HomeMy WebLinkAboutItem 04 - Alcoholic Beverages Fee ScheduleMEMO TO FROM: MEETING DATE SUBJECT RECOMMENDATION: ITEM HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL ROGER NELSON, CITY MANAGERR/ JANUARY 4, 2000 AMEND CHAPTER 4 ALCOHOLIC BEVERAGES FEE SCHEDULE Consider adopting an ordinance amending the Grapevine Code of Ordinances, Chapter 4 Alcoholic Beverages, Section 4-7 Fee Schedule to eliminate fee collection for the Mixed Beverage Late Hours and Caterer's Permits during the first three years of the permits. BACKGROUND: Sections 11.38, 29.03 and 31.04 of the Alcoholic Beverage Code provide that cities may levy and collect a fee not to exceed one-half the State fee for each permit issued for premises located within the City. State law provides that Mixed Beverage Permits, Mixed Beverage Late Hours Permits and Caterer's Permits are exempt for the first three years. The City Code currently exempts the fee for Mixed Beverage permits for the first three years. The proposed amendment would bring the City Code into compliance with State law and eliminate collecting fees for the Mixed Beverage Late Hours Permit and the Caterer's Permit for the first three years following issuance of the permits. There is hereby levied, pursuant to Article 11.38 of the Alcoholic Beverage Code of the State of Texas the following schedule of fees for a license or permit issued for premises located within the city under the Alcoholic Beverage Code, which fees shall be equal at all times to one-half (1/2) of the fee assessed by the State of Texas for each license or permit pursuant to the Alcoholic Beverage Code: (a) For each mixed beverage permit: (1) First through third years ....................................................... $0.00 rjQ� MIN, Vlk�z 1 "11101 (2) Fourth and subsequent years .............................................375.00 (9R and afteF SeptembeF 1, 19844 (b) For each retail dealer's off -premise license ....................................30.00 (c) For each mixed beverage late hours permit:................................... 75.00 (1) First through third years . ......................................................... o.00 (2)_ Fourth and subsequent years. 75.00 (d) For each beverage cartage permit for each holder of a mixed beverage or private club registration permit ........................................................10.00 (e) For each private club late hours permit .........................................375.00 For each caterer's permit:.. ..................................... @ ..... 25G.GG (1) Firstthroughthird years........ 0.00 (2) Fourth and subsequent years. 250.00 (g) For each brewpub permit ............................................................... 250.00 (h) For each winery permit .................................................................... 37.50 (i) For each wine bottler's permit .......................................................112.50 December 28, 1999 (8:47AM) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF -GRAPEVINE, TEXAS AMENDING THE GRAPEVINE CODE OF ORDINANCES, CHAPTER 4, ALCOHOLIC BEVERAGES, SECTION 4-7, FEES -SCHEDULE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED UPON EACH DAY DURING OR ON WHICH A VIOLATION OCCURS; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That the Grapevine Code of Ordinances, Chapter 4, Alcoholic Beverages, is hereby amended in the following particulars, and all other sections, subsections, paragraphs, definitions, words and phrases of said Chapter are not amended but are hereby ratified, verified and affirmed. A. That Section 4-7 Fees -Schedule is hereby amended by amending subsections 4(a), 4(c) and 4(f) to read as follows: "(a) For each mixed beverage permit: (1) First through third years ........................................ $ 0.00 (2) Fourth and subsequent years .............................. 375.00 (c) For each mixed beverage late hours permit: (1) First through third years ........................................ $ 0.00 (2) Fourth and subsequent years .................................. 75.00 (f) For each caterer's permit: (1) First through third years ........................................ $ 0.00 (2) Fourth and subsequent years ................................ 250.00" Section 2. If any section, paragraph or provision of this ordinance or the application thereto any person or situation is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 3. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Thousand Dollars ($2,000.00) and a separate offense shall be deemed committed upon each day during on on which a violation occurs or continues. Section 4. The fact that the present ordinances and regulations of the City of Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the public creates an emergency which requires that this ordinance become effective from and after the date of its passage, and it is accordingly so ordained.
