALLATION OF COMMUNICATIONS EQUIPMENT INCLUDING ANTENNAS, CABLES AND OTHER COMMUNICATION INSTRUMENTS ON THE DOVE WATER TOWER AND PROVIDING AN EFFECTIVE DATE Item 19. Consider an informal request for quote for an annual contract for generator maintenance with Diversified Power Systems. Public Works Director Beck recommended approval of a contract for generator maintenance for an annual amount of $24,100. Council Member O’Dell stated her question was answered in the memo and a presentation was not needed. Motion was made to approve the informal request for quote for an annual contract for generator maintenance. As you will notice (when you review the attached), no city has as a generous of a compensation package as Grapevine does (the highest is that of Colleyville, however, Colleyville and Keller have an intergovernmental agreement to run a single municipal court, so essentially, that judge runs two cities and not one city), none provide for retirement, health insurance, none provide employee and they consider their judges a contractor and not an employee (so do not provide for things like workers' comp). Also, attached please find the final compensation for David Florence. He retired in April of 2015, that put his final salary at $113k for "2015" "showed" Cr about (comparable for county judges). Also, he has employee insurance and up as an employee of the City (as do present Grapevine City judges) whenever I've requested data on salary of employees of the City pursuant to the Texas Public Information Act. I believe this position should be considered as a "contractor" and not an employee, for one thing, it has a set duration (a fundamentally distinguishing characteristic between an at will employee -<5 and an independent contractor based upon the Texas and Federal employment laws). - In response to my inquire (years back) on why Grapevine City Judge is being paid comparable to Tarrant County judges, as it is typical of y'all not one made an effort to find out why our City judge deserved to be paid in levels similar to County judges, or, better yet, what do cities neighboring us are paying their city judges. As I've noted before, Grapevine City Council is one monolith of inaction, I've questioned why the City is bearing the cost of having seven Council Members? What particular task one does which cannot be done by another, surely none of you are more accessible to the general public now that there are seven of you as opposed to a lower number, say, three. The Mayor wishes to artificially inflate his position by saying well people can reach me, why sir? Nothing in our City Charter bestows such requirements on the people of Grapevine, nor, gives the position of Mayor such an exclusive responsibility. But then again, City Charter, what is that (we keep that next to a copy of Bible and the US Constitution on some mantel and just look at its cover, as opposed to reading them)! Y'all say well no one runs against us! Well, why do you have to run until death or scandal do you apart? Why not stop after, I do not know, 15, 20 years; is that not long enough to satisfy your ego. In the wake of the revelation of theft of public funds, y'all have failed to do the minimum: passing an Ethics Ordinance to regulate the conduct of the City Council, heads of various departments, the City Manager, and more importantly to set sanctions for its violation. It is absurd that, for example, the Fire Department Chiefs salary/budget comes before this body for approval and yet the Fire Department Assoc. does campaigning, only, for a sitting Council Member. As I've noted before, even God knew He made a mistake when He created mankind, that is why He gave mankind a limited life span. Why y'all insist on being in the Council until death or scandal do you apart, is past me, but then again I am not an egoistic person. Besides all the harassment people running against a sitting Council Member have faced, It is unreasonably expensive to run for a City Council in Grapevine. Tell me something: would you be able to point to one ill which would have bestowed upon the City, but for, your effort to curb that ill? Just one! I can count some ills that have been bestowed upon the City because some of you were the Council Member. When the good Council Members stay silent, then they are no different than the others; and, if you did something right, that is not a big deal, that is what is expected. Tell me something, how many of you send a thank you note to the maker of your vehicle because when you turned the ignition key, the vehicle became operational, how many of you? I hope none, because that is "expected" (for your vehicle to come on when the ignition key is turned, no reason to thank the vehicle maker). If the excuse is that our City Council is non - salaried, I would be happy to vote for an initiative on the ballot to amend the City Charter to set a salary for our City Council Members, if that would make y'all more responsive to the general public. RECITALS: WHEREAS, Colleyville and Keller (each a "City" and collectively the "Cities") jointly administer and operate a regional municipal court; and WHEREAS, the Cities desire to engage and appoint Judge Carol Montgomery to serve as the regional municipal court judge for the Cities' regional municipal court pursuant to the terms and conditions of this Agreement. NOW, THEREFORE, in consideration of the mutual covenants and terms and conditions herein contained, and of the execution hereof, the Parties agree and bind themselves to the obligations and performance of the tasks as follows: Article I Purpose The purpose of this Agreement is for the City to contract for municipal court judge services to be performed in accordance with the terms and conditions of this Agreement. Article II Term This Agreement shall be effective as of December 1, 2021 (the "Effective Date") and shall expire December 31, 2023. Notwithstanding the foregoing, the term of this Agreement may be extended by mutual written agreement of the Parties. Article III Regional Municipal Court Judge 3.1 Authority; Services. Judge shall have all authority vested under law and shall undertake Judge's duties fairly, impartially and independently. Judge shall, in a timely and responsive manner, perform all services set forth herein and as required of municipal court judges in accordance with Cities' respective Charters, the Cities' interlocal agreement for combined municipal court services, the adopted policies and procedures of the regional municipal court, and the laws applicable to municipal judges of courts in the State of Texas, as the foregoing may be amended ("Services"). Judge shall be responsible for all duties customarily performed by magistrates of municipal courts of record in Texas. In particular, Judge shall be responsible for all arraignments and magistrate duties for the regional holding facility (jointly administered by Keller, Colleyville and Southlake), subject to the terms and conditions of all existing MOUs and other agreements of the cities related to the same. Judge (or duly assigned associate judge(s)) shall, at all times during the term of this Agreement, be available on a 24/7 basis to handle all warrants, bonds, emergency orders, prisoner transfers requests, and similar matters. Compensation for these duties flow through the stipend received from Southiake in the amount of $12,000 per year and Roanoke in the amount of $7,300 per year, to be paid to the Judge quarterly. 3.3 Scheduling of Dockets. Judge shall be responsible for scheduling all court dockets and proceedings in coordination with the municipal court administrator to facilitate optimal court efficiency in support of the Cities' customer service goals and values. 3.4 Review and Selection Committee. The Cities have established a Municipal Judge Review and Selection Committee (the "Committee") to assist in administering the position of the regional municipal court judge. The Committee may meet from time to time to discuss, review and/or modify the administration of the regional municipal judge position, including the periodic review the Judge's performance under this Agreement. Within the first three (3) months of this Agreement, a performance evaluation of judge shall be undertaken by the Cities (through their respective City Managers, or designee(s)) and presented to the Committee. Upon request by the Committee and/or Cities, Judge agrees to collaborate with the Committee to ensure the municipal court's operations, policies and orders are being effectively administered consistent with the operational goals and values of the Cities. 3.5 Associate Judge(s}. Judge shall, upon prior written approval of the Cities, engage the services of one or more associate judges during the term hereof, subject to all terms and conditions established by the Cities, in the Cities' sole discretion. Judge shall exercise direct supervision over all associate judges and be responsible for assigning such associate judges to act in Judge's absence in accordance with Section 30.00007(a)(4) of the Texas Government Code. Judge shall be responsible for all compensation due to all associate judges under this Agreement and shall ensure that the position of associate judge does not go vacant for more than 60 consecutive days during the term of this Agreement. PACE 2 I CITY Or COLLEYVILLEXITY OF KELLER REGIONAL MUNICIPAL COURT JUDGE AGREEMENT 3.6 Qualifications; Trainings. Judge must be an attorney licensed by the Texas Supreme Court and must remain in good standing with the State Bar of Texas at all times during the term of this Agreement. Judge shall further adhere to the Texas Code of Judicial Conduct and all other constitutional and statutory requirements of Judge's appointed office. The Cities acknowledge that Judge may be required to participate in training programs administered by the City of Southlake during the term of this Agreement and agree that the City of Southlake, as Judge's current employer, may seek equitable contribution in the form of reimbursement from the Cities for the proportionate costs of such trainings attributable to the Judge's Services under this Agreement. Article IV Compensation 4.1 Compensation. Judge shall be compensated for the Services based upon a flat annual rate of $135,000, which will be paid to Judge on a bi-weekly basis ($5,192.31) during the term of this Agreement. Should this Agreement terminate prior to the last day of the month, the Judge's compensation will be prorated on a daily basis for any partial month. Additionally, the cities will provide Judge, during the term of this Agreement, (i) use of 2 iPads (to be purchased and owned by Colleyville) at least one device will be a cellular streaming device, (ii) a one-time reimbursement up to $250.00 for judicial robe(s), (iii) a mobile telecommunications device stipend in the amount of $100.00 per month, and (iv) cities shall find City of Colleyville portion of participation in Texas Municipal Retirement Fund. Judge shall not be entitled to any other compensation under this Agreement unless otherwise agreed by the Parties in writing. 4.2 Independent Contractor Status; Insurance• Taxes. Notwithstanding any other provision of this Agreement, the Parties intend and agree that Judge shall be an independent contractor and not an employee of either City during the term of this Agreement for any purpose, including without limitation, application of FICA, the Social Security Act, the Federal Unemployment Act, and applicable provisions of the Internal Revenue Code. The Cities shall not pay (or reimburse) Worker's Compensation Insurance on Judge's behalf during the term of this Agreement and Judge shall at all times be responsible for the payment of Judge's self-employment taxes incurred in connection with this Agreement. Article V Termination 5.1 Termination for Convenience. Any Party may terminate this Agreement, in whole or in part, at any time by providing sixty (60) days written notice. Judge shall be compensated for all Services up to the time of termination. If Judge has any property or documents in its possession belonging to the Cities, Judge will account for and dispose of the same in the manner requested. 5.2 Termination for Default [Breach or Cause]. If Judge fails to perform in the manner called for in this Agreement, or if Judge fails to comply with any other provisions of this Agreement, the Cities may terminate this Agreement for default. Termination shall be given by serving a notice of termination on Judge setting forth the default and stating the date of termination. Notwithstanding any other provisions of this Agreement, the Parties acknowledge that Judge may be removed from office only as provided by law. The removal of Judge by either City, regardless of reason, shall be mutually effective to terminate this Agreement. 5.4 Waiver of Remedies for Any Breach. In the event that City elects to waive its remedies for any breach or default by Judge of any covenant, term or condition of this Agreement, such waiver by City shall not limit City's remedies for any succeeding breach or default of this Agreement. Article VI Miscellaneous 6.1 Independent Contractor. It is understood and agreed by and between the Parties that in satisfying the conditions of this Agreement, Judge is acting independently, and that the Cities assume no responsibility or liabilities to any third party in connection with these actions. All Services to be performed by Judge pursuant to this Agreement shall be in the capacity of an independent contractor, and not as an agent or employee of either Colleyville or Keller. Judge shall supervise the performance of its Services and shall be entitled to control the manner and means by which its Services are to be performed, subject to the terms of this Agreement. As such, the Cities shall not: (1) train the Judge; (2) require the Judge to complete regular oral or written reports; or (3) require any Judge to provide full-time employee services to either city. 6.3 Assignment of Agreement. Judge may not assign this Agreement, or assign or delegate any right or duty under this Agreement, without prior written approval from the Cities. 6.4 Notice. SECTION 2. TERM A. This Agreement establishes a two-year term of office beginning Januaryl, 2000. SALARY Euless agrees to pay Judge, for services rendered pursuant hereto, an annual base salary of Forty -Five Thousand and No/100 Dollars ($45,000.00), payable in installments at the same time as other employees of Euless are paid. SECTION 5. INSURANCE Judge, a her option, may elect to participate in the city of Euless' group insurance program, however, all costs of such coverage shall be borne exclusively by Judge. HOURS OF WORK Judge agrees to and shall devote such time as is necessary for the full and proper performance of her duties and that the compensation herein provided for includes compensation for the performance of all such services. As Presiding Judge, Judge shall also be responsible for temporary assignment of other judges or substitute judges, if necessary, for the expeditious disposition of the business of the Euless Municipal Court of Record. Without limitation thereto, Judge acknowledges that her duties shall include the expeditious and appropriate disposition of offenses for which complaints have been filed in the Euless Municipal Court of Record in accordance with rules of law and procedure governing the Euless Municipal Court of Record, the proper administration of such court and its records in working with the clerk of the Municipal Court of Record and such other employees of the city which may be assigned to the office of the Municipal Court Clerk, the arraignment of persons incarcerated in the Euless municipal jail and the review and issuance of search and arrest warrants. SECTION 7. JUDICIAL TRAINING Judge shall be entitled to one (1) weeks paid leave for judicial training as required for municipal judges by the State of Texas. Euless shall bear the expense of a substitute municipal judge for the period of such authorized absences. SECTION 8. OUTSIDE EMPLOYMENT Judge acknowledges that for and during the term of this Agreement she shall devote such time and effort in the performance of the duties required hereunder as shall be necessary and shall not undertake, nor accept, any outside or other employment which would in any wise limit Judge's availability or performance of her duties hereunder. The Municipal Judge shall preside in a professional and impartial manner and treat parties, attorneys, witnesses, and the public with appropriate judicial decorum. Rulings shall be issued in a timely manner consistent with the Penal Code and the Code of Criminal Procedures. 4. Arbitrate disputes and advise counsel, jury, litigants, or Court personnel on Court procedures; administer the judicial system; settle disputes between opposing attorneys. The Municipal Judge shall maintain decorum and order in the courtroom and shall ensure that all court hearings and business shall be conducted efficiently and promptly as the court schedule dictates. 5. Establish rules of the procedures for questioning witness and defendants for which standard procedures have not been established. 6. Listen to presentation of cases and rule on the admissibility of evidence and methods of conducting testimony. 7. Promptly process and issue search and arrest warrants, set and forfeit bail for Class C misdemeanors falling under Municipal Court jurisdiction; set bail for felonies and misdemeanors as part of magisterial duties or process all duties as a Tarrant County Magistrate in a timely manner. 8. In performing magistrate duties, the Judge shall coordinate with police personnel to conduct arraignments in such a manner to maximize efficient operation of the police. 9. Instruct jury on applicable laws and procedures; direct jury to deduce facts only from evidence presented and sentence or fine offenders if convicted or see page 30 of TMCEC Municipal Judges Book under Duties and Responsibilities. 10. Review and keep current on all new laws, major court decisions and other pertinent information relevant to the revision of Court procedures and operations. 11. Demonstrate efforts to improve operations, be specific, streamline work processes, and work cooperatively and jointly to enable the court personnel to provide quality customer service. 12. Represent the Southlake Municipal Court through attendance at community court -related functions. To avoid the appearance of impropriety the Southlake Municipal Court Judge may not participate in local or State elections.
