HomeMy WebLinkAboutItem 28 - Precision GolfMEMO TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: ROGER NELSON, CITY MANAGE MEETING DATE: MARCH 20, 2001 SUBJECT: RESOLUTION TERMINATING THE CONTRACT WITH PRECISION GOLF, INC., DECLARING AN EMERGENCY, AND AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO EXECUTE A CONTRACT(S) FOR THE COMPLETION OF PHASE II OF THE GOLF COURSE EXPANSION RECOMMENDATION: City Council to consider a Resolution terminating the contract with Precision Golf, Inc. declaring an emergency, and authorizing the City Manager or his designee to execute a contract(s) for the completion of Phase II of the Golf Course expansion. FUNDING SOURCE: Funds are available in account number 210-48850-341-2, Golf Course Revenue Certificates of Obligation in the amount $1,067,492.96. BACKGROUND: As we have worked to complete Phase II of the Golf Course expansion and remodeling project, the contractor has still failed to commence or complete the remaining punch list items. Staff has put the company on notice that the punch list items must be completed or the City will withhold from final payment an amount necessary to do the work and have the work completed ourselves as we are entitled to under the contract. While none of the individual items on list is large, added together we estimate that it will require $30,000 - $45,000 for the City to hire a contractor or contractors to complete the items. The work needs to be done promptly so that the course will be ready to open by mid-May, 2001. In order to facilitate a timely completion of the punch list, staff is recommending approval of a Resolution terminating the contract with Precision Golf, Inc. declaring this work an emergency and authorizing staff to dispense with bid procedures and hire contractors as needed to finish the work in an amount not to exceed $45,000. Again, funding for this will come from the final payment already authorized for the Golf Course project. A copy of the final punch list and contractor's response is attached. As indicated in our discussion following the walkthrough, it's critically important that we move forward quickly with completion of the punch list items. Following receipt of the punch list, I need a response from you within 24 hours as to your schedule for completion of the items and any comments that you have relative to them. Please note that these items must be completed or substantially completed within ten days or it will be necessary for the City to proceed with further steps to withhold funds from the contract and complete the punch list items ourselves. A representative from Golf Resources will be available to review and discuss specific items with the City of Grapevine and Precision Golf for the purpose of determining clearly the scope and extern of the work necessary to complete each of the items on the punch list. The above punch list relates to the physical repair of the 9 holes constructed by Precision Golf. Two additional items within the signed contract need to be completed before final payment can be released. The contract requires that the contractor provide 200 yards of Greensmix (same specifications and supplier from the project) to Jim Long for his use during the grow in phase. Currently, Jun has received only 50 yards, 150 yards still need to be delivered to fulfill this portion of the contract. The as built portion of the contract requires an accurate (to scale with dimensions) as -built drawing to be prepared by the contractor. This drawing should show all underground drainage materials in the fairways and bunkers. Sub -surface greens drainage shall be drawn to 1"— 20' scale and show accurate location of all installed drain lines. Locations shall be accurate with reference to existing site features and drainage drawings. The large-scale drawing provided by Precision is not acceptable at this point. The drawing we have received is not to scale. It lacks bunker drainage locations and has several areas that are partially erased or do not connect. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, TERMINATING ITS CONTRACT WITH PRECISION GOLF, INC.; FINDING AND DECLARING AN EMERGENCY TO COMPLETE THE NECESSARY CONSTRUCTION WORK ON THE GRAPEVINE MUNICIPAL GOLF COURSE; AUTHORIZING EXPENDITURES FOR THE COMPLETION OF SAID WORK; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City Council of the City of Grapevine (the "City") approved a contract, after completing the statutory competitive bidding requirements, with Precision Golf, Inc., ("Precision"), in the amount of $1,563,610.00 for the reconstruction of nine holes on the Grapevine Municipal Golf Course (the "Work"); and, WHEREAS, the estimated completion date agreed to by Precision for the Work was July 1, 2000; and, WHEREAS, Precision did not substantially complete Phase I in a timely manner and has not completed its contractual obligations to date; and, WHEREAS, the City is experiencing direct and actual damages due to the delay in completion in the form of lost revenue, delays in the subsequently scheduled project, extended architectural services, and increased contractual expenses on City contracts due to rebidding or rescheduling of services, and other damages and expenses; and, WHEREAS, delays by Precision in the completion of the Work and the associated mounting damages continue to mount each week the Work is not complete; and, WHEREAS, services and materials purchases related to the completion of the Work must be accomplished expeditiously in order to complete the project in as timely a manner as possible, and if not accomplished expeditiously will result in a greater expense and damage to the taxpayers of the City; and, WHEREAS, the third nine holes scheduled for renovation cannot reasonably be commenced until the subject nine holes is open and ready for play; and WHEREAS, the third nine holes must be completed in time for the fall growing season of 2001 in order to avoid unreasonable delays in its opening; and WHEREAS, the City Council finds and concludes that an emergency exists that requires the immediate appropriation of funds to preserve the property of the City, to protect the public health and safety of the City's residents and to preserve the safety of the City and its citizens; and, WHEREAS, this emergency obligates the City to complete the Work in the most efficient, economical manner, the City Council finds and concludes that the citizens are best served by the City completing the Work without the necessity of accepting additional competitive bids pursuant to Chapter 252, Texas Local Government Code. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, THAT: Section 1. That all matters in the preamble are found to be true and correct and are incorporated into the body of this resolution. Section 2. That the City's Contract with Precision Golf, Inc. is hereby terminated for default by the Contractor. Section 3. An emergency is hereby declared for the completion of the subject nine holes. Section 4. That the City Manager, or his designee, is authorized and directed to enter into an agreement for the completion of the Work in an amount not to exceed $ 45,000.00. Section 5.
