HomeMy WebLinkAboutItem 14 - ExcavatorMEMO TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: BRUNO RUMBELOW, CITY MANAGER MEETING DATE: NOVEMBER 15, 2011 SUBJECT: APPROVAL OF A RESOLUTION TO PURCHASE A 2012 EXCAVATOR AS A SOLE SOURCE AND THROUGH AN INTERLOCAL AGREEMENT WITH THE LOCAL GOVERNMENT PURCHASING COOPERATIVE (BUYBOARD) RECOMMENDATION: City Council to consider approval of a resolution for the purchase of a 2012 Gradall XL 3100 -IV wheeled Excavator with attachments as specified by the Public Works department from Kirby Smith Machinery, Inc through an interlocal agreement with Local Government Purchasing Cooperative (Buyboard) and as a sole source determined by the Public Works department. The total cost of this purchase is not to exceed $301,473. FUNDING SOURCE: Funds are available in account 325 - 48910 - 535 -12 (Capital Equipment/Machine Purchase Fund /Stormwater Drainage Utility Fund /FY2012 Acquisitions) in the amount of $325,000. BACKGROUND: This purchase will be made in accordance with an existing Interlocal Agreement with the Local Government Purchasing Cooperative (Buyboard.com) as allowed by Texas Local Government Code, Section 271.102. COOPERATIVE PURCHASING PROGRAM. Bids were taken by the Cooperative and a contract was awarded to the vendor shown below under contract number 345 -10. The Interlocal Agreement and Cooperative Purchasing Agreement satisfy all bidding requirements under the Local Government Code. Council approved the Vehicle and Equipment Replacement list for FY 2012. This list includes the replacement of unit 15898 Public Works Drainage Department 1997 Gradall G3WD Wheeled Excavator. This unit meets the fleet replacement criteria in life cycle cost, time in service and special circumstances. This special and highly utilized unit is November 8, 2011 (15:11 a111p11) used in repairs and maintenance for Drainage, Streets, Parks, material handling and as emergency response equipment for natural disasters. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, AUTHORIZING THE CITY MANAGER OR THE CITY MANAGER'S DESIGNEE TO DECLARE KIRBY SMITH MACHINERY, INC. AS A SOLE SOURCE PROVIDER AS DETERMINED BY THE PUBLIC WORKS DEPARTMENT FOR MACHINERY EQUIPMENT AND AUTHORIZATION TO PURCHASE UNDER AN INTERLOCAL CONTRACT WITH BUYBOARD AS A ONE -TIME PURCHASE AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City of Grapevine, Texas is a local government in the State of Texas and as such is empowered by the Texas Local Government Code, Section 271.102 to enter into a cooperative purchasing program agreement with other qualified entities in the State of Texas; and WHEREAS, the Local Government Purchasing Cooperative (Buyboard.com) is a qualified purchasing cooperative program as authorized by Section 271.102 of the Texas Local Government Code; and WHEREAS, the City of Grapevine, Texas, has established an Interlocal Agreement with the Local Government Purchasing Cooperative (Buyboard.com) and wishes to utilize established contracts meeting all State of Texas bidding requirements; and WHEREAS, the Local Government Purchasing Cooperative (Buyboard.com) has established a contract with Kirby Smith Machinery, Inc. for machinery equipment; and WHEREAS, the City of Grapevine, Texas has a need to replace the Gradall Excavator and that the Department's specifications are such, through staff evaluation, that the only vendor that can meet the specification is Kirby Smith Machinery, Inc. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated in the above preamble are true and correct and are incorporated herein as if copied in their entirety. Section 2. That the City Council of the City of Grapevine authorizes the purchase of a 2012 Gradall Excavator through an lnterlocal Agreement with the Local Government Purchasing Cooperative (Buyboard.com) for $301,473.00. Section 3. That the City Manager, or his designee, is authorized to take all steps necessary to consummate the purchase of said products and services. Section 4. That this resolution shall take effect from and after the date of its passage.
