A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS, CALLING FOR THE 2023 GENERAL
ELECTION OF OFFICERS TO BE HELD ON MAY 6, 20231
DETERMINING THE POLLING PLACE; PROVIDING
SPECIFIC INSTRUCTIONS FOR THE CONDUCTING OF
SAID ELECTION; REPEALING INCONSISTENT
RESOLUTIONS AND PROVIDING AN EFFECTIVE DATE
WHEREAS, Section 41.001(a) of the Texas Election Code provides for the holding
of general city elections on the first Saturday in May; and
WHEREAS, the Charter of the City of Grapevine, Texas provides that the Election
Code of the State of Texas is applicable to the City Council and Run -Off Elections, and in
order to comply with said code an order should be passed establishing the procedure to
be followed in said election, and designating the voting place for said election; and
WHEREAS, the City of Grapevine desires to conduct joint elections pursuant to
the provisions of the Texas Election Code, and as established in a joint election
agreement for election services with the Tarrant County Elections Administrator; and
WHEREAS, all legal prerequisites for the adoption of this resolution have been
met, including but not limited to the Local Government Code and the Open Meetings
Act; and
WHEREAS, the City Council hereby declares that the approval of this resolution
is in the best interests of the health, safety, and welfare of the public.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS:
Section 1. That all matters stated hereinabove are found to be true and
correct and are incorporated herein by reference as if copied in their entirety.
Section 2. An election is hereby called to elect persons to the offices of City
Council Place 5 and City Council Place 6 to be held on Saturday, May 6, 2023.
Section 3. The terms for City Council Place 5 and City Council Place 6 are for
three years to serve until May of 2026, or until their successors are duly elected and
qualified.
Section 4. Qualified persons may file as candidates by filing an application in
the office of the City Secretary, Monday through Friday, 8:00 a.m. until 5:00 p.m.
beginning on Wednesday, January 18, 2023 and continuing until 5:00 p.m. on Friday,
February 17, 2023. The names of eligible and qualified candidates for such office shall be
placed on the ballot for such election by the City Secretary at the time and in the manner
prescribed by law, and the charter and ordinances of the City of Grapevine.
Section 5. Heider Garcia (or his successor), Tarrant County Elections
Administrator, 2700 Premier Street, Fort Worth, Texas 76111, is hereby appointed as
Early Voting Clerk and may appoint additional deputy early voting clerks as necessary to
properly conduct the Election. The Election shall be conducted under the jurisdiction of
the Tarrant County Elections Department (the "Elections Administrator") pursuant to an
Election Services Contract (the "Contract") by and among the Tarrant County Elections
Department, the City and other participating entities, if any, described in the Contract.
The Mayor or the Mayor's designee is authorized to amend or supplement the Contract to
the extent required for the Election to be conducted in an efficient and legal manner as
determined by the Elections Administrator.
Section 6. All early voting shall be conducted pursuant to and in accordance
with the applicable provisions of the State of Texas Election Code. The Elections
Administrator shall determine the early voting place and hours, however, such locations
may be changed if so directed by the Elections Administrator without further action of the
City Council. The Elections Administrator is hereby authorized and directed to make such
changes in locations as may be necessary for the proper conduct of the Election. The
Elections Administrator is hereby authorized to appoint the members of the Early Voting
Ballot Board and the presiding judge and alternate judge in accordance with the
requirements of the Code.
Section 7. That the Tarrant County Elections Administrator/Early Voting Clerk
has established the following dates, times and locations for early voting by personal
appearance:

Section 8. On Election Day, all eligible City of Grapevine voters shall be
permitted to vote in polling place(s) designated by the Elections Administrator. These
locations include Tarrant County Elections Center, 2700 Premier Street, Fort Worth,
Texas 76111 and any polling location in the City of Grapevine and in Tarrant County. The
Election Administrator will provide a final listing of all available polling sites at a future
date. The designated polling locations will be published on the City's website prior to
Election Day.
Section 9. The Elections Administrator shall provide and furnish all necessary
equipment, supplies and personnel to conduct said election. Said supplies and
personnel shall be furnished at the expense of the General Fund of the City of
Grapevine, Texas. Combined ballots may be utilized containing all of the offices and
propositions to be voted on at each polling place, provided that no voter shall be given a
ballot or permitted to vote for any office or proposition on which the voter is ineligible to
vote.
Section 10. The City Secretary is hereby instructed to publish notice of said
election once in a newspaper of general circulation not more than thirty (30) days before
the election and not less than ten (10) days before the election.
Section 11. The Mayor shall issue all necessary orders, writs and notices for said
election and the returns of said election shall be made to the City Secretary after the
close of the polls and the completion of the counting of the ballots.
Section 12. The winner shall receive a majority of the votes cast. If no candidate
receives a majority, a runoff election will be held in accordance with the Texas Election
Code. Any runoff election required for the election of members of the City Council of the
City of Grapevine, Texas, ensuing from the General Election of May 6, 2023, shall be
held on Saturday, June 10, 2023, or as designated by the joint election agreement and
contract in accordance with the election code.
Section 13. This resolution shall repeal every prior resolution in conflict herewith,
but only insofar as the portion of such resolution shall be in conflict, and as to all other
sections of resolutions not in direct conflict herewith, this resolution shall be and is hereby
made cumulative.
Section 14. That this resolution shall be effective from and after the date of its
passage.

RESOLUCION DEL CONCEJO MUNICIPAL DE LA
CIUDAD DE GRAPEVINE, TEXAS, POR LA QUE SE
CONVOCA A LA ELECCION GENERAL DE
FUNCIONARIOS DE 2023 A CELEBRARSE EL 6 DE
MAYO DE 2023; SE DETERMINA EL CENTRO DE
VOTACION; SE DAN INSTRUCCIONES ESPECIFICAS
PARA DICHA ELECCION; SE DEROGAN RESOLUCIONES
INCONSISTENTES Y SE DA UNA FECHA DE ENTRADA
EN VIGENCIA
CONSIDERANDO QUE la Seccion 41.001(a) del Codigo Electoral de Texas
dispone la celebraciOn de elecciones municipales generates el primer sabado de mayo;
Y
CONSIDERANDO QUE la Carta Constitutiva de la ciudad de Grapevine, Texas,
establece que el Codigo Electoral del Estado de Texas es aplicable al Concejo
Municipal y a las elecciones de segunda vuelta y que, para cumplir dicho codigo, se
debe aprobar una orden que establezca el procedimiento a seguir en dicha eleccion,
que designe el lugar de votacion para dicha eleccion; y
CONSIDERANDO QUE la ciudad de Grapevine quiere hacer elecciones
conjuntas de conformidad con las clausulas del Codigo Electoral de Texas y segun to
establecido en un acuerdo de elecciones conjuntas para servicios electorales con el
administrador de elecciones del condado de Tarrant; y
CONSIDERANDO QUE se han cumplido todos los requisitos legales previos
para la adopcion de esta resolucion, incluyendo, entre otros, el Codigo de Gobierno
Local y la Ley de Reuniones Abiertas; y
CONSIDERANDO QUE, por la presente, el Concejo Municipal declara que la
aprobacion de esta resolucion redunda en beneficio de la salud, la seguridad y el
bienestar del publico.
POR LO TANTO, EL CONCEJO MUNICIPAL DE LA CIUDAD DE GRAPEVINE,
TEXAS, RESUELVE:
Seccion 1. Que todos los asuntos declarados arriba son verdaderos y
correctos y se incorporan aqui por referencia como si se copiaran en su totalidad.
Seccion 2. Por la presente, se convoca a una eleccion para elegir personas
para los cargos de concejal de la ciudad lugar 5 y concejal de la ciudad lugar 6, que se
celebrara el sabado 6 de mayo de 2023.
Seccion 3. Los terminos para el concejal de la ciudad lugar 5 y el concejal de
la ciudad lugar 6 son por tres arms para servir hasta mayo de 2026 o hasta que se elija
debidamente a sus sucesores y estos califiquen.
Seccion 4. Las personas calificadas se pueden presentar como candidatas
presentando una solicitud en la oficina de la secretaria de la ciudad, de lunes a viernes,
de 8:00 a. m. a 5:00 p. m. a partir del miercoles 18 de enero de 2023 y hasta las
5:00 p. m. del viernes 17 de febrero de 2023. La secretaria de la ciudad colocara los
nombres de los candidatos elegibles y calificados para dicho cargo en la boleta
electoral para dicha eleccion en el momento y de la manera prescritos por la ley, la
carta constitutiva y las ordenanzas de la ciudad de Grapevine.
Seccion 5. Por la presente, se designa a Heider Garcia (o su sucesor), el
administrador de elecciones del condado de Tarrant, 2700 Premier Street, Fort Worth,
Texas 76111, como secretario de votaciOn anticipada y puede designar secretarios
adjuntos de votacion anticipada adicionales segun sea necesario para hacer
adecuadamente la elecciOn. La elecciOn se hard en virtud de la jurisdiccion del
Departamento de Elecciones del Condado de Tarrant (Tarrant County Elections
Department) (el "administrador de elecciones") en virtud de un contrato de servicios
electorales (el "contrato") entre el Departamento de Elecciones del Condado de
Tarrant, la ciudad y otras entidades que participen, si las hubiera, que se describen en
el contrato. El alcalde, o Ia persona designada por el alcalde, esta autorizado a
enmendar o complementar el contrato en la medida que se necesite para que la
eleccion se haga de manera eficiente y legal segun lo determine el administrador de
elecciones.
Seccion 6. Todas las votaciones anticipadas se haran de conformidad con las
clausulas aplicables del Codigo Electoral del Estado de Texas. El administrador de
elecciones determinara el lugar y el horario de Ia votacion anticipada; aunque dichos
lugares se podran modificar si asi lo indica el administrador de elecciones sin
necesidad de que el Concejo Municipal tome otras medidas. Por la presente, se
autoriza y ordena al administrador de elecciones que haga los cambios en los lugares
que se necesiten para que la elecciOn se haga correctamente. Por la presente, se
autoriza al administrador de elecciones a designar a los miembros de la Junta de
VotaciOn Anticipada, al juez presidente y al juez suplente de conformidad con los
requisitos del Codigo.
Seccion 7. Que el administrador de elecciones/secretario de votaciOn
anticipada del condado de Tarrant ha establecido las siguientes fechas, horarios y
lugares para la votacion anticipada en persona:

Seccion 8. El dia de las elecciones, todos los votantes elegibles de la ciudad
de Grapevine podran votar en los centros de votaciOn designados por el administrador
de elecciones. Estos lugares incluyen el Tarrant County Elections Center, 2700 Premier
Street, Fort Worth, Texas 76111, y cualquier lugar de votacion en la ciudad de
Grapevine y en el condado de Tarrant. El administrador de elecciones dara una lista

sea elegible para votar.
Seccion 10. Por la presente, se instruye a la secretaria de la ciudad a publicar
el aviso de dicha elecciOn una vez en un periodico de circulacion general no mas de
treinta (30) dias antes de la elecciOn y no menos de diez (10) dias antes de la eleccion.
SecciOn 11. El alcalde emitira todas las ordenes, escritos y avisos necesarios
para dicha eleccion y los resultados de dicha eleccion se entregaran a la secretaria de
la ciudad despues del cierre de las urnas y la finalizacion del recuento de los votos.
SecciOn 12. El ganador recibira la mayoria de los votos emitidos. Si ningun
candidato recibe una mayoria, se hara una elecciOn de segunda vuelta de acuerdo con
el Codigo de Elecciones de Texas. La elecciOn de segunda vuelta requerida para la
elecciOn de miembros del Concejo Municipal de la ciudad de Grapevine, Texas, que
resulte de la eleccion general del 6 de mayo de 2023, se hara el sabado 10 de junio de
2023, o segun to designe el acuerdo de elecciones conjuntas y el contrato de
conformidad con el codigo electoral.

Seccion 13. Esta resolucion derogara toda resolucion anterior que este en
conflicto con la presente, pero solo en la medida en que la parte de dicha resoluciOn
este en conflicto, y en cuanto a todas las demas secciones de resoluciones que no
esten en conflicto directo con la presente, esta resoluciOn sera y se hace por la
presente acumulativa.
Seccion 14. Que la presente resolucion entrare en vigor despues de la fecha en
que se apruebe.
