HomeMy WebLinkAboutORD 2007-068 ORDINANCE NO. 2007-68 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS AMENDING THE GRAPEVINE CODE OF ORDINANCES, CHAPTER 11 FIRE PROTECTION AND PREVENTION, TO THE 2006 INTERNATIONAL FIRE CODE AS PUBLISHED BY THE INTERNATIONAL CODE COUNCIL, RELATING TO THIRD PARTY PLAN REVIEW AND INSPECTIONS PROVIDING AMENDMENTS TO SAME, REPEALING CONFLICTING ORDINANCES; PROVIDING A PENALTY NOT TO EXCEED TWO THOUSAND DOLLARS ($2,000.00) FOR EACH SEPARATE OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED UPON EACH DAY DURING OR ON WHICH A VIOLATION OCCURS; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City has previously adopted the 2006 Edition of the International Fire Code published by the International Code Council, as well as amendments to same; and WHEREAS, the City has determined that it would be in the best interest of the general public to have the ability to utilize a State Licensed Fire Protection Engineering Firm to perform third party plan review of fire protection plans and to perform inspections; and WHEREAS, the City Council has determined that the passage of this ordinance is in the best interest of the health, safety and welfare of the public. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated hereinabove are found to be true and correct and are incorporated herein by reference as if copied in their entirety. Section 2. That Chapter 11 Fire Protection and Prevention, of the City of Grapevine Code of Ordinances, Article III, Fire Code, Section 11-40, Code Adopted; Amendments, is hereby amended by the addition of the following: Section 105.4.1 Submittals is hereby amended to read as follows: "105.4.1 Submittals. Construction documents shall be submitted in one or more sets and in such form and detail as required by the fire code official or his designee. The construction documents shall be prepared by a registered design professional where required by the statutes of the jurisdiction in which the project is to be constructed. Fire sprinkler plans, fire alarm plans, hazardous materials plans, and other plans as determined by the fire code official shall be submitted to a third party State Licensed Fire Protection Engineer. Such engineer shall be designated by the fire code official. Plan review fees shall be paid directly to the third party Fire Protection Engineer by the applicant. Section 106.2 Inspections is hereby amended to read as follows: 106.2 Inspections. The fire code official is authorized to conduct such inspections as are deemed necessary to determine the extent of compliance with the provisions of this code and to approve reports of inspection by approved agencies or individuals. All reports of such inspections shall be prepared and submitted in writing for review and approval. Inspection reports shall be certified by a responsible individual. The fire code official is authorized to engage such expert opinion as deemed necessary to report upon unusual, detailed or complex technical issues subject to the approval of the governing body. The fire code official is hereby authorized to engage the services of a State Licensed Fire Protection Engineering firm to perform inspections described by the code. Such Fire Protection Engineering firm shall be designated by the fire code official. Inspection fees shall be paid directly to the Fire Protection Engineering firm by the applicant, property owner, tenant, contractor, or design professional." Section 3. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Thousand Dollars ($2,000.00) for each offense and a separate offense shall be deemed committed each day during or on which an offense occurs or continues. Section 4. All ordinances or any parts thereof in conflict with the terms of this ordinance shall be and hereby are deemed repealed and of no force or effect. Section 5. If any section, subsection, sentence, clause or phrase of this ordinance shall for any reason be held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance. Section 6. The fact that the present ordinances and regulations of the City of Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its passage, and it is accordingly so ordained.
