HomeMy WebLinkAboutItem 05 - FM 2499 Construction ProjectMEMO TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: BRUNO RUMBELOW, CITY MANAGER 3 MEETING DATE: AUGUST 20, 2013 SUBJECT: DFW CONNECTOR MASTER UTILITY ADJUSTMENT AGREEMENT AMENDMENT — FM 2499 tcT�iZ 1 -kTA hIaoiir7_IITiP► City Council consider a resolution amending the current scope of the approved DFW Connecter Master Utility Adjustment Agreement with Northgate Constructors for the necessary relocation and adjustment of City water and wastewater facilities to include the FM 2499 Construction Project relocations in an amount not to exceed $128,401.91, including contingency, authorizing City Manager to execute subsequent work specific Utility Adjustment Agreement Amendments (UAAA), and take any necessary action. FUNDING SOURCE: Funds are available in the following Utility Accounts 200 - 48930 - 534 -8- 000005 WA 200- 48940 - 534 -8- 000005 SW BACKGROUND INFORMATION: The construction of the DFW Connector project necessitated the relocation and adjustment of City water and wastewater facilities throughout the corridor. These relocations and adjustments were performed under a Master Utility Agreement with Northgate Constructors approved by City Council on March 16, 2010. Northgate Constructors has agreed with TxDOT to construct the FM 2499 project in far northeast Grapevine as a change order to the DFW Connector project. As was the case with the Connector project, it is desirable to contract with Northgate Constructors to design and relocate our water and wastewater facilities as their design /build process evolves on FM 2499. By amending our initial agreement to expand Northgate's efforts to design and construct our utility adjustments on FM 2499, we streamline the process. We are able to take advantage of their large engineering staff on site and their subcontractors under contract that can undertake adjustments with very little lead time and can quickly adapt to an evolving schedule. As with the initial agreement, the City still reserves the right to review all plans and can impose restrictions on the work schedule to protect our interests during peak use times of the year. R:\AGENDA\2013 \08 -20 -13 \DFW Connector Master Utility Agreement Amendment - FM 2499.DOC Memo The Master Agreement stipulated the general terms and guidelines under which the City and Northgate Constructors pursued our relocations and adjustments and the same terms and guidelines shall apply to the FM 2499 project. Subsequent Utility Adjustment Agreement Amendments (UAAA) will be approved by staff as the construction components are designed and are ready for construction. Northgate has submitted the estimated cost for our relocations and adjustments for FM 2499. This estimated cost has been developed from the unit prices received from the low bidder and from preliminary engineering plans and quantities for the utility adjustments necessitated by this roadway project. The ultimate scope of relocation and adjustment may be different from the current quantity estimates due to the evolving state of the construction plan development. Staff will keep the City Council informed of any significant modifications to the quantities and subsequent costs as they become evident. In this Master Agreement amendment process, the City Council approves an amendment price for FM 2499 based on the low bid prices and the most up to date quantities available. The staff will then approve supplemental agreements addressing specific components of the project scope with more refined quantities as the final plans are developed in this fast paced design and construction process. Changes will be submitted to the City Council if the cumulative cost of the UAAA's exceeds the agreement price plus a $15,000.00 contingency. Staff recommends approval. Fm a444 FuNOr A)6, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, APPROVING A MASTER UTILITY ADJUSTMENT AGREEMENT AMENDMENT, AUTHORIZING ASSOCIATED EXPENDITURES OF UP TO $128,401.91; AUTHORIZING THE CITY MANAGER TO EXECUTE ALL ASSOCIATED DOCUMENTS AND AMENDMENTS; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the Texas Department of Transportation (TXDOT) has undertaken the reconstruction and widening of the DFW Connector through the use of a Comprehensive Development Agreement (CDA); and WHEREAS, the Developer Team selected by TxDOT through their CDA process as submitting the best proposal is Northgate Constructors; and WHEREAS, the DFW Connector project required the relocation of City water and wastewater facilities; and WHEREAS, Northgate Constructors sought and obtained unit cost estimates forthe City's utility relocations in a competitive manner, and such process meets or exceeds the requirements of Chapter 252 of the Local Government Code; and WHEREAS, the City entered into a Master Utility Adjustment Agreement with Northgate Constructors to provide for the adjustment of City water and wastewater utility facilities by Northgate Constructors and its subcontractors to expedite the aggressive construction schedule for the DFW Connector; and WHEREAS, TxDOT has authorized Northgate Constructors to construct the improvements associated with the FM 2499 Construction Project by change order to the DFW Connector contract; and WHEREAS, the FM 2499 Construction Project requires the relocation of City water and wastewater facilities; and WHEREAS, Northgate Constructors sought and obtained unit cost estimates for the City's utility relocations in a competitive manner, and such process meets or exceeds the requirements of Chapter 252 of the Local Government Code; and WHEREAS, the City's share of the relocation and adjustment costs, including design, based upon the low bidder's unit costs and upon the latest quantity estimates for the utility relocations is $113,401.91; and WHEREAS, the City wishes to enter into a Master Utility Adjustment Agreement Amendment with Northgate Constructors to provide for the adjustment of City water and wastewater utility facilities by Northgate Constructors and its subcontractors to expedite the construction schedule for the FM 2499 Construction Project; and WHEREAS, all prerequisites to the adoption of this resolution have been met, including compliance with the Open Meetings Act and Chapter 252 of the Local Government Code; and WHEREAS, the City Council deems the adoption of this resolution to be in the best interests of the health, safety, and welfare of the public. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated hereinabove are true and correct and are incorporated herein by reference as if copied in their entirety. Section 2. That the City Council hereby approves the Master Utility Adjustment Agreement Amendment with Northgate Constructors for a total amount of $128,401.91 including a $15,000.00 contingency. Section 3. That the City Manager is hereby authorized to execute all associated documents and supplemental amendments not to exceed said amount. Section 4. That this resolution shall take effect from and after the date of its passage. PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS on this the 20th day of August, 2013.
