Tate Avenue and is proposed to be platted as Lot 1, 1 Hall -Johnson sy3 ADP I Block 1, Bone Daddy's Addition. The addition acontains 1.85 acres and has approximately 270 feet of frontage along William D. Tate Avenue and 286 Glade Rd. feet of frontage along Mustang Drive. F c REQUESTED CONDITIONAL USE, PLANNED DEVELOPMENT OVERLAY AND COMMENTS: The applicant is requesting a conditional use permit to allow the possession, storage, retail sales and on -premise consumption of alcoholic beverages (beer, wine, and mixed beverages) in conjunction with a restaurant. The applicant is also requesting a planned development overlay to reduce the landscape setback requirement along Mustang Drive and to provide less than 70 percent masonry to the exterior walls. The applicant intends to develop an 8,465 square foot restaurant (Bone Daddy's) with seating for 298 patrons. The applicant is providing 133 parking spaces -34 more than the minimum required. In an effort to accommodate the additional parking on site the applicant is proposing to reduce the landscaped setback area along Mustang Drive to seven feet rather than the 15 -feet that is required. Given the irregular shape of the lot and the lack of 0:\ZCU\CU05-59.4 & PD05-04.4 1 11/10/05 11:20 AM depth along Mustang Drive, providing more parking on site was felt by the applicant to be a higher priority than maintaining a 15 -foot landscaping setback along Mustang Drive. The applicant is providing overall, 30 percent landscaped open space on site, exceeding the minimum requirement by ten percent. The City's traffic engineer has reviewed the layout for Bone Daddy's and has proposed several changes to minimize the traffic impact of this restaurant to the general area. Specifically a dedicated right turn lane into the site off of Mustang Drive is proposed and a double left turn lane from Mustang Drive turning onto William D. Tate Avenue is also proposed. In addition, given the unique appearance of the Bone Daddy's restaurant, the applicant is proposing to provide 30 percent masonry exterior wall coverage rather than the 70 percent minimum that is required. See the attached letter. PRESENT ZONING AND USE: The property is currently zoned "GU" Governmental Use District and is vacant. The subject and surrounding property is zoned "GU" Governmental Use District. Conditional use request CU98-1 0 was approved by Council at their May 5, 1998 meeting which allowed for a convenience store with off -premise sale of alcoholic beverages (beer and wine only) and gasoline sales on the property immediately adjacent to the subject site to the northeast. SURROUNDING ZONING AND EXISTING LAND USE: NORTH: DFW International Airport property SOUTH: DFW International Airport property EAST: DFW International Airport property WEST: DFW International Airport property AIRPORT IMPACT: The subject tract is located within "Zone C" zone of greatest effect as defined on the "Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" map. In Zone C, industrial and commercial uses that can tolerate a high level of sound exposure are appropriate. Box 95104 Grapevine, Texas 76099 Dear Mayor Tate: Per........ 526-6603 Thanks once again to you, Bruno Rumbelow, Tommy Hardy, and Ron Stombaugh for taking the time to recently join us for lunch at Bone Daddy's, and for the opportunity to meet and discuss with Mike Leatherwood, Owner, his proposed plans for a Bone Daddy's for Grapevine on the northwest corner of William D. Tate Avenue and Mustang Drive. As noted in our meeting, this will be Mike's third Bone Daddy's joining two very successful restaurants in Dallas and Austin, and it appears with projected Total Revenue exceeding $5 -Million per year, it would have the honor of being our highest grossing restau- rant of the twelve operations in The CrossRoads of DFW (11) and CrossRoads West (1 plus ExxonMobil). Since this is our final pad site, it is only appropriate that we "close" on a successful note. Although the business matters noted below were reviewed with you and the other City representatives, we thought it would be prudent to share this information with the Councilors and Commissioners, as follows: 0 In 1992, the City and D/FW International Airport contacted us and needed some right-of-way for improvements to Mustang Drive. As outlined in the enclosed copy of the survey, the Airport added 26,044 SF of land to our Ground Lease in ex- change for the necessary ROW deeded to the City for Mustang Drive improvements. Although we had professional planning assistance in agreeing on the new parcel of land, I now have to believe that it was )n6t know at, that time that a mutual access drive would be required; therefore, materially adverse- ly impacting the tract with only 135 feet of depth on the improved Mustang Drive. The above referenced mutual accessway drive plus the current zoning requirement for a landscape setback or buffer of 25 feet along Mustang Drive makes the site unsuitable for Bone Daddy's due to inadequate parking yield. The property is currently zoned Highway Commercial (HC), which mandates the 25 -foot landscaping setback along both Tate and Mustang. Visits with Ron Stombaugh have suggested that rezoning to Planned Development (PD) would provide the necessary flexi- bility for requesting a variance that would leave the 25 -foot landscaping setback along Tate, but would eliminate the similar setback for Mustang. The net result would be 136 parking spaces. • Bone Daddy's would keep the mutual access easement. • All signage and landscaping ordinances would be in compliance. • Per Mike Pyles of D/FW International Airport, all of the other frontage along Mustang, both the south side across from Subject Property,, and the south and north frontages west of Subject will not be required to have a landscape setback. and WHEREAS, the City Council of the City of Grapevine, Texas, does find that the conditional use permit lessens the congestion in the streets, helps secure safety from fire, panic and other dangers, prevents the overcrowding of land, avoids undue concentration of population, facilitates the adequate provisions of transportation, water, sewerage, schools, parks and other public requirements; That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of land described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the tract or tracts of land described herein.
