SUBJECT: CONSIDER MODIFICATIONS TO THE PROFESSIONAL
PHOTOGRAPHY FEES AND POLICIES AT THE BOTANICAL
GARDENS
RECOMMENDATION:
City Council consider approval of a fee schedule for professional photography at the Botanical
Gardens of $50 per hour for Grapevine residents/businesses and $75 per hour for non -
Grapevine businesses and consider approval of modifications to the Professional
Photographer Contract.
BACKGROUND:
Staff established a fee of $25 per hour for professional photography at the Botanical Gardens
in early 2002 in an effort to control photographers and the number of photographers at the
-grdens. A total of 40 permits were issued to photographers in 2004.
Over the past year, staff has received many complaints from citizens regarding professional
photographers at the Botanical Gardens. The main issue is the number of photographers at
the Gardens at the same time. Many of these photographers are from outside of Grapevine
and many are not paying the fee.
According to attached fee survey done by staff, Grapevine is definitely on the low end at $25
per hour. Staff recommends increasing the fee to $50 per hour for Grapevine
residents/businesses and $75 per hour for non -Grapevine businesses. Increasing the fee will
cover the cost of staff monitoring the gardens during peak photography times.
Staff is also recommending a couple of modifications to the Professional Photographer
Contract. The first modification is to add the following language. "Specific areas for a photo
shoot are not designated. Photographers may not block off areas or ask park users to leave.
There will be no more that two professional photographers allowed at the Botanical Gardens
at one time."
The final modification recommended is to increase the length of time for photographer
sessions from one hour to two hours. The modifications are highlighted in the attached
contract. Also attached is a photographer fee survey of several botanical gardens in Texas.
Gtaff and the Parks & Recreation Board recommend approval.

In order to be granted access for the purpose of business and commercial photogra
to the Botanical Gardens at Heritage Park, a $2-5 fee of $50 per hour ,is required
Grapevine and a $75 per hour for non -Grapevine businesses. The following are the
general rules for professional photography at the gardens.
1. A permit is required for business and commercial photography. Permits can be
obtained at the Recreation Administration office at the Community Activities
Center, 1175 Municipal Way or you may call 817-410-3470.
2. Permits must be on your person during the photo session.
3. Photographers and clients cannot stand in or on plant material and landscape
5. There is no charge for professional photography during a scheduled wedding.
6. The length of a photographic session may not exceed I hou two hours.
7. Public restrooms are not available for changing clothes.
I understand that by signing this contract that I am liable for replacement of plant
materials and/or garden accessories damages during a photo/filming session. Upon
receipt of a signed contract and payment of the fee, a permit will be issued. Checks
should be made payable to the City of Grapevine, P. O. Box 95104, Grapevine, Texas,
76099.
I understand that the City of Grapevine is not responsible for any personal injury or
accident that might incur during a filming session. Finally, I understand that the gardens
will not be closed to the public at any time during a photograph session.
