SUBJECT: EMERGENCY WATERLINE RELOCATION CONTRACT
RECOMMENDATION:
City Council consider adopting a resolution declaring an emergency and awarding a
construction contract to Wright Construction Company in the amount of $86,173.94 for the
relocation of a 12" waterline in the SH 114 / SH 121 right-of-way that is currently in conflict
with the SH 114 / SH 121 Ramp Reversal Project between BS 114L and Main Street,
authorize staff to execute said contract, and take any necessary action.
FUNDING SOURCE:
Funds are currently available in the 1995 Utility Bonds, Account Number 200-48943-534-1.

The proposed waterline relocation is adjacent to the westbound service road of SH 114 / SH
121 between Minters Chapel Road and Trinity Parkway. With the current construction of the
highway ramp reversals between BS 114L and Main Street, a new multi-chamber box culvert
will be constructed in the service road right-of-way from the waterline crossing of SH 114 /
SH 121 to Minters Chapel Road for a distance of approximately 500 feet.
During the initial design of the ramp reversals by TxDOT, the existing 12" waterline was
located in the field east of the problem area which indicated that the line was clear of the
planned box culvert. Preliminary exploration by the contractor has revealed the line to be

angled in a way that it runs immediately adjacent to the north wall of the planned culvert and
will conflict with the construction.
This is an old waterline that cannot be easily shored and protected and should be relocated
and replaced with a new line for the 500 foot length in conflict with the box culvert. The new
location will be approximately 18 feet from the box culvert and well clear of the culvert
construction activities.
Because the water line was not discovered until the TxDOT contractor was on site and
beginning construction, the normal bidding process for construction of this type will result in
a delay for the contractor. The City Attorney has reviewed the situation and agrees that this
case qualifies as an emergency and that the City should contract for this relocation as quickly
as possible.
Staff has negotiated a contract with Wright Construction Company to perform the work with
reasonable unit costs considering the emergency nature of the work. The contract is
significantly below the Engineer's estimate for the relocation.
Staff recommends approval.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS, DECLARING AN EMERGENCY TO
COMPLETE THE NECESSARY CONSTRUCTION WORK
TO RELOCATE AN EXISTING 12" WATERLINE IN
CONFLICT WITH A TEXAS DEPARTMENT OF
TRANSPORTATION CONSTRUCTION PROJECT IN
PROGRESS ; AUTHORIZING EXPENDITURES FOR THE
COMPLETION OF SAID WORK; AWARDING A
CONTRACT AND DECLARING AN EFFECTIVE DATE
WHEREAS, the Texas Department of Transportation has awarded a construction
contract to relocate exit and entrance ramps to State Highway 114 and State Highway
121 in Grapevine; and
WHEREAS, an element of this project consists of the construction of a multi-
chamber box culvert drainage system beneath the westbound service road of State
Highway 114 and State Highway 121; and
WHEREAS, the City has an existing 12" diameter waterline located within State
Highway 114 and State Highway 121 right-of-way that is in direct conflict with this
planned box culvert; and
WHEREAS, delays by the City in relocating this 12" waterline results in delays to
the State's contractor; and
WHEREAS services and material purchases related to the completion of the
work must be accomplished expeditiously in order to complete the work in as timely a
manner as possible, and if not accomplished expeditiously will result in a greater
expense and damage to the State of Texas and potentially the City; and
WHEREAS, the City Council finds and concludes that an emergency exists that
requires the immediate appropriation of funds to preserve the property of the City, to
protect the public health and safety of the City's residents and to preserve the safety of
the City and its citizens; and
WHEREAS, this emergency obligates the City to complete the work in the most
efficient, economical manner; and
WHEREAS, the City Council finds and concludes that the citizens are best
served by the City completing the work without the necessity of accepting additional
competitive bids pursuant to Chapter 252, Texas Local Government Code.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS, THAT:
Section 1. That all matters in the preamble are found to be true and correct
and are incorporated into the body of this resolution.
Section 2. That the City Manager, or his designee, is authorized to expend up
to a total amount not to exceed $86,173.94 to relocate the 12" waterline in conflict with
the State construction project.
Section 3. That the City Manager, or his designee, is authorized to enter into
an agreement for the relocation of the 12" waterline with Wright Construction Company
in an amount of $86,173.94.
Section 4. That this resolution shall take effect from and after its date of
passage.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS on this the 16th day of January, 2001.
