RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS, MAKING FINDINGS OF CERTAIN
FACTS RELATIVE TO THE PURCHASE OF BENCH
SEATING AND TRASH CONTAINERS; DETERMINING THAT
THE SEATING AND CONTAINERS ARE AVAILABLE FROM
ONLY ONE SOURCE AND AUTHORIZING THE CITY
MANAGER TO EXECUTE SAID CONTRACTS AND
DOCUMENTS AND PROVIDING AN EFFECTIVE DATE
WHEREAS, the City of Grapevine desires to purchase bench seating and trash
containers for Main Street as follows:
12 Ea DuMor 8' long steel seating surface $15,900.00
4 Ea DuMor 4' long steel seating surface $ 4,444.00
8 Ea DuMor Trash Containers 5,544.00
Total ................................................ $25,888.00
WHEREAS, a recommendation was made to the City of Grapevine Historic
Preservation Commission to purchase the seating and containers specified above and
was approved by the Commission on May 24, 2006; and
WHEREAS, Paul E. Allen Company, Inc. is the current distributor and sole provider
of DuMor products and the sole provider of the benches and containers listed above; and
WHEREAS, the State of Texas Local Government Code Chapter 252, Subchapter
B, Section 252.022 (a) (7) (A) provides an exemption to the competitive bidding
requirements for items that are available from only one source.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS:
Section 1. That all matters stated in the above preamble are true and correct and
are incorporated herein as if copied in their entirety.
Section 2. That the City Council of the City of Grapevine authorizes the purchase
of the above listed benches and containers for a total amount not to exceed $25,888.00.
Section 3. That the City Manager, or his designee, is authorized to take all steps
necessary to consummate the purchase of said benches and containers.
Section 4. That this resolution shall take effect from and after the date of its
passage.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS on this the 18th day of July, 2006.
