SUBJECT: LAKE PARKS IMPROVEMENTS DESIGN — CHANGE ORDER
NO. 1
RECOMMENDATION:
City Council to consider approval of Change Order No. 1 to the Lake Parks
Improvements design contract with Carter & Burgess in the amount of $27,900. The
professional services agreement is attached for Council review.
FUNDING SOURCE:
Funds for professional services provided by Carter & Burgess will come from Certificate
of Obligation Bonds.
BACKGROUND:
At the November 2, 2004 meeting, the Council approved a Professional Services
Contract with Carter & Burgess for the development of a business plan and the design of
improvements outlined in the Five -Year Development Plan for the Corps of Engineers
property at Lake Grapevine. The original contract was for $110,020. The additional
fees requested by Carter & Burgess are for changes to the construction document set
and the business plan to accommodate and expansion of the project budget and
associated meetings/reviews.

hereby requests and authorizes Carter & Burgess, Inc. ("C&B") to perform the following Services:

COMPENSATION to be on a basis of: A Lump Sum amount of $ 27,900.00.
The Additional Services described herein shall be performed in accordance with the original Agreement for
Professional Services dated October 14 2004 (the "Agreement"). The Agreement and this amendment to the
Agreement embody the entire agreement between the parties regarding the subject matter hereof. This
amendment to the Agreement may only be amended by written agreement and executed by all parties.
Any term not defined herein shall be deemed to have the meaning ascribed to it under the Agreement. Except
as expressly amended hereby, all of the terms, provisions, covenants and conditions of the Agreement are
hereby ratified and confirmed and shall continue in full force and effect. This Amendment may not be
assigned by any party without the prior written consent of the parties hereto.
Additional Services authorized in writing or otherwise confirmed by Client will be billed in addition to the lump
sum amount as provided in Paragraph 7 on the other side of this authorization.
If technical or professional services are furnished by an outside source, an additional 15% shall be added to the
cost of the services for Carter & Burgess, Inc.'s administrative costs.
As is customary, deliveries, reprographics and other direct costs shall be billed at cost plus 15%.
The parties agree to the Provisions stated on the other side of this authorization.
