APPROVAL OF A RESOLUTION TO RECAP THE
PLAYGROUND SURFACE AT CASEY'S CLUBHOUSE
City Council to consider approval of a resolution to award a contract to No Fault
Industries, Inc. to recap the current playground surface at Casey's Clubhouse. The total
expenditure for this award would be limited to $19,282.00.

BACKGROUND:
If approved, this procurement will be made in accordance with Texas Local Government
Code, Chapter 252.022 that permits an exemption to the normal bidding procedures for
a procurement of items that are available from only one source.
The current surface material at Casey's Clubhouse has become worn and is in need of
recapping in order to insure the safety of the children at the playground. The vendor that
originally installed the material can provide a SAF DEK product that is designed to meet
the latest test requirements of the U.S. Consumer Products Safety Commission
guidelines for child safety. The process involved requires pouring a new surface over the
existing surface. Because companies will not offer a warranty when recapping is poured
over another vendor's product, it is recommended that the original product manufacturer
be awarded the recapping contract.
Staff recommends awarding a contract to No Fault Industries, Inc. to recap the surface
at Casey's Clubhouse in an amount not to exceed $19,282.00.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS, AUTHORIZING THE CITY MANAGER
OR THE MANAGER'S DESIGNATE TO ESTABLISH A
CONTRACT TO RECAP THE SURFACE AT CASEY'S
CLUBHOUSE FROM NO FAULT INDUSTRIES, INC. AS AN
ONLY SOURCE AND PROVIDING AN EFFECTIVE DATE
WHEREAS, the City of Grapevine, Texas is a local government in the State of
Texas and as such is empowered by Texas Local Government Code, Section 252.022 to
procure items that are available from only one source; and
WHEREAS, No Fault Industries, Inc. provided the original surface at Casey's
Clubhouse and is the only manufacturer that can provide surfacing material over the old
surface that would provide a product warranty.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS:
Section 1. That all matters stated in the above preamble are true and correct and
are incorporated herein as if copied in their entirety.
Section 2. That the City Council of the City of Grapevine authorizes the City
Manager or the Manager's designate to establish a contract with No Fault Industries, Inc.
for the resurfacing of the playground at Casey's Clubhouse in an amount not to exceed
$19,282.00.
Section 3. That this resolution shall take effect from and after the date of its
passage.

GRAPEVINE, TEXAS on this the 19th day of April, 2005.
