HomeMy WebLinkAboutRES 2023-006RESOLUTION NO. 2023-006 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS AMENDING RESOLUTION NO. 2022- 006 ADOPTED ON JULY 19, 2022, RELATING TO AUTHORIZING LOCAL TRANSPORTATION PROJECT ADVANCE FUNDING PARTICIPATION WITH THE TEXAS DEPARTMENT OF TRANSPORTATION ALTERING FUNDING PARTICIPATION LEVELS AND PROJECT SCOPES FOR HIGHWAY SAFETY IMPROVEMENT PROJECTS AT WILLIAM D TATE AVENUE — MUSTANG DRIVE TO STATE HIGHWAY 114 AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City of Grapevine established the Texas Department of Transportation approved funding participation levels for the development of the Highway Safety Improvement Program on July 19, 2022 by the adoption of Resolution 2022-006; and WHEREAS, it was determined that the William D Tate Avenue — Mustang Drive to State Highway 114 was and on -system project; and WHEREAS, the funding participation wording for the project needs to be revised to the following: William D Tate Avenue — Mustang Drive to State Highway 114 (CSJ: 0902- 90-217 On -System) estimated project cost $365,810.00. Local Government participation estimated $122,225. The Local Government participation will be based on actual costs. 100% of construction overruns are the responsibility of the State and 100% of engineering and environmental overruns are the responsibility of the Local Government; and WHEREAS, the Grapevine City Council strongly supports the efforts of the Metropolitan Planning Organization and Texas Department of Transportation in developing a system of highways in cooperation with local governments; and WHEREAS, the City Council authorizes a Local Project Advanced Funding Agreement with the State of Texas for the construction of the Highway Safety Improvements Program grant investments for the above project; and WHEREAS, the funding shall come from the Capital Projects Street Fund (178); and WHEREAS, the City Manager is authorized to execute all documents necessary to complete this transaction; and WHEREAS, all constitutional and statutory prerequisites for the approval of this resolution have been met, including but not limited to the Open Meetings Act; and WHEREAS, the City Council deems the adoption of this resolution to be in the best interests of the health, safety, and welfare of the public. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated hereinabove are found to be true and correct and are incorporated herein by reference as if copied in their entirety. Section 2. That the City Council of the City of Grapevine approves entering into this Local Project Advanced Funding Agreement with the State of Texas for the construction of the Highway Safety Improvements Program grant investments for the above project. Furthermore, the City authorizes the City Manager to execute all documents necessary to complete this transaction. Section 3. That this resolution shall take effect from and after the date of its passage. Section 4. That it is hereby officially found and determined that the meeting at which this resolution is passed is open to the public and public notice of the time, place and purpose of said meeting was given as required by law.
