HomeMy WebLinkAboutItem 07 - Silver Lake Elementary ITEM MEMO TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: BRUNO RUMBELOW, CITY MANAGER MEETING DATE: DECEMBER 16, 2008 SUBJECT: ADVANCED FUNDING AGREEMENT FOR A SIDEWALK PROJECT ON WILDWOOD DRIVE FOR SILVER LAKE ELEMENTARY SCHOOL RECOMMENDATION: City Council consider a resolution approving an advanced funding agreement with the Texas Department of Transportation for a sidewalk project on Wildwood Drive as part of a Safe Routes to School program and take any necessary action. BACKGROUND: Staff prepared and submitted an application to the State under the Safe Routes to School program for the installation of approximately 1,200 feet of sidewalk along Wildwood Drive between Dooley Street and Boyd Drive. The project was selected for grant funding by the State. The sidewalk was identified as being needed as part of a Safe Routes to School Plan that Staff developed for the Silver Lake Elementary School. The sidewalk will provide for a safe pedestrian path for children that live on the east side of Boyd Drive and attend Silver Lake Elementary School. The project cost is estimated at $98,713 and is completely funded by the Grant (there is no local match). An advanced funding agreement is needed before the State can issue us the notice to proceed. The agreement also sets forth the project scope, budget and project specific terms and conditions. Staff recommends approval. RC/rc O:\agenda\121608\AgendaMemo.Advanced Funding Agreement for Safe Routes to School Project.doc December 9,2008(4:42PM) RESOLUTION NO. \./R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE,TEXAS AUTHORIZING A LOCAL TRANSPORTATION PROJECT ADVANCE FUNDING AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION ADDRESSING FUNDING PARTICIPATION LEVEL AND PROJECT SCOPE FOR THE SILVER LAKE ELEMENTARY SCHOOL PROJECT W ITH I N THE CITY OF GRAPEVINE; AND PROVIDING AN EFFECTIVE DATE WHEREAS, a Master Agreement between the City of Grapevine and the State of Texas has been adopted and states the general terms and conditions for transportation projects developed through this Local Project Advanced Funding Agreement "LPAFA"; and WHEREAS, the Local Government prepared and submitted to the State an application for consideration under the Safe Routes to School Program for the project which is briefly described as the Silver Lake Elementary School, herein called the Project; and WHEREAS, federal law establishes federally funded programs for transportation improvements, including safe routes to school programs, to implement its public purposes; and WHEREAS, Title 23 U.S.C. $134 requires that Metropolitan Planning Organizations and the States' Transportation Agencies to develop transportation plans and programs for urbanized areas of the State; and WHEREAS, the Texas Transportation Code, $201.614 directs the State to establish the Safe Routes to School Program to enhance safety in and around school areas through a construction program designed to improve the bicycle and the pedestrian safety of school age children; and WHEREAS, Texas Administrative Code Title 43, Part I, Chapter 25, Subchapter 1, s25.500 -25.505 directs the State to implement the Safe Routes to School Program to enhance safety in and around school areas through a comprehensive program designed to improve the bicycle and pedestrian safety of school age children; encourage a healthy and active lifestyle from an early age; enable and encourage children, including those with disabilities, to walk and bicycle to school; and to facilitate projects and activities that will improve safety and reduce traffic, fuel consumption, and air pollution in the vicinity of schools; and WHEREAS, federal and state laws require local governments to meet certain contract standards relating to the management and administration of state and federal funds; and WHEREAS, the Texas Transportation Commission passed Minute Order 111071 awarding funding for projects in the 2007 Program Call, including the Project; and WHEREAS, the rules and procedures for the selection and administration of the Safe Routes to School Program are established in 43 Texas Administrative Code (TAC) §§ 25.500 et seq. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated in the preamble of this resolution are true and correct and are incorporated herein as if copied in their entirety. Section 2. That the City Council of the City of Grapevine approves entering into a Local Transportation Project Advance Funding Agreement with TxDOT for construction of the Silver Lake Elementary School project within the City of Grapevine. Section 3. That this resolution shall become effective from and after the date of its passage.
